2. Submit a final grading and drainage plan to the

AGREEME��T FQR FINANCING
IMPROVEMENTS TO FIFTH SUBDIVISION OF LAKEVIEW PARK
-Graber Street and Cliffview Drive-
THIS AGREEMEPJT is made pursuant to Section 30-40 of the Oshkosh
hlunicipal Code providing for required improvements in and to the Fifth
Subdivision of Lakeview Park Plat approved by the Oshkosh Common Council on
the 21st day of October, 1976.
6dHEREAS, the Common Council of the City of Oshkosh approved the
Fifth Subdivision of Lakevievr Park Final Plat on October 21, 1976, and
WHEREAS, Section 30-40 (3) of the Oshkosh Municipal Code provides
for the installation of the required improvements consisting of sewer and water,
grading and graveling and street surfacing, including curb and gutter9 may be
paid for through the use of special assessment financing, and
WHEREAS, the owners of all the land included in the Fifth Subdivision
of Lakevie�v Park have petitioned the City Clerk for special assessments financing
for street surfacing including curb and gutter, pursuant to Section 30-40 (3)
of the Oshkosh Municipal Code,
IT IS HEREBY AGREED by and between the City of Oshkosh, a municipal
corporation located in Winnebago County, State of Wisconsin, hereinafter referred
to as "City" and Louis D. Graber and Kathleen N. Graber, of 683 Hazel Street,
Oshkosh, 4lisconsin, owners of all the land in the Final Plat of the Fifth
Subdivision of Lakeview Park, hereinafter referred to as "Owners", as follows:
1. The owners covenant and warrant that they are the owners of
all land included in the Final Plat of the Fifth Subdivision of Lakeview Park.
2. That the owners have petitioned the City Clerk for installation of
the required improvements to said Plat, for street surfacing including curb
and gutter, through special assessment financing and to that end, signed
waivers for benefits to be conferred upon said land by said improvements
urithout the necessity of public hearing.
3. Such special assessments may be paid as follows: One-tenth (1/10}
of said special assessment plus interest at the rate of eight percent (8%)
annually, said payments to begin upon certification of the City Engineer
that said project has been completed.

4. The owners agree upon voluntary divesture of title to any of the
lots in the Final Plat to Anchorage Park to fully pay the outstanding assess-
ments against said lot. Divesture of a lot shall mean the transfer of legal
title providing the owners do not retain any lien or mor-�gage interest in
said lot; in the event the owners retain a lien or mortgage interest in said
lot, then the assessments shall be paid in full within one (1) year from the
date of sa1e. Should the owner sell by land contract, the assessments will
be due and payable one (1) year from the date of the land contract.
5. Parties hereto agree that the required improvements which are the
subject matter of this contract and for which waivers of special assessments
have been signed and are attached hereto as Exhibit "R�' shall be completed
pur�suant to Section 30-40 of the Oshkosh Municipal Code within three (3)
years from the date of recording of said Plat.
6. Any refund which may be due as a result of any special assessment
being in excess of the actual amount paid the contractor is assignable.
7. That the owners hereby agree to install, under private contract,
sanitary se�ver, water main, sewer and water laterals, and grading and
graveling in said Plat, all in accordance with plans and specifications
approved by the Department of Fublic 4Jorks

by the proper officers of each party and seals to be hereunto affixed all on this
19th day of January, 1977.

The undersigned, owners of proaerty benefited by the following improvemenis
to be made by the City of Oshkosh, Winnebago County, State of Wisconsin, to-wit:
STREET SURFACING, PAVING WITH CURB AND GUTTER, FOR GRABER STREET
AND CLIFFVIEW DRIVE, FIFTH SUBDIVISION OF LAKEUIEW PARK
In consideration of the construction of said improvements by the City of
Oshkosh, �Jisconsin, I hereby admit that such public improvement will benefit said
property and consent to the levying of special assessments against the premises
under Section 66.60 of the Wisconsin Statutes for the cost of such improvements.
In accordance with Section 66.60 (18) of the Wisconsi�n Statutes, I hereby waive all
special assessment notices and hearings required by Section 66.60 of the Wisconsin
Statutes; and i further agrez and admit �hat the benefit of my property from the
construction of such improvements is in proportion to the footage thereof, and that
the benefits for such improvements for each lot are in the amount set forth in the
%llowing exhibit which is hereby made a part hereof, and that there are no damages
resulting therefrom.
