FARM LEASE
T�-ffS LEASE AGREEMII�TI' made and entered into this � day of
__����, 1976, by and between the CITY OF OSHKOSH, a rrnanicipal
corporation located in Winnebago County, GTisconsin, and GORDC)N RADDATZ,
3308 Oregon Street Road, Oshkosh, Wisconsin, hereinafter referred to as
"Lessee'r ,
WITNE�SSETH :
That the City of Oshkosh in consideration of the mutu�.l ag�e�nents
herein made, hereby leases and lets to Lessee, and Lessee hereby leases
and rents f'rom the City of Osrikosh twenty ( 20 ) acres of land lmoran as
the GEORGE FISHER FARM, described as follows:
The North 1/2 of the North 1/2 of the North 1/2 of the
South Ea.st 1/�4 of Section 2, Township 17 North, Rar�ge 16
Ea,st, Town of Nekimi, Winneba.go County, Wisconsin (located
south of present city owned land extending from Wittman
Field to Oregora Street)
To hold for the term of one (1) year from the first day of
January, 1976 to the 31st day of December, 1976 at an annua.l cash rental
of 'I'hree Hundred Dollars ($300.00); said rent shall be payable �n cash
payment on December l, 1976.
IN CONSIDERATION of said leasing, the Lessee fLirther ag�ees as
follows :
l. To pay the rent as above specified.
2. To use the premises for farrning and for no other purpose.
3. To operate and cul'civate the premises in a good and
husband-like manner.
4. To cut down no trees t,rithout the consent of the City.
5. To keep all fences located thereon in a state of repa.ir
substantially similar to the present condition of said fences.
6. To f�.irnish ar:d install such temporary fences whieh Lessee
may deem necessary in the use of said property.
7. To destroy all noxious weeds, in compliance with state Ia�ts
and local regulations pertaining to the control of noxious
weeds in a reasonably thorou�h and corrq�lete manner.
8. To keep the premises in a neat and orderly condition.
9. Not to sublet the premises or any part thereof.

IT IS FUR'I'HER MUI'UALLY AGR�D by and betvreen the parties as
follows:
1. That the City of Oshkosh specifically retains the right to
sell the above described property and to obtain actual possession of all
or any part of said premises upon ten (10) days notice mailed to the
Lessee by certified mail to his last known address and upon offering in
said notice to pay to Lessee an amount of rr�or�ey eaual to the value of
the crops, the value of said crops to be determ3ned as of the date the
notice is given; in ascertaining the value of the crops, the cost of all
labor and seed rr�.y be taken into consideration, being the intent of the
parties herein, however, that all risk in the farming operation be assuirecl
by the Lessee and in case of an extremely good crop the value so to be
determined shall take that act into consideration, and likewise in the
event of a poor crop, said factor shall be taken into consideration in
determining the value of the crops.
The Winnebago County A�icultural A.gent is hereby desa..�ated as
the party to determine the value of said crops and his re�orts s�all be
binding upon the parties hereto. Any fee to be pai.d the Agricultural
Ag�nt for this service, or any other services rendered pursuant to this
Lea.se, shall be paid by the City of Oshkosh. The value of sai,d crops shall
be tendered or paid to the Lessee wi.thin thirty (30) days from the da'te
of the notice aforesaid.
2. That if Lessee shall fail to paty rent as herein prova.ded or shall
make default in any of the agreements herein, he sha.11 forfeit all r'�ts
under this Lease and the City may at its option take immediate �ossession
of the premise and ma.y recover such possession by action of forcible entry
and detainer; and at the ��iration of this Lease the Lessee agr�es, Uritnoui,
f�zrther notice of any kind, to quit and surrender oecupancy and the possessic�
of the premises.

parties hereto and their heirs, executors, ad�inistrators, successors
and assig�s.
