;v'�'"REAS, the presence of a binding arbiter who has no involvement in the
�c�u.�.i�,� would adversely af€ect not only the bargaining process itself, but
t^e egistir�; relationship between the rrnanicipal e�loyer and the municipal
�loyee �.ions involved; and
�ti"r,-.I'�'�:r�S, . binding arbitration would and does discourage honest, good faith
�oliec�icn bargaining;
;ya;T, �'ORE, BE IT RESOLUED by the Comnon Council of the City of Oshkosh,
��.�� for_ the above reasons and r.�a.r�y more, which are too numerous to state, this
"c��:cil stronoly requests the Legislature of the State of Irlisconsin to reject

TN�REAS, the Legislature of the State of Wisconsin presently has before
it Senate Bi_ll 15 which woul.d provide for binding arbitration .in m�u�icipal labor
disputes; and
��REAS, the arbiter would be a�pointed from without the community and
��uld r.ot be accountable either to the co;nrninity itsel.f, the elected officials
of the co:ranunity or the u.nion inv�lved; and
Wf�RE'�S, the Cit� of Oshkosh has continuously negotiated in good faith
�aith its public e�loyee unions; and
Wf�REAS, the ominous ov�rlooking of a bin ding arbiter who has no
in���olvPSnent in the community would adversely affect not only the bargaining
��ess itself, but t-he ex�sting relationship be�u,een the municipal employer
ar�u -the _�;unicipal P.�n�loyee unions involved; and
�•7HEFZEAS, binding arbitration would and does discourage honest, good faith
c�ilection bargaining; and
WI-�RE�1S, it is in the interest of this co:rarnznity and the interest of
t?-his City Council that i_ts em�ployees are treate� fairly and equitably together
�•.ith the other_ variant employer ar.d err�loyee gr�ups throughout the Citj�. It
��;ooves LZS to object to intez-v�ntion of sone pcf,aer that is uriknaan to either
o= t'r�e parties at any tii� until his appointr�nt. '_T'his City and its elected
���:res�-�ta}ives have c_�nsiste� t?y b�rgain�3 with _ts unions for��si�h`Iy and
fa? .r1y, the unions w��_ch re�r�se.^.t the er�lo��ees of the City have barctained
�il.igently, forthrightly and fairly with the City. The results of these
s�ssions over the years have been fair, just and e��:i.tabie rontracts between the
e.--�loyei and the e.r�loyee. Bc�th sides, during �i� bargaining processes, ha:�e
atter�ted to reach an equitable settlement and we u?.�ae the Legislature to
realize �-.hat the local bargaining process, as wi11 certainly happen under Senate
Bill 15, will become �:�:erely a prelude in preparatzo:� for bi.nding arbitration
under a� arbiter who has no local ties or concerns to either the union or the
�ity. It therefore follaw� that not only will the bargaining process set forth
t:.n�:er Section 111.70 of the �•7iseonsin Statutes be denolished but further, that
gc�od labor relatinns ixi ai.y city in this State w�11 beco�� destroyPcl under
the binding arbitration grocess of Senate Bill 15. This d��s'-..nzct��n is inevitable
%•ause neither side wauld believe its bargaining ooponent. The end result
af. the bargaining wi11 have no �ffect and the arbiter who will Ieave will be
the determining fac�or. Therefore, should tne City win a binding arbitration
case, t�ze err�loyeer will be looked daan �orr. Should the union win, the City
a.�c its constituents wi11 look da•m u�on the u.ni.on. There will be no arbiter
to �int a finger at.

NOW Z'HEREFORE, BE IT RESOLUED by the Co�n Council of the City of
Osh�tash that for the above r.easons and many irore, which are too n�rous to
state, this Council strongly requests the Legislature of the State of Wisconsin
tr� re;ect Senate Bill 15.
HE IT FU�fTf�R RESOLVED that the City Clerk send copies of this
i�soluti.on to State Sena.tor Gary R. Goyke and to State Representatives Richard
Flintrop and Gordon R. Bradley.
