shall be in effect through July 31, 1977.

AGREEMENT made in dupticate this 16th day of June, 1977, by and between the
City of Oshkosh, Wisconsin, a municipal corporation, hereinafter called "City"
and ADVOCAP, Inc., a Wisconsin non-profit, non-stock corporati.on, hereinafter
called "ADVOCAP." The term of this agreement is a period to June 15, 1978•
1. PURPOSE:
The purpose of this Agreement is to set forth the terms under which the
City wil] continue to engage ADVOCAP to provide housing rehabilitation as further
defir.ed herein to residents of the City of Oskkosh and the payment for the same
by the City to ADVOCAP. It is understood by the parties that in addition to the
funds being paid by the City to ADVOCAP herein that ADVOCAP also has other
funding sources to provide these services and that ADVOCAP is fully able and
capable of providing such services.

2. SERVICES TO BE PROVIDED:
The service to be provided by the ADVOCAP Housing Rehabilitation Program
is structural rehabilitation to the homes of eligible City of Oshkosh residents.
During tne term ot this current agreement, ADVOCAP agrees to provide the comple-
r.�ntary property maintenance, home weatherization, and family budget counseling
services to residznts within the City served under contract. ADVOCAP shall
f urther orovide labor, supervision, and equipment necessary to implemeni their
service; as outlined in this agreement.
3. PAYMENT:
For the above, the City agrees to pay ADVOGAP a maximum amount of Twenty
inousand Dollars (520,000) from the 1977 Community Block Grant program budget in
rzirburserent for the materials and services purchased for Residential Rehabilitation
E'o�.e Szrvices and for the permits, labor and materials used by private contractors
;�;ho ars co,7petively secured by ADVOCAP to provide plumbing, heating, electrical

and masonry rehabilitative services. The City also agrees to reimburse ADVOCAP
up to 30�, not to exceed $1,000 of the direct ADVOCAP labor costs (at $3.66/hr.)
per project site. ADVOCAP shatl bill the City on an invoice/voucher basis,
itenizing the nature and actuat amount of materials and direct labor supplied
and used in completed projects. Approval of payment of the submitted vouchers
ti•,ill be dependent upon the following criteria: That ADVOCAP has complied with
24 CFR Part 35 (Lead-based paint); that ADVOCAP's contract procedure for all
private subcontracte� residential rehabilitation services and material is in
cc�plete compliance with the advertisirg requirements of the Osiikosh Municipal
Code; that the Procurement Standards of Community Development Block Grant Reg-
ulations are comptied with; that the projects in which materials and labor have
been used, are physically finished in conformance with �rticle 5 of this agree-
rent; and that those finished projects have been inspected and approved as to
their co�pleteness by the appropriate staff of the Oshkosh Community Development
Cepart�ent. The City shall pay ADUOCAP on such voucher basis, not to exceed the
established maximum reimb�rsement limit of this agreement. In addition, the
City shall receive a quarterly Cumulative Progress Report which witl comprehensively
describe completed and current housing-related activities, as well as indicating
proposed projects, and the Monthly Manpower Utilization Report (HUD form).
4. ELIGIBILITY:
The eligibility for participation in this program by residents of the City
shall be determined by ADVOCAP under the current HUD Section 8 guidelines for
lew incone, elderly, and handicapped and an asset limit of seven thousand five
hundred (57,500) dollars will be used in the screening process. ADVOCAP shall
retain the responsibility for determining each homeowner's personal/financial
eligibility. The City shali retain the responsibility for determining the
housing unit's structural and economic eligibility for residential rehabilitation.
Final site selections and work order detriminations for residential housing
�ehabilitation :��ill be nade jointly after an environmentai review. A1l records
and ir,for:�ation regarding such eligibility and work order determinations shall
Se r.ade available to the City or ADVOCAP upon request.
5. BU l LD I fJG CODES :
Al1 ;�ork perforned by ADVOCAP under this agreement shall comply with the
Suilding Code of the City and the Property Rehabilitation Standards of the City
of Oshkosh. In addition, ADVOCAP shall insure that all necessary building
permits are obtained for the work which ADVOCAP or its subcontractor(s) shall
�arform under this contrac�. Completion of this svork to be dor.e will be subject
to verification by the Division of Code Enforcement by an inspection process.
6. REHABiLlTATION AGREEMENT:
P.ttached hereto and made part hereof is a copy of the type of agreemeRt
�hat AD`l�CAP sha11 enter into with each homeowner where housing rehabilitation
services are being performed. The City shall not be held contingently responsible
ror con�liance costs (i.e. additional material or labor) for the fulfillment of
the guarantee provisions outlined in the aforeme�tioned agreement; nor shail the
City be held contingently responsible for the execution of other, unwritten
;:.rovisio�al itens nade betti•�een ADVOCAP and the homeowner, not expressly contained
in the �inal �,�ork order. Change orders V�ill be approved in writing by the
appro�riate staff of the Department of Community Development.
7. C00?D1NAT10�� dF WORK:
AD':OCAP wi11 coordinate all work performed under this contract with the
•,•rork procram of the Osh�cosh Community Development Department and its staff.
This coordination and cooperation shall include but not be timited to the
oollo�.�+i�g areas:
a. Prior to the commencement of residential rehabilitation services at
any su5ject property served under his contract, the appropriate staff
of ADVOCAP t•till reviear and cfetermine with the staff of the Oshkosh
Co-rnurrity Development Department, the homeowner's eligibility, the
�•;ork s�ecifications, property inspections, and job orders for subject
property.

b. 7ne Oshkosh Cor�munity Development Department shall apprise ADVOCAP of
all past or current building inspection reports which may exist on
subject properties to be served under this contract.
c. Prior to the commencement of residential rehabilitation services at
any subject property served under this contract, the Oshkosh Community
Development Department shail make a determination regarding the
architectural/historic preservation impact of any work to be performed
a�d advise ADVOCAP of same.
c�. ln the performance of services under this contract, ADVOCAP agrees to
cooperate fully with any efforts within specific areas of the City of
Oshkosh designated by the Oshkosh Community Development Department.
e. While performing rehabilitative services at any site, ADVOCAP agrees to
place a double exposure sign in the front yard of the property. This
sign ti�lilt indicate that the work is being done by ADVOCAP and is a
City-sponsored program. The sign will be pTaced at the property upon
initiation of the actual work and will remain in place until the voucher
is subnitted to the City.

In p�rforming the work herein, ADVOCAP agrees that it will not discriminate
