A G R E E M E N 7
THIS AGREEMENT IS entered into to be effective on January 1, 197$ by and between
the City of Oshkosh, Wisconsin, party of the first part hereinafter referred to as
the Employer, and the Oshkosh Police Captains Association, party of the second pa rt
hereinafter referred to as the Association.
WHEREAS iN ORDER TO INCREASE GENERR� EFFICtENCY, to maintain the existing
harmonious relations between the Empioyer and its empioye�s, to promote t�e morale,
well being and security of said employees, to maintain an uniform minimum scate of
wages, hours and Eonditions nf empToyment among the erttployees and ta promote arderly
procedures for the processing of any grievance between employees and%r employee and
employer, and the declaration of policies to insure proper and ethical conduct af
business and relations between the Employer and to that end h�ve reached this Rgreement.
NOW, thzrefore, the parties hereto, each in consideration of the Agreeme�ts
herein contained of the other, her.eby agree as foTlows. ..
ARTICLE I
410RK WEEK
Police Captains are supervisory personnel and as such are in charge with the
responsibility of controiling and directing subordinate personnel in executing �Cheir
specified police assic,nnents.
Therefore, the duty week shall be determ�ned by the department f�ead basec! upon
departmental manpawer requirements.
AP.TtCLL i t
UNIFORM MAtNTENANCE
The Employer will provide uniform appareT to all personnel at City expense_ Tf�e
items to be furnished by the City shall include; coats, trousers, hats, ties, shirts,
shoes, leather goods, and other items of uniform apparel required by the City.

Uniform will be inspected periodically by the department head or his agent and
replaced as needed. Replacement orders shall be processed by the City of Oshkosh
Purchasing Division.
Non-uniformed personnel shatl continue to receive a uniform alTowance of $185-00
per year, payable on April 15th. Uniformed captains required to wear plain cTot�es
during a"substantia]" amount of his duty time, shali receive a partial yeariy ciothing
allowance in the amoun� of $50.00 per year. Substantial is defined as at ieast
twenty (20) times per year. �
Cleaning and laundering services will be provided at City expense_ The cTeaning
firm and cleaning schedule sha11 be disignated by the City.
ARTICLE It)
AUiHORIZED LEAVE
Sick Leave: Each regular full time employee shall accmulate sick teave at the
rate of one (1} working day for each month of service.

An emplvyee may usP sick leave with pay for absence necessitated by injury or -
illness. It is further recognized that the serious injury or il.lness of the spouse
or child of the employee may adversely effect the ability of the emptoyee to per�orm
his duties efficiently, and may necessitate the use of sick leave. Howeuer, no Teave
shaTl be granted under this subsection if the spouse of the emptoyee is empioyed and
continues to work during the absence of the officer. It is understood that absences
because of illness of t�e officer's wife, �hiidren, or other member of the famiTy
living at their residence is designed for emergency purposes and the officer shatl
make diligent effort to 1imiC such absences to one day if possible.
To qualiry for sick leave paymen� an empTayee must do the foll�ing:
a.

Report his absence prior ta the start�of each work day to t�e department
' head or supervisor_
Keep his supervisor informed of the canditions if the absence is more t�an
three (3) working days.

c. Upon request submit a doctors certificate for such absence. The cert-
ificate must State t�e nature of the illness or injury and whether the
employee has been incapacitated for the period of his absence_
d. The empToyee upon returning to duty must sign a change of status form
requesting the sick teave b�nefits. Suc11 a signature sfiail ba a� acknow-
iedgement of fuli compliance with all reguiations re}ated td sick leave
benefits as set forth in this Contract.
In fihe event any employee has misused the provisions contained herein or has
requested the use of sick ieave when such leave is �ot a�thorized by t�e terms of _
this contract, the employees absenc� shall be witho�t pay. The determination that an
employee has abused the benefits contained in this paragraph shall not prectude the
employee from using accumulat�d sick leave whe� authori�ed by t�e terms of thfs
contract in the future nor sha11 t�e accumutated sick leave credit to tfiat employee
be effected thereby.
Vacation Leave: Atl full time employees shall be granted the folTowing vacation
benefits: After one (1) year of servic� - ten (10) working days_ After eight (8)
years of service - fifteen (15) working days. After fifteen (15) years of service -
twenty (20) working days. After twenty (20) years of service - twenty-five (25)
working days.
Those employees reaching their eighth, fifteenth, and twentieth year of $ervice
shali earn their vacation for that year on a prd�rated basis. [n the ev�nt an
employee has not wo�ked the full caiendar year prior to �is vacation, such vacation
shall be pro-rated on the time ae�ualTy worked. Vacation.wiit noi be carried over
f rom y�ear to year.
Departmental seniority on shifts shall determine the chaice o-F vacations. tn
case of an empjoyee splitting his vacation, the ernployee`s seTection of addifiioRal
vacation time shall be made ortly after the entire shift has first seiecteci their
vacations. The vacation schedule is su6ject to the staffing requirements o�' ti�e

