Plumbing Code.

SECT I ON 20-3 APPO 1 NTMcNT AND QUAL I F I C,=. i I G';S OF SUPER�1 f SOR
(A) Appointment
There is hereby created the positio^ c' plumbing svpervisor who shall
be appointed by the city manager, as a_thorized in Section 2-23,

�B� Qualificatio^s
� Th� plumbing supervisor shalt have at �east ten (10} years of experience
in plumbing, be a iicensed p)umber �nc have the n2cessary ability to
supervise Lhe installation of plu�,cinc systems. 'rie shait not be
� in�e rested as a partner nor otherwi;� :;ith any p?;son or in any b�siness
dealing in piumber's supplies, fixt�re� or materials or carrying on
the trade of plumbing.

S��Tf�'+ 20-4 DUiIES OF SUPERVISOR
(Aj ��nerallv
.� shall be tne responsibility of t�e �?u--�ing suRervisor to estaolish
�nd carry out the city's program to er.=orce the requirer�ents of Chapter
1'�S, Wisconsin Statutes, State Board e' Nealth plumbing code, munici-
pal plumbing code, and relative laws. He shail also perform such
other appropriate duties as may be prescribed by the city manager.
(B) Records
The plumbing supervisor shall keep a r�cord of all plumbing permits
a�d plan approvals. Each permit shall oe regularty numbered in order
o` issue. The records sha11 show all inspections made, plans approved
and fees collected. -
(C) Reports to City Manager
The plumbing supervisor shall file mon.hly and yearly reports with the
city manager showing the activities of his office.
(D) Noneys Collected
ihe plumbing supervisor shall keep a r=cord of all fees received for
permits and ptan approvals pursuant to provis.ions of this chapter.
Moneys collected shali be paid into th� city treasury and be placed in
tne general fund. The comptrol]er sha�l keep an account of the same
and make a report thereof once a year :o the city manager.
(E) Wnenever it shall be reported to the health officer that the plumbing
or drainage outside or inside of any building, structures, parks,
areas. or complexes, etc., of an existi�g plumbing system is defective,
or fails to conform to the requirem�nts o� this section and by reason
o* such failure tends to create a heal�h hazard, the heatth officer
shall direct the plumbing supervisor to irspect the plum�ing system
a�d suggest such changes as are necessary to eliminate the health
hazard by bringing the faulty plumbing system into compliance with the
existing plumbing code. The health of�icer shall thereupon direct
such changes to be made and fix a time for doing same. Any person
r=fusing to comply therewith shal] be =ui?ty of a violation of this
chapter; each day's continuance thereo` shall constitute a separate
o�'fense.
SECTIQN 20-5 AUTHORITY 0� PLUMBING SU?ERU!50� AND AUTHORlZE9 ASSlSTANTS
(A) Tne plumbing inspector and assistants s;�all have" the power and auti�ority
at all reasonable times, for any proper purpose, to enter upon any
public or private premises and make in��ections thereof, and to require
o` any person or persons doing plunoinc or draintaying work the produc-
�ion of the permit therefor; provided, no�.��ver, that no inspection
shall be made t,rithout a warrant, in th_ ev�nt that t�e occupant of the
premises shall fail to give his conser.: tc such inspection. Any
c�rson who shall resist or obstruct a�,,: lawfut exercise of authority
�y said plumbing inspector shall be su�ject to the penalty provided in
�nis chapter.

�,,: In all cases ��rnere any action is t�<_- by the p;umbino supervisor or
ass;stants to enforce the ordinanc=s c.' plumbin� such action or act
� shall be consi�ered as done in tne na-� of and on behalf of the City
of Oshkosh, and the plumbing superv.s�- or assistants so acting for
the city shal) not be judged as liabl� for any �amage or inconvenience
�� that may accrue to persons or proo�rt�: as the result of any such
action or act committed in the disc:�arae of their duties, and any law
suit or action �rought againsi. sai�! pi��mbing supervisor or assistants
by.reason thereo�, shall be de`end�d �y the ci�y attorney until final
termination of the proceedings contain�ci therein.

(D} Inspection or a�provals by the plur�ir,c supervisor ar assistants shall
� not in any case constitute a guaran:e� against imperfection by either
the City of Oshkosh or the plumbine s::�ervisor or assistants.

