representatives of the Oshkosh Fire Department Chief Off icer's
Association, and
, WHEREAS, the conclusions of said negotiations have been •
reduced to the attached agreement,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of Oshkosh that the proper City officials are hereby authorized
and directed to enter into the attach�d agreement with the Oshkosh
Fire Depa�tment Chief Officer's Association for the 1976 calendar
year. -

WORK WEEK
Chief Officers are supervisory personnel and as such are charged with the
responsibility of controlling and directing subordinate personnel in executing their
specified assignments.
Therefore, the duty week shall be determined by the Chief, based upon department
manpower requirements.
ARTICLE II
PAY POLICY
Chief Officers shall be compensated within the pay range as set forth in Schedule
"A", attached hereto and made a part of this agreement.
ARTICLE III
OUTSIDE EMPLOYMENT
Chief Officers shall have the right to seek and hold autside employment upon
approval of the Chief of the department. All requests and approvals or denials shall
be in writing.
ARTICLE IV
HOSPITAL AND MEDICAL INSURANCE - LIFE INSURANCE
HOSPITAL AND MEDICAL INSURANCE
The employer shall pay up to Eighty-eight Dollars and Fif ty-two Cents ($88.52)
per month for each employee toward the premium of the employee's group hospital and
medical policy irrespective of the employee's marital status.
RETIRED EMPLOYEE INSURANCE
B. For those employees on the Oshkosh Fire Department prior to January l,
1974, the City will pay an amount equal to the cost of the current individual group
health insurance premium for retiring employees, for a period not to exceed £ive (S)
years from their date of retirement, providing that such employees have not obtained
health insurance coverage or is not eligible for health insurance coverage through
o*_her emgloyment or any other source. �ny retired employee who ha,s health insurance
benefits or who is eligible for such benefits from any source other than the City of
Oshkosh shall be ineligible for the benefits provided herein.
LIFE INSURANCE
The employer shall pay one hundred per cent (100%) of the Chief Officers state
group life insurance policy.

ARTICLE V
At3THORIZED ABSENCE
Vacation
Each employee with more than one (1) calendar year of continuous service,
shall be granted six work days of vacation leave. Each employee with more than
f ive (5) years of consecutive calendar service, shall be granted seven work days
of vacation leave. Each employee with more than ten (10) years of consecutive
calendar service, shall be granted eight work days of vacation leave. Each
employee with mare than fif teen (15) years of consecutive calendar service shall
be granted ten work days of vacation. Each employee with more than twenty (20)
years of consecutive calendar service shall be granted eleven work days of
vacation. Each employee with less than a full calendar year of service in the
calendar year preceeding shall be granted a vacation in the succeeding year on a
prorated basis equal to the percentage of the year worked as bears to the prescribed
vacation period. Those employees completing their fifth, tenth, fifteenth, and
twentieth years of service shall earn their vacation for that year on a prorated
basis. On separation all vacation shall be paid in proportion to the time
worked.
Sick Leave
Al1 employees shall be entitled to sick Ieave credits on the following
basis:
All Chief Officers shall accumulate sick leave with pay ati the rate of one
(1) working day for each month of service, an unlimited accumulation of sick
leave. A Chief Off icer may use sick leave with pay for absence necessitated by
injury or illness, or exposure to contagious disease when confirmed by a physician.
In order to qualify for sick leave payment, an employee must:
a. Report his absence to his Chief prior to the start of each work day.
b. I:eep his Chief informed on the condition if the absence is more than
one working day.
c. Submit a doctor's certif icate tor such absence upon request of the
employer. The certificate must state the kind and nature of sickness
or injury and whether the employee has been incapacitated for such
period of absence.
d. Apply for such leave according to the procedure established by the
employer.
e. Record of sick leave will be maintained by the Personnel Office.
It is recognized that the serious injury or illness of the spouse or child
of the employee may adversely affect the ability of the employee to perform his
duties efficiently and may necessitate the use of sick leave. However, no ieave
shall be granted under this subsection if the spouse of the employee is employed
and continues to work during the absence of the employee. Any leave granted for
reasons listed in this subsection shall be subject to the general sick leave
provisions with approval of the Fire Chief.

Section 2-138 (d) (4) of the Oshkosh Municipal Code provides as follows:
"Upon written election by the employee filed with the Director of Administration,
an employee injured while on duty and otherwise covered under the provisions
of the Worl:men's Compensation Act, may use accumulated sick leave so as to
draw as paid sick leave an amount which equals the difference between
regular salary and Workmen's Compensation weekly benefits and such sick
leave accumulations charged with 1/3 of a day for each such day; in the
case of inembers of the police and fire departments for the first year of
injury. See Sections 2-162 and 2-163 of this Code."
ARTICLE VII
EMERGENCY LEAVE
Each employee shall be allowed three (3) consecutive calendar days off with
pay in the event of th2 death of such employee's mother, father, son, daughter,
wife, father-in-law, mother-in-law, brother, sister, or step-child, step-father,
step-mother, grandchildren, grandparents or guardian. In the event an employee
is called off from duty because of the death of an above relative, �hat duty day
shall not be counted as part of the three (3) day leave provision.
ARTICLE VIII
HOLIDAY LEAVE
All Chief Officers shall receive five (5) working days off duty with pay in
lieu of the following holidays: rdew Year's Day, Good Friday afternoon (1/2
day), Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Eve
afternoon (1/2 day), Christmas Day, and one Floating Holiday which shall be
earned at the rate of 1/10 day for each month worked, but not to exceed one day.
These Chief Officers may, at their option, forfeit the time off and receive five
(5) days at the enployees current rate. Employees selecting the option payment
must notify the department prior to September lst of the current budget year for
the following year.

Neither party to this agreement by such act at the time hereof or subsequent
hereto agrees to and does waive any rights possessed by it or them under state and
federal laws, regulations or statutes. In the event any clause or portion of this
Agreement is in conflict with Statutes of the State of Wisconsin governing muni.-

cipalities or other Statutes, such clause or portion of the Agreement shall be
declared invalid and negotiations shall be instituted to adjust the invalidated
clause or portion thereof.
ARTICLE XI
PRESENT BENEFITS
The employer agrees to maintain in substantially the same manner such present
benefits not specifically referred to in this Agreement.
ARTICLE XII
TERMINATION OF EMPLOYMENT
The employer shall pay all monies due employees upon the termination of employ-
ment and shall furnisli such employees with a statement of employment if requested to
do so by such employee.
ARTICLE XIII
PENSION
In addition to the Statutory requirements, the employer shall pay to the
retirement fund up to 8% of the employees gross wages. During the month of
retirement of employees under the ss. 62.13 retirement system, bi-weekly con-
tribution shall cease and the amount transferred to the emplo�ees salary�
ARTICLE XIV
UNIFORM ALLOWANCE
The employer will provide a uniform allowance of One Hundred Seventy-
Five Dollars ($175.00) per year to be paid in January of each year. In the
event an employee has worked less than twelve (12) months in the year preceding,
the amount shall be pro-rated.

ARTICLE XV
DURATION
!
This Agreement shall become effective January 1, 1976 and shall remain in
full force and effect until and including December 31, 1976, and shall be auto-
matically renewed from year to year unless negotiations are instituted by Septemlaer
1, 1976 and the first day of September of any subsequent effective year of this
Agreement.