department as determined by the Police Chief. Vacation may be chosen f rom Jan�ary ],
through December 31.

Holiday Leave: Each full time employee shatl be granted nine and one-haTf (9�)
paid holidays: New Year`s Day, Merr�riaT Day, Independenee Day, Labar Day, Thanksgiving
Day, Christmas Day, Good Friday afternoon, December 24, Washington's Birthday and one
(1) additional flaating holiday shall b� grant�d eac�r empiayee. Such fyaliday leave
shall be granted as nine and one-�alf (9�) days off in lieu of the calendar holidays.
Such holiday leave shail be subject to the departme�tal work schedule and staffing
requiremenfis as determined hy the Police Chief. Employees rnay waive hoiidays off
time in favor p� cash payment. Said cash payment shali b� computed in the foilo�ing
manner: the hourly rate in effect at the time of holiday accruement times t�e number
of holiday hours. Empioy�es electing the aption paymen� must notify the departme�t
head in writing by October lst of the current budge� year for the foliowi�g year.. A
separate check shail be issued for holiday pay. Ail holfdays s�all be credited fia
the employee Janua ry 1 of each year and must be used by December 3t of each year
except a maximum of three (3) holidays may be carri�d over to Apri1 i ot the.follawing
year. Nolidays not us�d within these tim� limits wiil be farfeited.
Emergency �eave: Each empioyee sha11 be allow�d paid.leave nat to exceed fihree
(3) working days far the f�neral of such employee's spouse, father, mother, father-
in-law, mother-in-law, son, daughter, step-child, brofiher and sister. Such teave
shall be only for the purpose of attending the funeral and be fihe period immediateiy
preceeding and including the date of the.funeral or to be the date of the funeral and
the days following.
ARTICLE IV. PAY PERfObS
A11 payroll checks sha11 be paid Bi-Weekty.
ARTtCLE V. HOSPiTAL � MEDfCAL (NSURANCE - LtFE tNSURAHCE
Hospital and Medical (nsurance: 7he Empioyer shall pay �p to One Hundred and
Nine Dollars and Fifty Cents �$109.50) per month far each employee towards the premium
of the employee's group hospital and medical policy irrespectiue of the empTayee`s
marital status.

•The City wili pay an amount equal to the cost of the current individual group

health insurance premium for coverage at tE�e time af retirement for retiring officers
until such officers have attained fihe age of sixty-fiive (65) years, providing that
such officers have not obtained health insurance coverage or is nat eligibte for
health insurance toverage through other employ�nt or any ofiher source. Any retired
employee who has health ins�rance benefits or who is eligibte for such benefits from
any source other than the C i ty of OsFrkost� shal i be i rtel i g i bt e for the benef i ts
provided herein. tn the event, however, that the retired employee exercises the
option to retire before age 60, such payment shaii then cot�tinue for a maximum perioci
of five (5) years f rom the date of retirement. In the even� the employee 'ts retired
mandatorily, then such payments shall continue until age 65 as provided herein.
Life lnsurance: The employer shall pay one hundred per cent (100°6) of the
employee's group )ife insurance poTicy.
ARTiCLE Vt. PENS{ON
fn addition to the Statutory requirements, the employer sha11 pay to tE�e t-etire-
menfi fund up to 6i of the employees gross earnings. During th� rrzonth of retirerrrent
of employees under the ss:62.13 retirement system, the r�tiremer�t contributior� shall
cease and the amount transferred to the employee's saiary.
ARTICLE Vtl. WAlVER OF RIGHT5
Neither party to this agreement by sucFr act at th� time hereof os- subsequent
hereto agrees to and does waive any rights possessed by it or them under state ancf
federal laws, regulations or statutes. In the event any clause or portion of this
agreement is in conflict with Statt�tes of the State of Wisconsin Governing munici-
palities or other stat�at�s such ciause or portions of the Agreement sh�11 be decTared
invaiid and negotiations shall be instituted to adjust the invatidated cTause or
portion thereof.