SECTION 2a-6 IN►ERFERENCE WITH 1tJSPEC-OR
No person shall interfere in any way wi �;� �ne ��ork of inspection or permit
any plumbing or drainage to be used until i� has been inspected and appraved
"� untess special permission therefore is g�v?� by the plumbing inspector.
SECTION 20-7 CLAIMS AG.AINST CITY
(A) The City of Qsh;osh shall not allo��; a.-� claim rade by zny person, firm
or corporation owning proper�y in ��? city which is serviced by sewer
and water for damages to such servi�e� that may have occ�rr-ed during
public water and sewer constructic„ i^ th4 pubiic right-of-way unless
prior notice is given to the plum�+'nc supervisor and city engineer of
the time and place where the repair is to be made. Upon receiving
such notice, the plumbing supervisor a.�d/or city engineer shalt inspect
the repairs to be made and shall file a writter, report of his findings
in his office; and such notice an� ir•_�ection shall be conditions
precedent to tne allowance of clai- ��r such repairs or damages.
� (B) Informztion as the plumbing superv:scr or city engineer has with
regard to tne location of the pub�ic s=_wer or �ublic water supply and
� locations of y`s and laterals ror serving properties wi1T be furnished
at requester's risks as to accuracy o- same.
SECTI ON 20-8 PLUMB I P�G PERMITS, PLA�� �X:," ( tJAT IONS �.�Q APPRQVAL
(A) Permits
No person shall perform or permit =:^� ��rformance of any plunbing or
�" sewer work of any kind, except th= r�-�val of sto�pages or repair of
faucets, valves, or leaks as orov��?� in subsection (b) of Section 20-
� 3 of this cha�ter, unless a per^�; _-erefor s+;all first have been
ob�ained as hereinafter provided.

(B) General Pznalty
An�r contracting plumber, or master or �ourneyman piumber, drainlayer,
property owner or othzr person who shatl violate any of the provisions
of this chapter or who shall install or allow to be instailed any

chapLer, sha11, where no other penalty is specificaliy provided, be
� punished bv a fine of not less than te� (S10.00) Dollars nor more than
Two Hundred (5200.00) Dollars, plus th� costs of proseccction and in
default of payment thereof, by impriso-!ment in the County Jail until
+"" such fine and costs are paid, not exce=ding thirty (30) days. Each
day of such violation shall constituie a separate offense.

syste:^ and snall sho,i the loc��ic�, kind an� size of all sewers�
drains, wastes and vent pipes, `'xtures, tra�s, receptacles,
appliances, �•:ater service, an� 4:�:2� distrihution, and any other
pertir��nt data. The plans sr=;i �e prints that are clear, legible�
and p� r�;,anent . P 1 ans �not nee � i nc above requ i rements :•�i 1 1 be
reject�d. Plans will be revie�:rec in order o` receipt.
�S) After approval is granted, plans and soecifications sha11 not be
.,�, changed without �.�ritten approval �y the plumbing supervisor, A
review of changes will be made w��n deemed necessary without
+� cost .
SECTION 20-9 �ELINQUENT FEES
�' In the event any permit fees are due fro� any applicant and are not paid at
the time of.filing of the ptumbing supervisor monthly report, such applicant's
� name and the amount due shatl be carried forward an each suceeeding monthly
report until such fees are fully paid. `do �ermit shali be issued to any
person, firm or corporation which is in arr�ars for more Chan the fees
� incurred during a current month, until such account has been settied with
the city.
� SECTIO`� 20-10 NO PERMIT TO VIOLAT�RS
Whenever the installation of any ptumbing is done or being done contrary to
� the regulations of this chapter, the plu-+bi:�g supervisor shall send a
written notice to the violator at his last <nown business address as shown
in the register of licensed master plumb�rs or home owners to remedy such
� violation. F'ailure to comply with such �otice shall be deemed sufficient
reason for withholding future permits. If ;nere is a`ailure to promptly
respond to any ofricial conmunications, �he-; such acts shall also be deemed
sufficient reason for withholding future p�-mits.
SECTION 20-]l S�RVICE BEYO"tD CITY LIMITS
(A) Connections Prohibited
Every person including al1 officers ar,� employees of the City, are
prohibited fro� connect�ng or aidin� ��d abetting the connection of
any sewer or water lateral servicir� a�y p roperty situated outside of
the legaliy zstablished city limits o� the City.with any existing or
hereinafter to be constructed water or sewer main belonging to the
city water znd sewer systerns.
(B} Exceptions
This ordinance shall not affect any ex�sting installations.
(C) Allowed Connections
� �he Common Council of Oshkosh may, �y -esolution, authorize connections
to the ci �y set•�er and water mains �y �-:y property after said property
nas f�iled a valid an^�xation petition and prior to the consideration
� of said p�ti�ion by th2 Common Cou^cii.

