A public hearing tiaas h��ld before th� Board or Public T�tiTOrks on
rionday, August 2, 1976, 4:00 P.M., Room 404, City Hall.
Present: Gerald Konrad, Converse Marks
Project: inTater MainF Cantract 76-1C
Mr. Allan R. Kath, 1402 Liberty St. Code 12-627, $45.95 assessment,
and Mr. Brian C. Bradley, 135Q Liberty St., Code 12-630, $34.00,
were presert.
Mr. Allan R. Kath spoke for both properties. In his case at 1402
Liberty St., his house faces Liberty and he has 86.5' frontage.
On Congress Ave., the street involved� he has a dep�h of 132.5' and
is given credit for 12Q ft., therefore assessed f.or the balance of
12.5' times the frontage for square foot assessment. In a 1_ike
manner, Mr. Bradley has a 64' frontage on Liberty St. and also
a 132.5' depth; excludin� the 120', leaving a balance of 12.5' times
the frontage for square foot assessment. The rate is $.Q425 per
square footo
Mr. Kath said the assessments are unfair as the main is, what he
termed, a replacement, and only two properties are being assessed.
He said they are paying taxes for this larger sized lot and feel
this should entitle them to this main, (which they are not going
to use as they are hooked up for service on Liberty St.) without
charge. He said if this main is a b�nefit to the area bec:ause it
will increase and stabilize water pressure, tahy should two
properties pay for it because they abutt the street i�s laid in.
Mr. Konrad explaaned this is no� a replacement main, and said it
is an additional main to increase pressure in the area. All the
properties involved are corner lots, and by City policy, the property
owners pay for cost on the portion over 120' on the long side of
the lot. Al1 the other lots involved are under the 120' and therefore
no charge is made. It was noted that in some cases long lots facing
a street such as this could be divided and sold as separate lots

Mr. Kath said both his and P�r. Bradley's
deep enough to divide and sell and could
made into addi.tional lots. He would ask
of the assessment charges for them both.
No one else appeared for or against these
and the Hearing was declared closed.