ARTICLE V[EI
EDUCATION BENEFITS
Enployees in the position c�f Police Captain on December 31, 1g74, sha11 receive
education benefits as outlined b�low. This Articie (V111) shatl not apply to any
employees appointed Poliee Captain after J�nuary t, 1975•
In consideration of the successful completion of thirty-six (36y credits from
t�e curriculum of the University.of Wisconsin Oshkosh, or the Fox Va11e� Technicat
tnstitute, defined as th� Poiice Administration Program; the following schedule of
benefits and provisions apply:

For every thre� (3) credits an employee obtaens in the afore-said program of
study, he shall receive bi-weekly payments as listed below:

Saiary adjustments as contained herein shall be made at the beginning of the
first pay period in February and the beginning of the firsfi pay period in Juty of
each year upon presentatidn of satisfacfiory evidence that.the officer Eeas completed
the a�oresaid courses of instruction. Employees shail not be paid for courses
completed unless the finaT grade re�eived is "C" or b�tter.
A11 eroployees who have completed two (2) years bf service are eltgibte to
participate in tf�e educational pragram set fort(� herein, art employee who has accumulated
credits herein prior to tl�e comptetian of '�4V0 (2) years of service witT receiv� the
compensation as provided herein at such time as he has completed twv (2} years of
service.

SENfORiTY CREDiT
All officers with fifteen (15) years service as of the lst of January, Tg6g,
will receive for purposes of the pay schedule eighteen (i8) credits. These credits
shall be given in addition to whatever credits they may acquire under the.program set
forth herein.
Those employees who are employed prior to the lst day of January, t96g, who �ave
not progressed ih the educational prdgram set forth herein shall receive for pay
purposes anly an additionai ten do}lars ($10.00) per month �pon the comp�etion ofi ten
(10) years of service and an additfonal ten dollars ($10.00) per month upon t�e
completion of twenty (20) years service.
This provision is not to be construed as credit equivalents, nor as ad�itional
benefits to acguired credits. Those employees who quaTify for benefits in th�
previous paragraph sha1T nnt be eligible for the ben�fits contained in this paragraph.
The employer wilt furnish r�quired books and tuttion for certified eourses in
the police administradion program at City expense. All payments shaii be at the - �
undergraduate rate. If an employee wishes to take a graduate course, �e s�a1t be
responsible for the differen�es between the graduate and undergraduate r�te. [f the
employee drops a ciass, the employ�e will be responsible for the costs incurred by
the City for that course inciuding books and tuition. If the reason for the empioyee
dropping the course is due to a shift chang�, the employee witt no� be denied reimburse-
ment. Student classroom and study haurs shall not be cons�rue� as ti�ork hours nor
shali such time be subject to compensatio�. �
No new employee hired after January 1, 196g, for purpases of the saTary schedule
shall be hired 'en oth�r than the first step of the satary schedule unTess educational
achievement is such as the City may choose to start him in a s±ep not to exeeed step
C of the selary schedule. The saTary scheduie is set forth in Appendix R an� in�or-
porated herein 6y reference.

RECOGNtTiON � UNIT OF REPP,ESENTATfON
The City hereby recognizes th� Association as the sole and exclusive bargaining
agent with respect to hours, wages and conditions of empToyment for t�e positions of
Police Captains. �
THIS AGREEMENT shall become effective as of the lst day of January, i978, a�d
�
wi11 remain in full for�e and effect to and in�luding the 31st day of December, 1978.

business and relations between the Employer and to that end have reached this Agreement.
NOW, therefore, the parties hereto, each in consideration of the Agreements
herein contained of the other, hereby agree as foltows.
ARTtCLE t
WORK WEEK
Police Captains are supervisory personnel and as such are in charge with the

Therefore, the duty week shall be determined by the department head based upon
departmental manpower requirements.
ARTICLE lt

