(Ann Iiintz arrived at this time to make a 5-member Board).
Mr. Leyhe stated that his property does not have a garage presently and most of the :
surrounding properties have garages and he felt being in conformity with the surrounding
properties would be an improvement on the property and the neighborhood.
Mr. Schorse inquired if the storage shed that is there presently is similar to a shanty.
Mr. Leyhe stated that the storage shed that it there now is worse than a shanty as it is in
very poor condition.
Mr. Leyhe stated he was aware of the deed restriction and had no problem with that
condition as he didn't feel he would sell the property in the near future.
Motion by McDonald to approve the variance request with the stipulation that the vacant
lot in question be deed restricted to the lake lot located at 2846 Stony Beach Avenue and
that the applicant not build an auxiliary shed on this property at any time. Seconded by .
Slover. Motion carried 5-0.
Regarding the Findings of Fact, Mr. McDonald stated it would be an improvement on the
property and the neighborhood. We have minimized the variance by eliminating any other
structures on the property and he is basically requesting the minimum for his property and
there are no alternatives.
III. 913 NEBRASBA STREET - Grace Evangelical Lutheran Church & School, owners;
ar J. Boldt Construction Company by John E. Koga, Architect, petitioners
The applicants are requesting a variance to construct a gymnasium in conjunction with
Grace Lutheran Schooi with a 17 ft.structural front yard setback, a 12 ft.entrance canopy
front yard setback, an 18 ft.structural rear yard setback, and a 12 ft.entrance canopy rear
yard setback; whereas Section 30-31(B)(1)(C) of the City of Oshkosh Zoning Ordinance
requires a minimum 25 ft. front yard setback and a minimum 25 ft. rear yard setback.
Mr. Roskom stated that this item had previously been before the Board on June 5, 1991,
and the modification being requested at this time is for the canopies by the entrances and
there is a one foot difference between the original request of 18 ft.setback for the front yard
and now they are requesting a 17 ft. setback.
Mr. John Koga, Architect for Grace Lutheran, stated that Grace Lutheran plans on
building a gymnasium addition to their school. They are interested in protecting the
children from the elements (i.e. snow, ice, etc.) as much as possible and that is the reason
for the canopies at the entrances. He further stated Grace Lutheran would like to put

something more substantial up rather than just a 2 ft.canopy that is allowed by the Zoning
Code and that is the reason for the variance request. He stated that the 17 ft. setback in
the front yard and an 18 ft. setback in the rear yard would both align with the residences
to the left and with the school to the east.
Mr. McDonald inquired if the appellants were anticipating installing a total of three
canopies.
Mr. Koga stated they were interested in installing a total of four canopies - three right away
and one in the future when they expanded their cafeteria.
Mr. McDonald inquired as to what the canopies would look like.
Mr. Koga stated they haven't detailed them presently, but they were thinking of a very
simple canopy structure - two posts probably like pipe columns on the two corners on the
outside and taking a 1 ft. deep structure coming around and putting aluminum facia
material on that. They would not be closed-in canopies as there is no reason to close them
in.
Mr. McDonald inquired if the rear exit be used regularly or was that exit only for
emergency purposes.
Mr. Koga stated it was meant for emergency purposes, however, it is possible that in the
good weather if they want to have children leave from the locker rooms in the gym and go
out to the playground, they might use that exit.In the winter when everything is snowbound,
I only foresee it as an emergency exit.
Mr. McDonald iaquired what the overhang on the principal structure would be made of.
Mr. Koga stated that for the most part the east/west side would not have an overhang other
than the trim detait; the north/south overhang is mainly the body of the gutter and a little
soffit material.
Mr. McDonald inquired as to the purpose of a 5 ft. canopy versus a 2 ft. canopy.
Mr. Koga stated the difference between the 2 ft. and 5 ft.canopy is for more protection as
the appellants do not feel that a 2 ft.canopy is adequate to protect the children from the
elements.
Motion by Schorse to approve the variance as requested. Seconded by Hintz. Motion
carried 4-1 (AYE: Hintz, Krueger, Schorse, Slover; NAY: McDonald).

Regarding the Findings of Fact, Mr. Schorse stated with the limited land available for
expansion, the appellants appear to be using the least amount necessary and they are
requesting the minimum variance necessary and it won't have much impact on the
neighborhood because it is a mixed use already.
There being no further business, the meeting adjourned.
