IMPROVEMENTS TO SEVENTH I�DDITION TO NORTH POINT PLAT

THIS t'�GREENzENT is made pursuaz�t to Section 30-40 of the
Oshkosh Municipal.Code providing �or required impravements in and
to the Sevei�th Addition to North Point Plat approved by the Osnkosh
Common Council on the 20th day of January, 1977.
WHE REAS, the Common Council of the City of �shkosh approved
�he Final Plat of the Seventh Addition to North Point Plat on January
20, 1977, and
WHEREAS, Section 30-40 (3) of the Oshkosh Municipal Code
provides for the instal.lation of the xequired improvements consisting
of s�wer and water, grading and graveling and street surfacing, in-
cluding curb and gutter, may be paid for through �he use of special
�.c;��:�sstnent fina��i.ng, �n��.
WHEREASr the owner of all the lanc� included in the.Seventh
Addition ot North Point Plat has petitioned the City Clerk for special
assessments financing for street surfacing including curb and gut-ter,
pursuant to Section 30-40 {3) o� the Oshkosh Municipal Code,
IT IS HEREBY AGREED by and between the City of Oshkosh, a
municipal corporation located in W.innebago County, State of Wisconsin,
hereinafter r�ferred to as "City" and Shirley L. Doemel, 1825 Hickory
Lane, Oshkosh, Wisconsin, owner of all the land in the Final Plat of �he
Seventh Addition to North Point Plat, hereinafter referred to as "Oa-nex",
as follows:
1. The owner convenants and warrants that she is the owner of
all land included in the Final Plat of the 5eventh Addition to North
Point.
2. That the awner has petitioned the City Clerk for install-
lation of the required improvements to sa.id Plat, �or street sur-
facing including curb and gutter, through special assessinent
financzng and to that end, signed �,vaivers for benefits to be con-
ferred upon said 1and by said improvements without the necessity of
public hearing.
3. Such special assessments may be paid as follows: One-tenth
(I/10) of said special assessment plus interest at the rate of eight
percent (8$) annually, said payments to begin upon certification
of the Ci ty Engineer tha t said project has been completed,

4. The owner agrees upon voluntary divesture of title
to w-�y o` the lots in the Final Plat to Sever_th Ad�i �ion to ,*�dorth
Po� nt Plat �o Lully pay the outstanding asse�s.r:ent�s a,ainst said lot.
Divesture or a lot.sha]_1 mean transfer or lec�al title pr_oviding the
o°r:ner does no-t retain any lien or mortgage in�ei-est in said lot; in
the event tne ot�mer retains a lien or mortgage interest in said lot,
then the assessments shall be paid in ful� within one (1) year from
the date .of sale. Should �he ovrner sell by land contract, the ass�ss-
m�nts will be due and payable one (1) year from the date of the land
contract.
5. Part��s hereto agree that the reguired improvements
w'rlich are the subject matter of tihis contract and for which wai.vers_
o�' special assess�ents have been signed and are attached hereto as

osh'.,osh Municipal Code within three (3) years from the date of reeord-
ing of said Plat. - -
6. Any refund which may be due as a result of any special
assessment being in excess of the actual a*��ount paid the contractor
is assigna.ble.
7. That the owner hereby agrees to install, under private
coritract, sanitary sewer, water main, sewer and water laterals, and
grading a.nd gravel�ng in said Plat, a1i in accardance with ��:l.ans and
specifications approved by the Departrnent af Public Works. The owner
further agrees to pay the total cost of said installatian.

signed by the proper officers of each party and seals to be hereunto
