PURPOSE: SUPPORT BILL LRB 1921 TO ALLOW MUNICIPALITIES TO SELL
LIQUOR & WINE AT MUNICIPAL PARKS & GOLF COURSES
INITIATED BY: PARKS DEPARTMENT
WHEREAS, currently, municipalities may serve beer only at municipal parks and
golf courses; and
WHEREAS, that Rep. Skowronski (R-Franklin) plans to introduce a bill that would
allow municipalities to sell liquor and wine at municipal parks and golf courses; and
WHEREAS, the selling of liquor and wine at such municipal parks and golf courses
would provide additional revenues and provide patrons with additional options found at
other establishments.
NOW THEREFORE BE IT RESOLVED that the City of Oshkosh supports the
proposed legislation introduced by Rep. Skowronski that would provide this much needed
source of revenues through the passing of LRB 1921, and encourages other legislators to
become co-sponsors of this proposed legislation.

Municipal Parks & Golf Courses
Included on your meeting agenda for the Tuesday,September 22 Common Council meeting is a resolution in
support of Bill LRB 1921 to allow municipalities to sell liquor and wine at municipal parks and golf courses.
Currently, local governments, such as county and municipal park systems may only sell beer to patrons
of the park facilities without the need for a municipal operators permit when the government itself
operates the facility. This bill would expand the exemption from the permit requirement to allow the sale
of all alcoholic beverages, not just fermented malt beverages.
The current law allows a government to make the sale of beer without need for utilizing one of the
tavern permits that the municipality has to offer to private sector operators of taverns. If the local park
system wishes to have the park staff sell and serve a distilled spirits drink on a golf course,they must
take out a permit for the park thereby denying that permit to a potential private sector tavern. This bill
will allow the government operated sales of all legal alcoholic beverages in its own parks.
The purpose of this bill is to allow governments that operate their concession stands to achieve new
earned revenue that reduces the need for tax levy and serves the demands of the population enjoying the
park. These are captive audiences that represent a potential market that results in earned revenue for
local parks that can be used for a variety of purposes, including replacement for tax levy.
The Wisconsin Counties Association, the League of Wisconsin Municipalities and the Wisconsin Park
and Recreation Association support this proposal.

Dear Rep. Skowronski: The League of Wisconsin Municipalities supports your legislative effort
to allow cities and villages to sell intoxicating liquor and wine in municipal parks. Under current
law, specifically Wis. Stats. sec. 125.06(6), a municipality may enact an ordinance or resolution
allowing the sale of beer at any municipal park. However, this provision does not allow the
municipal sale of intoxicating liquor or wine.
Municipalities often host weddings and other events at park facilities. Also, municipal golf
courses often host functions and have concessions that sell beer for golfers to enjoy during
and/or after their round of golf. Many municipalities would like the option of being able to sell
liquor and wine at such events and locations.
We support giving municipalities this option. Thank you for authoring such legislation.

however does not allow the municipal sale of intoxicating liquor orwine.
Municipalities often host special events, community gatherings, weddings and
other events at park facilities. Also, municipal golf courses often host functions
and have concessions that sell beer for golfers/patrons to enjoy both before
and following their round of golf. Many municipalities would like the option of
being able to sell liquor and wine at such events and locations.
Our state association supports giving municipalities this option. Thank you for
authoring such legislation, and we encourage other legislators to co-sponsor this
important and much needed change in the Wisconsin Statutes.

1 AN ACT to amend 125.06 (6) and 125.09 (6) of the statutes; relating to: the sale
2 of alcohol beverages by a municipality or county in a park.
Analysis by the Legislative Reference Bureau
Under current law, with limited exceptions, no person may sell alcohol
beverages to a consumer unless the seller possesses a license or permit authorizing
the sale. Under one exception, no license or permit is required for the sale, by officers
or employees of a county or municipality, of fermented malt beverages (beer) in a
public park operated by the county or municipality.
This bill applies this exception to all alcohol beverages (beer, wine, and distilled
spirits), not just to beer.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
3 SECTION 1. 125.06 (6) of the statutes is amended to read:
4 125.06 (6) PUBLIC PARKS. The sale of alcohol beverages in any
5 public park operated by a county or municipality. Fen�ne +^d malt Alcohol beverages
6 shall be sold by officers or employees of the county or municipality under an
7 ordinance, resolution, rule, or regulation enacted by the governing body.

1 SECTION 2. 125.09 (6) of the statutes is amended to read:
2 125.09 (6) MUNICIPAL STORES SALES. No municipality may engage in the sale of
3 alcohol beverages, except as authorized under s-.- ss. 125.06 (6) and 125.26 (6). This
4 subsection does not apply to municipal stores in operation on November 6, 1969.
