Roskom, Principal Planner; Diane Witzke, Recording Secretary Acting Chairperson Krueger called the meeting to order. Roll call was taken and a quorum declared present. Due to a four member Board present, Mr. Krueger informed the appli- cants that four affirmative votes would be required to approve a request. A 3-1 vote for approval would lay the appeal over for con- sideration until the next meeting. The minutes of May 1, 1991 were approved as distributed. � 905 913 919 NEBRASKA STREET - Grace Lutheran Church and School, owner; Garry H. Decker, applicant : The applicant is requesting a variance to construct a gymnasium in conjunction with Grace Lutheran School with an 18 ft. front yard setback and an 18 ft. rear yard setback; whereas Section 30- 31(B) (1) (c) of the City of Oshkosh Zoning Ordinance requires a minimum 25 ft. front yard setback and a minimum 25 ft. rear yard setback. Mr. Decker introduced Randy Hess, Chairman of the Expansion Committee; Tom Koepsell, Principal of the school; Bob Koepp and Mr. Slattery, both teachers at the school. Mr. Decker gave a brief description of the history of the school and . church. The school has classes for grades kindergarten through 8th grade and enrolls 230 children. In answering question from the Board, Mr. Decker explained the follow- ing: The church is ready to go ahead with plans to build a gym and lockers which would be about a 114 ft. sguare building, but they are not able to add more classrooms at this time because of the cost. The structure is proposed to be built 60 ft. away from the existing build- ing because of the existing school roof and a new kitchen/cafeteria with 2-3 classrooms on the second floor are proposed to be built some time in the future in the remaining 50 ft. of space between the gym and existing building. It is not possible to make the gym any smaller to meet the setbacks. Also, the existing building is back 18 ft. from lOth Avenue and we felt it would look better to align the buildings. The east/west dimensions of the gym of 102 ft. may change to 114 ft. but the setback of 18 ft. would remain the same. There is a municipal parking lot across the street and Mr. Helm the closest neighbor has no problem with this proposal. The existing fence can be placed along his property line if he would prefer that. BOARD OF ZONING APPEALS PAGE TWO JUNE 5, 1991 Motion by Dellantonia to approve a variance to construct a gymnasium in conjunction with Grace Lutheran School with an 18 ft. front yard setback and an 18 ft. rear yard setback with the condition that the fence be moved and constructed on the southerly lot line of Lots 6 and 7. Seconded by Herricks. Motion carried 4-0. Regarding the findings of fact, Mr. Dellantonia stated the single family residence bordering the school deserves some privacy from the children playing in the playground and the fence along their lot line will help preserve that privacy. Mr. Krueger stated the infringement along lOth Avenue is no more than the existing building's to the east. The only infringement allowed is between the rear of the building and the southerly lot line. Mr. Schorse stated there is limited land available and this is a transitional area. They are making the most of what they have with the least infringement possible into the setback. II. 2337 JACKSON STREET - Norman Bock and William Dumke, owners/applicants The applicants are requesting a variance to construct a parking lot with a 0 ft. side yard setback; whereas Section 30-22 (B) (2) (b) of the City of Oshkosh Zoning Ordinance requires a 10 ft. side yard setback for a parking lot. In answering questions from the Board, Mr. Dumke explained the follow- . ing: Before this property was blacktopped a neighbor asked if he could park behind his building. The neighbor then had gravel put on the lot to improve the parking. Then the neighbor moved away and they had a new neighbor. The gravel is blowing and dusty. They have added on to their building and now need additional parking. The grass in this area was gravelled for maintenance reasons. They felt that blacktopping this area would improve the looks of the neighborhood. There is gravel up to the south lot line which is next to their neigh- bor's driveway. The 10 ft. strip would be used for parking. If grass or landscaping were put in that 10 ft. strip, snow removal would damage anything growing there. Also, 4 parking stalls would be lost if the 10 ft. strip is left but the number of parking spaces is not the problem. They felt blacktopping the 10 ft. strip would improve maintenance and help beautify the area. , Mr. Donald Hibsch and Mr. Mark Hibsch, 2329 Jackson Street, stated there is a 10 ft. strip of grass on the south property line. Their concern is surface water drainage. On May 31 there was 2 inches of rain and they stood in 4 inches of water on their property. They were concerned that the water be drained away from their property. This is the first time they have had a water problem. The applicant raised the grade on his lot when he paved his parking lot, making their property the lower of the two. Since the construction started on the applicant's building the construction trucks have used their driveway which is now full of mud and gets tracked into their store.
