PURPOSE: APPROVE AMENDMENT TO ENGINEERING SERVICES
AGREEMENT WITH CH2M HILL ENGINEERS, INC. FOR DESIGN
AND BIDDING SERVICES FOR THE MARION ROAD WATER
TOWER REPLACEMENT (+$237,485.00)

WHEREAS, the City and CH2M HILL Engineers, Inc. (CH2M HILL) previously
entered into a professional services agreement in which CH2M HILL would provide the
City with design and bidding services for the Marion Road water tower replacement; and
WHEREAS, a new location was selected to allow the existing tower to stay in
service while the new tower was being construction; and
WHEREAS, additional engineering services are necessary that are related to the
change in location.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-
16 of the Municipal Code to enter into an amended agreement with CH2M HILL.
BE IT FURTHER RESOLVED that an amendment to the agreement with CH2M
HILL is approved and said City officials are authorized and directed to take those steps
necessary to implement the terms and conditions of the final agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

RE: Amendment to Engineering Services Agreement for Design and Bidding Services for the Marion
Road Water Tower Replacement / CH2M HILL Engineers, Inc. (CH2M HILL) (+$237,485)
BACKGROUND
The Marion Road Water Tower is an elevated 750,000 gallon water storage tank on Marion Road between the
University of Wisconsin-Oshkosh and the City's downtown business district that was erected in 1936. This water
tower has been well maintained and is routinely inspected, but it is near the end of its useful life. In previous
engineering studies performed by CH2M HILL, it was recommended that the City maintain its current volume of
elevated storage in order to continue to cost-effectively provide an adequate volume of high-quality drinking water
and fire protection. CH2M Hill was chosen to perform the design and bidding services for this project. The
original scope of work envisioned replacing the water tower at its current location with an updated tower design
based on input from a stakeholder group. Early in the design discussions, it was suggested that we evaluate
additional location options for this tower. Through the stakeholder meetings, several alternative locations were
suggested. These suggestions were analyzed by CH2M HILL for feasibility and for the ability to provide the
function needed for the water tower. In the end, a location currently owned by the City of Oshkosh
Redevelopment Authority (RDA), was selected to locate the new water tower. This option was selected because
it allowed the existing tower to stay in service while the new tower was being constructed, which reduced
concerns about adequate fire protection while the tower was out of service. A number of ineetings were held with
the RDA to discuss this option and to review questions and concerns. The RDA approved sale of this parcel to
the Water Utility for this construction.
ANALYSIS
The level of water system modeling required to analyze the various new site alternatives is a significant effort that
could not have been foreseen in developing the original scope of services. Changing the location of the tower is a
major change in scope from the original design. The additional services necessary that are related to the change
in location include: surveying and subsurface exploration of new tower site; expanded drainage plan and erosion
control provisions; design and construction detailing to accommodate poor soils; piping connections for the new
water tower to existing water mains; cell phone screening structures on the new water tower; architectural building
structures for the cell phone equipment; additional site security; and site fencing and aesthetics to match current
area development, which must be reviewed and approved by the Planning Commission.
FISCAL IMPACT
Staff has reviewed the amendment and costs. The amount of this contract amendment is $237,485. This will
raise the total contract amount to $420,635. Funds are available in the Property Improvements Section (Water
Utility Funds) of the 2015 Capital Improvement Budget.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized
nature, including engineering services, may be procured without the use of formal, sealed quotes. I have
reviewed the amendment and in accordance with Section 12-16 of the Code, I am hereby recommending that the
Common Council approve this amendment.
