The te� o= this agreement is to June 16, 1978. - 32 - � A G R E E M E N T 1 � � AGREEMENT made in duplicate this 16th day of June, 1977, by and between the City of Dshkosh, Wisconsin, a municipal corporation, hereinafter called "City" and ADVOCAP, Inc., a SJisconsin non-profit, non-stock corporation, hereinafter called "ADVOCAP." The terrn of this agreement is a period to June 15, 1978- 1. PURPOSE: The purpose of this Agreement is to set forth the terms under which tf�e City will continue to engage ADVOCAP to provide housing rehabilitation as further defined herein to residents of the City of Oskkosh and the payment for the same by the City to ADVOCAP. It is understood by the parties that in addition to the funds being paid by the City to ADVOCAP herein that ADVOCAP also has other funding sources to provide these services and that ADVOCAP is fully able and capable of providing such services. 2. SERVICES TO BE PROVIDED: The service to be provided by the ADUOCAP Housing Rehabilitation Program is structural rehabilitation to the homes of eligible City of Oshkosh residents. During the term of this current agreement, ADVOCAP agrees to provide the comple- mentary property maintenance, home weatherization, and family budget counseling services to residents within the City served under contract. ADVOCAP shall further provide labor, supervision, and equipment necessary to implement their services as outlined in this agreement. 3. PAYMENT: For the above, the City agrees to pay ADVOCAP a maximum amount of Twenty Thousand Dollars ($20,000) from the 1977 Community Block Grant program budget in reimbursement for the materials and services purchased for Residential Rehabilitation Home Services and for the permits, labor and materials used by private contractors who are competively secured by ADVOCAP ta provide plumbing, heating, eiectrical and masonry rehabilitative services. The City also agrees to reimburse ADVOCA up to 30�, not to exceed $1,000 of the direct ADVOCAP labor costs\(at $3.66/hr.) per project site. ADVOCAP shatl bill the City on an invoice/voucher basis, itemizing the nature and actual amount of materials and direct labor supplied and used in completed projec'ts. Approval of payment of the submitted vouchers will be dependent upon the follo��ing criteria: That ADVOCAP has complied with 24 CFR Part 35 (Lead-based paint); that ADVOCAP's contract procedure for all private subcontracted residential rehabilitation,services and material is in complete compliance with the advertising requirements of the Oshkosh Municipal Code; that the Procurement Standards of Community Development Block Grant Reg- ulations are complied with; that the projects in which materials and labor have been used, are physically finished in conformance with Article 5 of this agree- ment; and that those finished projects have been inspected and approved as to their completeness by the appropriate staff of the Oshkosh Community Development Department. The City shall pay A�VOCAP on such voucher basis, not to exceed the established maximum reimbursement limit of this agreement. In addition, the City shall receive a quarterly Cumulative Progress Report which will comprehensively describe completed and current housing-related activities, as well as indicating proposed projects, and the Monthly Manpower Utilization Report (HUD form). 4. ELIGIBILtTY: The eligibility for participation in this program by residents of the City shal] be determined by ADVOCAP under the current NUD Section 8 guidelines for low income, elderly, and handicapped and an asset limit of seven thousand five hundred ($7,500) dollars will be used in the screening process. ADVOCAP shall retain the responsibility for deternining each homeowner's personal/financial eligibility. The City shall retain the responsibility for determining the housing unit's structural and economic eligibility for residential rehabilitation. Final site selections and 4rork order detriminations for residential housing �. � rehabilitation will be made jointly after an environmental review. All records and information regarding such eligibility and work order determi\ations shall be made available to the City or ADVOCAP upon request. 5• BUILDING CODES: All work performed by ADVOCAP under this agreement shall comply with ti�e Building Code of the City and the Property Rehabilitation Standards of the City of Oshkosh. In addition, ADVOCAP shall insure that all necessary buiiding permits are obtained for the work which ADVOCAP or its subcontractor(s) shall perform under this contract. Completion of this work to be done will be subject to verification by the Division of Code Enforcement by an inspection process. 6. REHABILITATION AGREEMENT: Attached hereto and made part hereof is a copy of the type of agreement that ADUOCAP shall enter into with each homeowner where housing rehabilitation services are being performed. The City sha11 not be held contingentTy responsible for compliance costs (i.e. additional material or labor) for the fulfillment of the guarantee provisions outlined in the aforementioned agreement; nor shail tf�e City be held contingently responsible for the execution of other, unwritten provisional items made between ADVOCAP and tF�e homeowner, not expressTy contained in the final work order. Change orders will be approved in writing by the appropriate staff of the Department of Community Development. 7. COORDINATION OF WORK: ADVOCAP will coordinate all work performed under this contract with the work program of the Oshkosh Community Development Department and its staff. This coordination and cooperation shall include but not be limited to the following areas: a. Prior to the commencement of residential rehabilitation services at any subject property served under his contract, the appropriate staff of ADVOCAP will review and deternine with the staff of the Oshkosh Community Development Department, the homeowner's eligibiiity, the work specifications, property inspections, and job orders for subject p+i J�Ci ly. n �� The Oshkosh Community Development Department shaTl apprise ADVOCAP of all past or current building inspection reports which may exist on subject properties to be served under this contract. , c. Prior to the commencement of residential rehabilitafiion services at any subject property served under this contract, the Oshkosh Community Development Department shall make a determination regarding the architectural/historic preservation impact of any work to be performed and advise ADVOCAP of same. d. In the performance of services under this contract, ADVdCAP agrees to cooperate fully with any efforts within specific areas of the City of Oshkosh designated by the Oshkosh Community Development Department. � e. While performing rehabilitative services at any site, ADVOCAP agrees to place a double exposure sign in the front yard of the property. This sign v�rill indicate that the work is being done by ADVOCAP and is a City-sporrsored program. The sign will be placed at the property upon initiation of the actual work and will remain in place untit the voucher is submitfied to the City. 8. ANTI-DISCRiMINATION: ln performing the work herein, ADVOCAP agrees that it will not discriminate against anyone on the basis of race, creed, color, sex, or national origin in its employment practices and/or in providing the services agreed to herein.