(2) Issuance of Permit
Pao pernit will be issued unti' p��n examination and approval
requirements have been met. �'po.^. examination and approval of
such application by the plu�bi�g inspector and u�on payment to
tne city treasurer of the requirF�' permit �ees }isted in Subsection
i3)of this Section, the inspector shall issu� a permit therefor.
� Such permit may be issued oniy te persons duly licensed to do
plurbing work under the lat•ls of '.risconsin and under the provisions
of this chapter, and such other ��rsons who are entitled to a
perr�it under the laws of tne State of Wisconsin.
No plumbing permit shall be issued authorizing � conneetion �iith
the city water or sewer systers i� the land tG be benefited by
such connection had not been specifically assessed for the water
or sewer main extension in thP s�reet abutting said property
unless the owner thereof pays a c�nnection fee to the tity in an
amount equal to the amount wh+ch :he property would have been
assessed at the time of said water or sewer main construction,
based on the formula used at �ha: time for the computation of the
special assessment for said wa�er or sewer r�ain installation.
(3) Schedule of Fees
The schedule of fees to be paid snall be as faltows:
$3•00 for sanitary or storm sewer connections at main in
street or curb.
$3.00 for sanitary or storn sewers relaid from main or curb
to building or main to curb. •
5].00 for water service con�_ctions at �ain in street or
curb.
$1.00 for water service relaid from main or curb or building
or main to curb.
$1.00 for water service and sewer repair,
$1.00 minimum fee for inspe�_ion of any plumbing or drainage
work requiring a permit. �
S1 .00 for each f ixture w;,et=er a new instaT lat ion or a
replacement and all oluge�d openings for fixtures. Such
schedule shal] apply to ;hz ;ollowing list of fixtures: alt
trapped fixtures, ali style_ and descriptions of.sinks,
water closets, bathtubs, sncrler baths, Urash basins, bubblers,
garbage disposals, launcro�a�s, dishwashers, floor drains,
taundry tubs, water soft=_n�-s, urinals, gas, oit, etectric
and coal water heaters, -an_=_s, boilers, electric pumps,
septic tanks, catch basi:�s �� similar receptacles, bar and

fixtures are installed.
(4� Double Fees
Plumbing fixtures or apptiances =o��� installed by the Plumbing (nspector
,� for which installation no permit �a� been issued will be subject to an
inspection �ee charge of Two ($2.0��;� Dollars for each such fixture appliance.
(B) P1an and Specification Examinations and .�oproval
� (l) Complete plans and specificatior,s o- plumbing to be installed outside and
inside of ali new buildings, structures, parks, areas or complexes, in the
following classifications shall �e =_ubmitted for approval and approval
received betore a plumbing permi_ �;ill be issued so instaliation may commence:

Schools and oLher places of in�truction except state-owned schools.

Private interceptor mains
This section shall apply to �li plumbing to be instalied in all alterations
a�d a�ditions exceeding three `ixtures.
(g�. Doctor and dental offices.
(h� Doctor and dental c]inics �•.it�out operating facilities,
(2) All plans and specifications sha',l �e sealed or stamped in accordance with
Chapter A-�I Wis. Adm. Code by a r_�is_ered architect, engineer or registere�
plumbing designzr. A master plu-ib.- may design and submit for approval
plumbing plans and specificatior.s ��r a plumbing system which he is to
insta]l. Each sneet of ptans a^' s�ecficiations the master plumber subrnits
shall be signed, dated and incl��e ;is Wisconsin Master Plumber l,ieense
number. Wnere more than one sh=�t is bound together into one volume, only
the title sneet or index sheet ne�c be signed and dated by the master
plumoer designer-installer, if si�n�d title sh�et cleariy identifies a11
other sheets.
(3� P1an examination rees for all n=�.y ���ildings witt be determined by the size
of the building sewer at fifteen d:,llars ($15.00) per inch diameter of
building s�wer, private interce�tor �ains at 55.00 per inch diameter, and
$5.00 per inch for storm sewer :ic;, inches in diameter or smaller, and
S2•50 per inch ror every inch i� c��meter for sewers larger than eight
inches in �ianeter when not in �uie�ing plum5i�g plan. Ptan examination
fee for all additions and alter�:io�s ti�ill be at $15-00 per inch diameter
of �•ra,te er soil pipe connection :o existing alumbing system or new building
se��er. (� more than one pipe c��r__tion, the larger shall be the price
`actor. Plan exanination fees ��a�� b� paid ��rhen pians and specifications
are SUDRI� tted for approval .
