HomeMy WebLinkAbout27958 / 75-16,�.,_..��____._.. _.______ � v _.__.._._.._....^.._. ,� :• . � • ��� � � �,g%�J �` lo' RESOLUTION ...._ _. . . _.._ , �. , __ _ __ _-- -__ _ _ _ _..._.�u _ _:.._- --._. .__..� _ _e_,_�. .� FTHEREAS, Section 66.293 of the Wisconsin Statutes provides that it shall be the duty of every city which proposes the making of a contract �or any pro;ect oi pu�' �c worxs t� ciete�ine tne rate of wage scale which shall be,paid by the cont�ac�or to the employees upon such project, and reference to such scale having to be published in the notices issued for the purposes of securing bids for any project, NOW, THEREFORE, BE IT RESOLVED by the Common Council o� ths City of Oshkosh tn�t the attached schedule marked "Exhi_bit A" and Made a part hereof as though full� set out at length herein is hereby d�termined to be th� rate of wage scale for such p�ablic works; and the City Clerk is directed to file same and to use same in connection with and as directed by said statute, same being the rate of wage scale published by the Builder and Construction Trades Council of Oshkosh and vicinity, and same shall remai:rz in fuli force and effect; and in the even� that the present contracts now under negotiations are adopted resulting in an increase in the rate of wage scale ov�r and above these established in the schedule marked "Exhibit A", the same wage scale adopted as the result of said neyfltiations shall automatically bPcome the rate of wage scale far the City of Oshkosh as required by Section 66.293. Failure to_pay prevailing rate. Any cantractor, subcontractor or agent t�ereof, who fails to pay the prevaiiing rate of wages determined by the department under this subsection or pays jess than 1� times the hourly basic rate of pay for hours warked on the project in excess of tf�e pre- vailing hours determined under this subsection, shall be iiablc to the employes affected in the amount of their unpaid minimum wages or thei.r unpaid overtime compensation and an additional equal arnount as liquida�cd damages. Action ro recove�r th� liabiiity may be maintained in any.court of competent jurisdiction by any one or more employes for and in behali of himseif and other employes similarly situated� No empioye shalt be a party plaintiff to any such action un.less he gives his consent in wr-itinq to become such a party and the consent is filed in the court in which Che .�ction is brought. The court shall, in addit:ion to any jud��ment awarded to the ptaintiff, aliow a reasonable attox'ney's fee and GOStS to be paid by the defendantA _ Payroli records required> Each contractorf subcontractor or agent there��f participating in a project covered by tFFES subsection shall keep full and accurate reco.rds clearly indicating the name and trade or occupation o` every laborer, workman or mechanic employed hy him in connection with Cl�e project and an accurate record of the number of hours worked by each employe and the actual wages paid therefor. .
