Home My WebLink About28514 / 76-02t • � November 18, 1976 (AS REVISED) # 2 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN FINAL RESOLUTION vacating portion of W. 19th Avenue UNANIMOUSLY APPROVED BY PLAN COMMISSION 8-0 WHEREAS, pursuant to Sec. 66.296 (2) of the Wisconsin Statutes for 1973, the Common Council has heretofore initiated proceedings on October 7, 1976 at a regular meeting of the Common Council to vacate and discontinue the following described street: A part of Lot 16 and Lot 17 in the Subdivision of the SE 1/4 of the SE 1/4 of Section 27, Township 18 North, Range 16 East, per Leach's Map of 1894, 13th Ward, City of Oshkosh, Winnebago County, Wisconsin, containing 8,834.14 square feet of land and being described by: commencing at the southwest corner of said Lot 16, thence North 00° O1' 36" west 30.00 feet along the west line of said Lot 16, thence South 88° 47' 23" East 124.73 feet along a line 30 feet north of and parallel to the south line of said Lot 16, thence southeasterly 111.12 feet along the arc of a curve to the left having a radius of 90.65 feet and a chord of which bears South 53° 37' 08" East 104.50 feet, thence North 88° 47' 23" West 208.74 feet along a line 30 feet south of and parallel to the North line of said Lot 17, also being the south line of said Lot 16, to its intersection with the west line of said Lot 17, thence North 00° Ol' 36" West 30.00 feet along the west line of said Lot 17 to the point of commencement. WHEREAS, a public hearing on the passage of such resolution has been set by the Common Council, which hearing was set for 7:00 p.m, in the Council Chambers of the City Hall, Oshkosh, Wisconsin, on the 18th day of November, 1976 and written notice of such meeting was duly served on the owners of all of the frontage of the lots and lands abutting upon that portion thereof sought to be discontinued as provided by law, and WHEREAS, a public hearing was duly held pursuant to said notice at that time and place therefore affixed and all persons so served and interested were then and there given an opportunity to be heard, and WHEREAS, a proper notice of the pendency of said petition for vacation and discontinuance and map covering the proposed vacation was duly filed in the office of the Register of Deeds for Winnebago County as required by the Wisconsin Statutes, and WHEREAS, the lots and land abutting on said streets affected by this resolution are all in the 13th Ward, City of Oshkosh and as heretofore described, (continued) - 2 - f � � * Res. #2 (as revised) NOW, THEREFORE, BE IT RESGLVED by the Common Council of the City of Oshkosh that it is hereby cieclared that since public interest requires it, the following de�cribed in the 13th Ward, City of Oshkosh, Winnebago County, Wi"consin, is hereby vacated and discon- tinuEd, reserving unto the City of Oshkosh the right to maintain, service, repair, add or replac.e all sanitary sewer, storm sewer, water and gas mains and fittir�gs in said vacated street: A part of Lot 16 and Lot 1.7 in the Subdivision of the SE 1/� of the SE 1/4 of Section 27, Township 18 North, Range 16 East, per Leach's Map c�f 1894; 13th Ward, City of Oshkosh, Winnebago County, Wisconsin; contaii�ing 8,834.14 square feet of land and being described bye ConunE�ncing at the southwest corner of said Lot 16, thence North 00° U1' 36" west 30.00 feet along the west line of said Lot 16, thcr�c�e South 88° 47' 23" East 124.73 feet along a line 30 feet nortYi of and �arallel to the south line of said Lot 16, thence southE�asterly 111.12 fc�et along the arc of a curve to the left having �i radius of 90.65 feet and a chord of which bears South 53° 37' 08" East 104.50 feet, thence North 88° 47' 23" West 208.74 feet �ilong a line 30 feet south of and parallel to the North line c�f said L�t 17, also being the south line of said Lot 16, to its intersecti�n with the west line of said Lot 17, thence North 00° Ol' 36" �dest 30.00 fee�t along the west line of said Lot 17 to the point c>f commencement.
