Dear Polcyholder:
Enclosed is an endorsement to your workers' compensation policy
showing the increase in Wisconsin rates approved by the Office
of the Commissioner of Insurance. The change in rates reflects
.., the increased benefits for injured employees provided
under the December 30, 1975, amendments to the Wisconsin
Workers' Compensation Act (Assembly Bill 1016) and
... assessments levied against insurance carriers for state
costs to administer the Workers' Compensation Program
(Assembly Bill 222). '
Major benefit changes include:
.., an increase in the maximum compensation rate for
temporary disability, permanent total disability, and
death from $108 to $176 (100% of the state's average
weekly wage).
... an increase in the maximum weekly compensation rate
for permanent partial disability from $53 to $57.
... a reduction in the weekly indemnity rate for temporary
total disabilities and permanent total disabilities
from 70% to 2/3 of average weekly earnings.
... an increase in the weekly indemnity rate in death cases
from 50% to 2/3 of the average weekly earnings. (Maxi-
mum death benef it is now $52,800.)
... removal of the statute of limitations on occupational
disease cases, with the provision that payments on claims
made after six years following the date of injury or
twelve years following the date of death or injury in
lung disease cases are to be from the newly established
work injury supplemental fund.
... extension of weekly indemnity benefits during rehabili-
tation beyond 40 weeks if the Department of Industry,
Labor and Human Relations determines additional training
is warranted.

In addition, the new law
... permits workers' compensation cases to be treated by
chiropractors and podiatrists.
... makes the employer liable for lost wages up to one year
for refusal to rehire an injured employee.
... makes the employer liable for medical expenses incurred
by an employee when the employer had knowledge of the
injury and failed to render necessary treatment.
... reduces the waiting period for loss of hearing claims
from six months to two months after removal from noisy
employment.
Another Important Change
... removes the ability of corporation officers, epileptics
and blind persons to nonelect, i.e., elect not to be
subject to the compensation law. Therefore, if any
executive officers or employees have filed nonelections,
such nonelections are not valid effective December 30,
1975, and any endorsement purporting to exclude coverage
for executive officers or other employees who have non-
elected is null and void as of that date. Total remun-
eration for such persons will be included in the premium
base for this policy on and after December 30, 1975, in
accordance with the provisions of the amended Workers'
Compensation Act.
Please contact your sales representative if you have questions
concerning these recent changes in the Wisconsin Glorkers`
Compensation Laws.
