PURPOSE: TO AMEND THE CITY'S FLOOD PAIN ORDINANCE
INITIATED BY: DEPARTMENT OF COAiA"liNITY DEVELOPMENT
PLAN COMMISSION RECOMMENDATION:
A GEN�RAL ORDINANCE OF THE CITY OF OSHKOSH A2yIENDING ARTICLE IX OF THE
�SHKOSH riUNCIPAL CODE "SUPPLEMENTARY FLOO� PLAIN ZONING ORDINANCE".

held before the Common Council of the City of Oshkosh concerning
adoption of this amendment to the Oshkosh Supplementary Flood Plain
Ordinance and the Plan Commission having duly recommended the adoption
of this ordinance,
NOG7 THEREFORE, the Common Council of the City of Oshkosh do
�rdain as follows:
SECTION 1. That Article IX of the Oshkosh Municipal Code pertaining
to Flood Plain Zoning is hereby amended as �ollows:
DIVISION 2
SECTIGN 30-58 NONCONFORI'4ING USES
DELETE: (A) The existing lawrul use of a s�tructure or premises
which is not i.n conformity with the provisions
of this Article or any amendmer_t thereto may be
continued subject to the conditions specified
in Section 30-18(�) of this Code.
(B) Any substantial improvement or structura�
alteration, to a nonconforming structur_e, shall
be protected by either floodproofing or elevation
in compliance with Sectioz� 30-59(B) and/or
Section 30-68 {B) (1) .
ADD: In so far as the standards in this section are not inconsistent
with the provisions of Section 62.23(7)(h), Sais. Stats., they
shall apply to a11 nonconforming uses. The ex_isting lawfuZ
use of a structure or building or its accessory use which is
not in conformity with the provisions of this ordinance may
be continued subject to Section 30-18(A) and the follo�ving
conditions:
(A) FLOOnWAY AREAS
(1) No subs�antial improvement or structural alteration shall
be allowed to any existing struc�ures which are not in compliance

with permitted flood*r�ay standards or uses, unless such mod-
ifications or addi.tions meet all �f the following criteria:
(a) The modifications or additions to a structure witl
not increase the amount of obstructian to flood flows
pursuant to Section 30-62(A) of this Ordinance;
(b) Any addition to a structure shall be flood proofed,
by means other than the us� of fill, to the flood protection
elevation.
(2) D10 new well used to obtain wa.ter_ for ultimate human
consumption, or modifications to an existing well, shall be
allowed in a floodway area. Any replacement, repair or
maintenance or a well in a floodway area shall not meet the
appl�_cable provisions of local ordinances and Chapters NR 1.11
and tiR ii�, Wis. Admin. Cc:de.
(B) FLOOD FRINGE AREAS
(1) A]_1 modifications or additions to any nonconiorming
struc�.ure, which do not exceed 500 of its present equalized
assessed value, shall be protected by flood proofing measures
of this Ordinance.
(2) Where compliance with the provisions of subsection (B)(1)
above would result in unnecessary hardship, and only where
the stxuctures v�ill r_ot be e�ther used for human habitation
or be associated with a high flood damage potential, the Boar.d
of Adjustment/Ap�eals, using the procedure in Secf.ion 30-70, may
grant a variance from those provisions, using the criteria
listed below. l�iodifications or additions to structures or
buildings which are protected to elevations lo��ter than the
flood protection elevation may be permitted only if:
(a) Human lives are not endangered;
(b} Public facilitie�, such as water or sewer, are not

(c) Flood depths will r.ot exceed four feet;
(d) F1.00d velocities will not exceed ttao feet per
second; and
(e) The structure will, not be used for sto.rage of materials
described in Section 30-68(A).
(3) Ar_y new, addition to, replacement, repair or naintenance
of a well in a floc�d frince area shall meet tne applicable
provisions of this ordinance and Chapters NR 111 and NR 112,
Wis. Admin. Code.
(4) If a variance is grai�ted, the community snall notify the
property owner that increased flood insurance preniums may result.

be grounds for the removal of land from the flood p].ain
district unl_ess such lands are buil.t to a height of at
least one (1) ��ot above the elevation of the "100-year
regional flood" for the partic�lar area and are contiguaus
to other lands lyinc� autside the flood plain district.
Before removal of lanct from the flood plain the city
shall obtain the concurance of the Wisconsin D�partment
o� Natural Resources and the Federal Insuranc� Admini-
s-t�ation.
(B) Com�liance with �th� provisions of this Article shall not

SECTION 2. This ordinance shall be in full force and effect from
