BACKGROUND
The proposed dedication is located on property owned by Gen2 Holdings, LLC, the site of Lakeside
Plastics, Inc. who is currently undertaking an expansion project which includes creation of a Certified
Survey Map to consolidate three tax parcels owned by Gen2 Holdings, LLC into one tax parcel.
During the review process, the Department of Public Works requested dedication of a cul-de-sac bulb
to mirror a similar dedication on the south side of W. 33�d Avenue. Per the Subdivision Regulations in
the Zoning Ordinance, dead-end streets are required to have cul-de-sacs dedicated to allow for easy
turnarounds for large trucks, garbage and snow removal equipment. The subject site as well as lands
surrounding the site is currently and has been historically used for industrial purposes and the site is
located within the Aviation Industrial Park, zoned M-3, General Industrial District.
ANALYSIS
The proposed dedication will complete the cul-de-sac bulb near the eastern terminus of W. 33�d
Avenue and although it is not truly at the end of the street, the bulb dedication on the south side of the
street was placed to accommodate the existing development. The proposed dedication mirrors the
south side and will be a 55-foot radius bulb exceeding the minimum requirements of 50 feet. Once
dedicated, a portion of Lakeside Plastics off-street parking area will be located within the right-of-way
however the Department of Public Works has reviewed this issue and does not have any concerns
with this "encroachment" at this time. Staff is recommending a condition that the property owner signs
an encroachment agreement to allow continued use of the parking area located in the new right-of-
way and at such a time that W. 33�d Avenue is reconstructed, the City may require the removal of the
encroaching portion of the parking lot.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its November 17, 2015 meeting.

GENERAL INFORMATION

Action Requested:
The petitioner proposes a partial cul-de-sac right-of-way dedication of a 1,354 square foot (0.031
acre) area located adjacent to 450 W. 33`d Avenue. The subject site is located near the eastern
terminus of W. 33`d Avenue, approximately a quarter mile east of Medalist Dr. and is within the
Aviation Industrial Park.
Applicable Ordinance Provisions: N/A
Property Location and Type:
The proposed dedication is located on property owned by Gen2 Holdings, LLC, the site of
Lakeside Plastics, Inc. Lakeside Plastics is currently undertaking an expansion project; part of the
project includes creation of a Certified Survey Map to consolidate three tax parcels owned by
Gen2 Holdings, LLC into one tax parcel. During the review process, the Department of Public
Works requested the dedication of a cul-de-sac bulb to mirror a similar dedication on the south
side of W. 33`d Avenue (CSM 6813). Per the Subdivision Regulations in the Zoning Ordinance,
dead-end streets are required to have cul-de-sacs dedicated to allow for easy turnarounds for large
trucks, garbage and snow removal equipment.

Once dedicated, a portion of Lakeside Plastics off-street parking area will be located within the
right-of-way. The Department of Public Works has reviewed this and does not have any concerns
with this "encroachment" into the new right-of-way at this time. As a condition, staff is
recommending a condition that Gen2 Holdings sign an encroachment agreement prepared by the
City Attorney's Office to allow continued use of the parking area located in the new right-of-way.
At such time that W. 33rd Avenue is reconstructed with concrete, curb and gutter, the City, at its
discretion, may require the removal of the encroaching portion of the parking lot.
Staff is in the opinion that the proposed right-of-way dedication is consistent with requirements of
the Subdivision Regulations.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the right-of-way dedication of W. 33`d Avenue as requested with the
following condition:
Property owner of 450 W. 33`d Avenue enters into an encroachment agreement for
the existing off-street parking area located within the proposed dedication area.
The Plan Commission approved of the right-of-way dedication as requested with conditions noted.
The following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and
zoning classifications in this area. He discussed that the property owner was combining three tax
parcels into one parcel as part of an expansion project for Lakeside Plastics, Inc. and reviewed the
certified survey map depicting the area. He also discussed the need for the dedication of a cul-de-
sac bulb on dead-end streets to allow for turnarounds for large trucks and that the dedication of this
area was to minor a similar dedication on the south side of W. 33rd Avenue. He explained that a
portion of the off-street parking area for Lakeside Plastics would be located within the right-of-
way once dedicated and the City would require the property owner to sign an encroachment
agreement to allow the continued use of this parking area and may require the removal of the
encroaching portion at some point when W. 33rd Avenue is reconstructed. He also reviewed the
condition related to the encroachment agreement recommended for this request.
Mr. Gray questioned if this was a dead-end street as it appeared to continue beyond the point of the
proposed cul-de-sac.
Mr. Nau responded affirmatively.
Mr. Gray then questioned if the street would be extended over time.
Mr. Nau replied that the street was once intended to extend to the east however this area is now
under private ownership and will be combined with the other parcels into one parcel and the City
has no plans to extend W. 33rd Avenue at this time.
Steve Gohde, Assistant Director of Public Works, added that with the development in this area and
other natural features so he did not see W. 33`d Avenue being extended in the future.
Mike Huddle, representing Gen2 Holdings, LLC, stated that if the City would extend W. 33`a
Avenue, there would be houses in the way and their company did not have any issues with the
encroachment agreement necessary.
Motion by Nollenberger to approve the right-of-way dedication adjacent to 450 W. 33rd
Avenue with the following condition:
Property owner of 450 W. 33rd Avenue enters into an encroachment agreement for the
existing off-street parking area located within the proposed dedication area.
Seconded by Borsuk. Motion carried 7-0.
