% 3 . PAYNIEIvT :
'j For the above, the City agrees to pay Advocap a maximt;m of
S22,600.00 in reimbursement for materials purchased for Residential
?.�:abilitation Home Services and for materials used in residential
r�n.abilitation by private contractors who are secured by Advocap to
provide znore technical rehabilitative services. Advocap shaZl bi11
the City on a monthlX voucher basis, itemizing the nature and actual
a�.--lount of materials supplied and used in comp�eted �rojects. Approval
a� pa_y:-tant of the submitted vouchers will be dependent upon the
iollowi.ng criteriae that Advocap`s purchasing pracedure fo� material.
is in�complete compliance with the Oshkosh Municipal Code, and that
Tor all private subcontracted residential rehabilitation services, the
Procurement Standards of Community Development Block Grant Regulations
are complied wi.th, described in Exhibit "B" attached hereto and made
par� hereof; that the projects in which materials have been used, have

be�n physically finished in conformance with Article 5 of this agreement;
a�a t��at those finished projects have been inspected and approved as
�o their completeness �y the City of Oshkosh. The City shall pay 1�dvocap
o� such monthly basis, not to exceed the established maximur.i reimbursement
li�:?it of this agreement. In addition, the City shall receive a monthly
C�,���ulative Progress Report which will catalogue completed and current
housing services as well'as proposed projects. The section o� project
�ro�osals shall include the following: Name, Adc?ress, Priority class-
i�ications, Type of services to be rendered, including specifications,
�=ojected materials cost, and Projected labor, supervision and equipmer_t
cast.
4, ELIGIBILITY:
The eligibility for participation in this program bX residents of
t::e City shall be determined under the tables provided in Exhibit "C"
a�.�ached hereta and made part hereof. Advocap shall retain the respon-
s�bzlity for determining each homeowner's personal/financial eligibility.
T�!e City shall retain the responsibility for determining the housing
t:niL's structura]./financial eligibility tor energy conservation and/or
residential rehabilitation. Final si.te sel.ectians for eriergy conservation
and/or residential housing rehaba.litation wi11 be made ja:�ntly after
review. All re�ords and informat�.on regarding 5uc:h P1�g:�bi,litX det�r-
�inations shall be made available to the City or Advocap upon request.
5. BUILDING CODES:
?�11 work performed by Advocap under this agreement shall comply
w�tn the ordinances of the City and the minimum praperty standards �or
cr� and t«o living units of the United States Department of Housing
and Urban Development. In addition, Advocap shall znsure that al.l
necessary building permits are obtained for the work which Advocap
sh�ll perform under this contract. This work to be done a.s subject to
�.��rification by the City of Oshkosh by an inspection process. Furthermore,
��vocap shall instizute a mutually agreed upon Graduazed Code Compliance
Sys�em of minimum housing code enforcement of those subject properties
seY-ved by Advocap's energy conservation or Re�idential Rehabilitation Home
S�rvices under this agreement, where feasible.
6. REHABILITATION AGREEMENT:
�ttached hereto and made part hereof �.s a copy of the type of
Ggreement that Aduocap shall enter into wa.th each homeowner where
housing rehabilitation, home maintenance or energy conservation
rehabi3itation services are being performed. The City shall not be
� `�iG contingently responsible for compliance costs (example:
,�� ��ditional material) for the fulfillment of the guarantee provisians

,% outlined in the aforementioned agreement; nor shall the City be held
��
contingently responsible for the execution of other, unwritten pro-
visional items.
7. COORD INAZ'ION OF' WORK :
Advocap will coordinate all work performed under this contract
with the work program of the City of �shkosh and its staff. This
coordination and cooperation shall incl.ude but not be limited to the
following areas: -
a. Prior to the commencement of ene.rgy conservation and/or
residential rehabilitation services at any subject property
served under this contrac�, the appropriate sta�f of Advocap
will review and determine with the staff of the City of
Oshkosh, the homeowner's eligibility, the work specifications,
property inspections, and job orders for subject property.
b. The City of Oshkosh shall apprise Advocap of all past or
current building inspection reports which may exist on
subject properzies to be served under this contract.
c. Prior to the commencement of energy conservation and/or
residential rehabilitation services at any subject property
served under this contract, the City of Ushkosh shall make a
determination regarding the historic preservation imgact of
any ��ork to be performed and advise Advocap of the sar.►e. .
d. In the performance of services under this contract, Advocap
agrees to coeperate fully with any efforts within specifi.c
areas of the City of Oshkosh designated by the City of
Oshkosh.
8. ANTIDISCRINIINATION:
In performing the work herein, Advocap agrees tY:at it will not
discriminate against anyone on the basis of race, creed, color, sex,
or•national origin in its employment practices and/or in providing the
services agreed to herein.

c. PROJECT F'UNCTIONS .
It is proposed that the Housing Rehabiiitation Projec� would
have three primary housing-relatc�d funciions. These pt�imary
project functions are:
(a} to provide basic home maintenance services to
elderl� a�nd handicapped hameowners r
(b) to offer° energy conservation rehabilitation
services to low-income, �lderiy, and handi-
capped hom�owner�s t an� '.
(cj to provide ba�i� structuzRal rehabiiit�tion

(� ) Home Maintenance Services: � 7he general scope of v�ork for
. this project function is-to�perform routine household mainten-
ance and minor home repai r far e1 derly and tiandicapped homeown- �
ers who are physically unable to perform such work or financial-
� ly incaoable of hiring it done commercially. Some examples of
the work arhich will be performed under th7s function are:

minor household repair and maintenance;

(2) Er�ergy Conseruaiion Rehabilitation: The scope of work for
tfie energy conservation rehabilitation function is to perform
winterizing rehabiiitation an the hames of eligible elderly,
handicapped, or low-income individuals so as to conserve energy
and reduce fuel and utility costs. Examples of the V�ork which
will be performed under this project function are as fallows:
