AGREEMEP�T FOR FINANCING IMPROUEMENTS TO FINP,L PLAT OF THIRD ADDITION TO WESTHAVEN (��`� 7 � sa -- �1`�l 3�7C -----� �j . �.Z�'� o % (�� THIS AGREEMENT is made pursuant to Section 30-40 of the Oshkosh F;unicipal Code providing for required improvements in and to the Final Plat of the Third Addition to Westhaven approved by the Oshkosh Common Council on the lst day of July, 1976. 4;HEREAS, the Common Council of the Gity of Oshkosh approved the Final Plat of the Third Addition to Westhaven on July 1, 1976, and 41HERFAS, Section 30-40 (3) of the Oshkosh Municipal Code provides for the installation of the reguired improvements consisting of sewer and water, grading and graveling and street surfacing, including curb and gutter, may be paid for through ihe use of special assessment financing, and WHEREAS, the owners of all the land included in the Final Plat of the Third Addition to l��esthaven have petitioned the City Clerk for special assessment financing pursuant to Section 30-40 (3) of the Oshkosh Municipal Code, IT IS HEREBY AGREED by and between the City of Oshkosh, a municipal corporation located in Winnebago County, State of Wisconsin, hereinafter referred io as "City", and Flanagan and Stauffer,_a copartnership, Fintan h1. Flanagan, individually and as Trustee, and Carol Jean Flanagan, owners of all the land in ihe Final Plat of ihe Third Addition to Westhaven, hereinafter referred to as "arrners" , as fol l ows : 1. The owners covenant and warrant that they are the owners of all land included in the Final Plat of ihe Third Addition to Westhaven. 2. That the owners have petitioned the City Clerk for installation of ine required improvements to said Plat through special assessment financing and to that end, signed waivers for benefits to be conferred upon said land by said improvements without the necessity of public hearing. 3. Such special assessments may be paid as follows: One-tenth (1J10) of said special assessment plus interest at the rate of eight percert (8f) annually, said payments to begin upon certification af the City Engineer that said project has been completed. 4. The owners agree upon voluntary divesture of title to any of the lots in the Final Plat of the Third Addition to Westhaven to fully pay the outstanding assessments against said lot. Divesture of a lot shall mean r} - 7. i the transfer of legal title providing the owner does not retain any lien or mortgage interest in said lot, then he shall pay the assessments in full within one (1) year from the date of sale. Should the owner sell by land contract, the assessments will be due and payable one (1) year from the date of the land contract. 5. Parties hereto agree that the required improvements which are the subject matter of this contract and for which waivers of special assessments have been signed and are attached hereto as Exhibit "A" shall be completed pursuant to Seciion 30-40 of the Oshkosh Mianicipal Code within three (3) years from the date of recording of said Plat. 6. Any refund which may be due as a result of any special assess- ment being in excess of the actual amount paid the contractor is assignable.
