THIS AGREE��TENT is made pursuant to Section 30-40 of the
Municipal Code providing for required improvements in and to the
Final Plat of the Murdock-Hazel Plat approved by the Oshkosh Common
Council on the 17th day of November, 1977.
WHEREAS, the Common Council of the City of Oshkosh appr_ov-
ed the Fi�nal Plat of the P-iurdock-Hazel Plat on November 17, 1977,
and
WHEREAS, Section 30-40(3) of the Oshkosh Municipal Cade
provides for the installation of the required improvements consist-
ing of storm sewer, sanitary sewer, water main, grading and graveling
and street su�-facing, including curb and gutter, may be paid for
through the use of special assessment financing, and
�VHEREAS, the owner of all the land included in the Final Pl.at
of the Murdock-HazeZ Plat have petitioned the City Clerk for special
assessment financing pursuant to Section 30-40(3) of the Oshkosh
Municipal Code,
IT IS HEREBY AGP.EED by and between the City of Oshkosh, a
AZunicioal corporation located in Winnebago County, State of 6ais-

consin, hereinafter referred to as "City", and Garry Decker, ownerj
Gera,ld I�lerenhausen
of all the land in the Fina1 Plat of the Murdock-Hazel Plat, here-
inafter referred to as "O�•mer", as follows:
Lhey are
l. The owner convenants and warrants that rkrex:.i;�; the owners
of a11 land included .in the Fina1 Plat of the r�urdock-Hazel Plat.
2. That the o�aner has petitioned the City Clerk for in-
stallation af the required improvements to said Plat through special
assessr;eni financing and to that end, signed waivers for benefits to
be conferred upon said land by said improvements wi.thout the necessity
of public hearing.
3. Such special assessments may be paid as follows: One-tenth
(1/10) of said special assessment plus interest at the rate of eight
( 8 J) a:��ually, said payments to begin upon certifica-tion of the Ci.ty
Ene�ineer that said project has been completed.

4. The o�,mer agrees upon voluntary aivesture of title to
any of the lots in the Final Plat of the r�iurdock-Hazel Plat to
fully pay the outstanding assessments againsi said lot. Divesture
of a lot shall mean the transfer of legal title providing the owner
does not retain any lien or mortgage interest in said 1ot; in the
event the o�•mer retains a lien or a mortgage interest in said lot,
that the assessments shall be paid in full within one (1) year from
the date of sale. 5hould the o°.aner sell by land contract, the assess-
ments will be due and payable one (1) year from the date of the 1.and
contract.
5. Parties hereto agree that the required im�rovements
which are subject matter of this contract and for which waivers of
special assessments have been signed and are attached hereto as
Exhibit "A" shall be completed pursuant to Section 30-40 of the Osh--
kosh Municipal Code within three (3) years from the date of recording
of said Plat.
6. Any refund which may be due as a result of any special
assessment being in excess of the actual amount paid the contractor
is assia,nable.

In consideration of the construction of said improver,lents
by the Ci ty of Oshkosh, Wisconsin, I hereby aclmit that such public
i-:provements ��ill benefit said property and consent to the levying
o_ special assessments against the premises under Section 66.60 of
the L•�isconsin Statutes for the cost of such improvements.
In accordance with Section 66.60 (18) of the Z•Jisconsin
Statutes, I hereby waive all special assessrment notices and hearings
required by Section 66.60 of the Tr;isconsin Statutes; and i further
�cree and admit that the benefit oi my property from the construc-
tion of such improvements is in pro�ortion to the footage thereof,
�-�d that the benefits for such improvements for each lot are in the
a�ount set forth in the attached eyhibit which is r:lade a part hereo�,
a�d that there are no damages resulting therefrom.