ARTICLE I11

benefits as set forth in this Contract.
In the event any employee has misused the provisions contained herein or has
requested the use of sick leave when such leave is not a��horized by the terms of
this contract, the employees absence shall b� witho�►t pay. The determination that ari
employee has abused the ben�fits cbntained in this paragraph sha11 not preclude the
empioyee from using accumuiated sick leave when authorized by the terms of this
contract in the future nor shall the accumulated sick leave credit to that employee
be effected thereby.
Vacation Leave: Atl full time employees shall be granted the following vacation
benefits: After vn� (1) year of servic� - ten (�0) working days. After eight (8)
years of service - fifteen (15) working days. After fifteen (15) years nf service -
twenty (20) working days. After twenty (20} years of service - twenty-five (25)
working days.

employee has not warked the full calendar year prior to his vacation, such vacation

case of an employee spTitting his vacation, the employee's s�lection of additionat
vacation time shali be made only after the entire shift has first selected their
vacations. The vaca�ion sched�le is subjecr to the sta�fing requirements of the

department as determin�d by the Police Chief. Vacation may be chosen from January 1,
through December 31.

ARTICLE IU. PAY PERIODS

ARTICLE V1. PENSION
In addition to the Statutory requirements, the employer shall pay to the retire-
ment fund up to 60 of the employees gross earnings� During the month of retirement
of employees under the ss:62.13 retirement system, the retirement contribution shall
cease and the amount transferred to the �mployee's salary.
ARTlCLE Utl._ WAIVER bF RlGHTS
Neither party to this agreemant by such act at the time hereof or subsequent
hereto agrees to and does waive any rights possessed by it or them under state and
federal laws, regulations or statutes. In the event any clause or portion of this
agreement is in conflict with Statutes of the State of Wisconsin Governing�munici-
palities or other statut�s such cTause or portions of the Agreement shall be declared
invalid and negotiations shall be instituted to adjust the invalidated clause or
portion thereof.

ARTiCLE VIII
EDUCATION BENEFITS
Employees in the position of Police Captain nn December 31, 1974, shall receive
education benefits as outlined below. This Article (V111) shail not apply to any
employees appointed Police Captain aft�r January 1, 197�.
In consideration af the succes�fuT completion of thirty-six (36i credits from
the curriculum of the University of Wisconsin Oshkosh, or the Fox Valley Technical
Institute, defln�d as the Police Administration Program; the following schedWte of
benefits and provisions apply:

Salary adjustment� as contair�ed herein shalt be made at the beginning of the
first pay periad in February and the beginning of the first pay period in July of
each year upon presentation of satisfactory evidence tF�at the officer has completed
the aforesaid courses of instruction. Employees shail not be paid for courses
compieted unTess the final grade r�ceived is "C" or better.
All emptoyees who have completed twa (2) years af servic� are eligible to
participate in the educational program set forth herein, an empioyee who has accumulated
credits herein prior to the completian of two (2) years of service wi1T receive the
compensation as provided herein at such time as he has completed two (2) years of
service.

SENtORtTY CREDIT
All officers with,fifteen (15) years service as of the lst of January, 1969,
will receive for purposes of the pay schedule eighteen (18) credits. These credits
shaZl be given ih addition to whatever credits they may acquire under the program set
forth herein.
Those employe�s who are employed prior ta the lst day of _January, 1g69, who have
not progressed in the educational program set forth herein shalt receive for pay
purposes only an additional ten dollars ($10.00) per month �pon the completion of ten
(10) years of service and an additional ten dollars ($10.00) per month upon the
completion of twenty (20) years service.
This provision is not to be construed as credit equivatents, nor as additional
benefits to acquired �redits. Those employees wha qualify far benefi�s i� the
previous paragraph sha11 n�t be eligible for the benefifis contained in this paragraph.
The employer witl furnish required books and tuition for certified courses in
the police administration program at City expense. All payments shall be at the
undergraduate rate. If an empToyee wish�s to take a�raduate co�rse, he shatl be
responsible for the differen�es between th�.graduate and undergraduat� rat�. If the
employee drops a class, t�e emptoy�� will be responsibie for t�e casts incurred by
the City for that courss including books and tuition. If the reason for the employee
dropping the course is due to a shift change, the empioyee witt not be denied reimburse-
ment. Student classroom an� study h�urs shali not be construed as work hours nor
shail such time be subject to compensation.
No new employee hired after January t, 19b9, for purposes of the salary schedule
shall be hired in oth�r than the firsfi step of the salary schedule unless educational
achievement is such as the City may choos� to start him in a step not to exceed step
C of the salary schedule. The satary schedule is sefi forth in Appendix A and incor-
porated herein by reference.
