PURPOSE: EXECUTE AGREEP�IENT FOR COi'�PLIANCE WITH NATIONAL
HISTORICAL PRESERVATION ACT OF 1966.
. WHEREAS, as a condition of receiving Housing and
Community Development Block Grant fUI1dS, the City of Oshkosh
is required to comply with the National Historical Preser-
vation Ac�t of 1966,

NOW, THEREFORE, BE IT RESOLVED by the Common Council
of the City of Oshkosh that appropriate City officials are `�

hereby authorized and directed to enter into the attached
Memorandum of Agreement between the City of Oshkosh,
the Ac�visory Council on Historical Preservation, and the
Wisconsin State Historical Society.

PIEMORANDUM OF AGREEPAENT
WHEREAS, in accordance with the prova.sions of the Housing and
Community Development Act of i974, the Ci�y of Qshkosh, Wisconsin, prapose�
to fund a Housing Rehabilitation Assistance Progxam; and,
WHEREAS, the City of Oshkosh, Wisconsin, in consultation with Che
Wisconsin State Historic Preservation Officer, has determined that implementation
of this project may adversely affect properties eligible for inclusion in the
National Register of Historic Places; and,
WHEREAS, pursuant to Section 106 of the National Historic Preservation
Act of 1966 the City of Oshkosh, [disconsin, has requested the comments of the
Advisory Council on Historic Pxeservatzon; and,
WHEREAS, pursuant to the procedures oi the Advisory Council on �tistoric
Preservation (36 C.F.R. Part 800), representatives of the Advisory Council,
the C�ty of Oshkosh, idisconsin, and the Wisconsin State Historic Preservation
Officeg have consulted and reviewed the proposed undertaking to consider
alternatives to avoid or satisfactorilq mitigate adverse effects An historiG
properties; now,
THEREFORE:
It is mutually agreed that implementation of the Housing Rehabilitation
Assistance Program in the Ci[y of Oshkosh, Wiscomsin, in aecordance with the
following stipulatior_s, �vill provide measures adequate to avoid or satis—
factorily mitigate any adverse effects and will therefore constitute
satisfactory compliancs with Advisory Council Procedures.
Stipulations
1. Applications for grants and interest subsidies for all p�roperties
that may underoo change, beneficial or adverse, in their historic�2,
architectural or cultural quality as a result of the Housing Rehabi2itation
Assistance Program will be reviewed by the Oshkosh Historic Preservation
Committee, or appropriate city personnel designated to act on their behalf.
In consultation with the Wisconsin State Historic Preservation Officer, the
Oshkosh Historic Preservation Committee will apply the Criteria for
listing properties in the National Register of Historic Places (found in
36 CeF.R. Part 800.10) to these properties,

a. Those properties that appea� to meet the Criteria wil� be
referred by the Historic Preservatic�n Committee to the Ci�S� af
Oshkosh for appropriate action as described in Point ��2 belaw.
b. For [hose proper�ies that fail to meet the Criteria, the
Historic Preservation Committee will record the xeasons therefore,
and no further action will be taken.
co If it is questionable whether the Criteria are met, the
Historic Preservation Committee will immediately request, on.
behalf of the City of Oshkosh, a determination of eligibility
from the Secretary of the Interior in accordance with prescribed
procedures found in 36 C.F.R. Part 63. If the Secretary of the
Interior determines the property to be eligible for inclusion, the
Historic Preservation Committee will refer the property to the City o£
Oshkosh for appropriate action as described in Point ��2 below.
d. Those properties that appear to meet the Criteria ("a" above)
or are determined by the Secretary of the Interior to be eligible
foa° inclusion in the National Register ("c" above) will be nominated
to the National Register of Historic Places by the City of Oshkosh
through the process provided for in the State of Wisconsin.
2. Properties that appear to meet the National Register Criteria �r are
determined to be eligible for inciusion in the National Register for
which modifications funded through the Housing Rehabilitation Assistance
Program are planned will be treated in accordance with the Secretary of
the Interior "Standards for Rehabilitation and Guidelines for P.ehab-
ilitating Historic Buildings," attached to this Agreement. Such rehab-
ilitation will have no adverse effect on those properties. In instances
where the re1-�abilitation guidelines cannot be met, or where demolition
is the reco�mended treatment, the City of Oshkosh will consult with the
Wisconsin State Historic Preservation Officer and, prior to taking any
further action, obtain the �,dvisory Council's couunents in accordance
with the Council°s Procedures, commencing with Section 800.4(e).
3e "Technical Assistance" offered to owners of structures within
designated Neighborhood Development Priority areas as part of the
Housing Rehabilitation Assistance Program will be in accordance with the
Secretary of the Interior°s "Standards for Rehabilitation and Guidelines
for Rehabilitating Historic Buildings."
