PURPOSE: APPROVE GRANTING UTILITY EASEMENT TO WISCONSIN
PUBLIC SERVICE CORPORATION / 200 NORTH CAMPBELL
ROAD

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to grant a utility easement to Wisconsin
Public Service Corporation at 200 North Campbell Road, per the attached, and the proper
City officials are authorized and directed to execute any and all documents necessary for
purposes of same. Said easement is hereby granted with the following condition:
1.) Final easement document shall include wording that the proposed easement will be
subordinate to all easements from vacated right-of-way or other existing easements

BACKGROUND
The subject 2.74 acre property is located on the east side of N. Campbell Road,
approximately 550 feet north of Witzel Avenue. The subject area is located on a green strip
northwest of and adjacent to Fox Valley Technical College's parking lot and southeast of the
Seniors Center's parking lot. The area surrounding the Seniors Center is a mix of uses
including Fox Valley Technical College to the southeast, the Seniors Center Annex and a
condominium complex to the northwest, the University of Wisconsin Oshkosh's Facility
Maintenance facility to the west and Fox River to the northeast.
ANALYSIS
Wisconsin Public Service Corporation (WPS) is requesting a six-foot wide private utility
easement from North Campbell Road to the southeast side of the Seniors Center building to
convert an existing private utility service to a public utility service which will allow WPS to
connect to it and service the Fox Valley Technical College facilities located to the south. The
proposed easement is located north of and along the southeasterly property line extending
approximately 360 feet and no new utility installation is planned within the easement area as
there is existing utilities already in place. The Department of Public Works reviewed the
request and noted that the easement area will cross two city sanitary sewer easements and
is therefore requesting this proposed easement be subordinate from any easements from
vacated right-of-way or other existing easements.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of the request at its September 15, 2015 meeting.

GENERAL INFORMATION
Applicant: Wisconsin Public Service Corporation

Actions Requested:
Wisconsin Public Service Corporation is requesting the granting of a private utility easement from
the City of Oshkosh at the Oshkosh Seniors Center, 200 North Campbell Road.
Applicable Ordinance Provisions:

Property Location and Background Information:
The subject 2.74 acre property is located on the east side of N. Campbell Road, approximately 550
feet north of Witzel Avenue. The subject area is located on a green strip northwest of and adjacent
to Fox Valley Technical College's parking lot and southeast of the Seniors Center's parking lot.
The area surrounding the Seniors Center is a mix of uses including Fox Valley Technical College

Analysis:
Wisconsin Public Service is requesting a six-foot wide private utility easement from N. Campbell
Road to the Seniors Center building in an effort to convert this from a private service to a public
service. The proposed easement is located north of and along the southeasterly property line
leading from N. Campbell Road northeasterly approximately 360 feet to the Seniors Center
building. According to correspondence from AECOM, there is no installation planned within the
easement area as there are sufficient existing utilities in place.
The Department of Public Works reviewed the proposed easement and reported that the easement
will cross two city sanitary sewer easements running east of and parallel to N. Campbell Road on
the Seniors Center property. Therefore, the Department of Public Works is requesting that
wording be added to the final easement document that this proposed easement be subordinate from
any easements from vacated right-of-way or other existing easements.
RECOMMENDATIONS/CONDITIONS
Staff recommends approval of the granting of the proposed private utility easement to Wisconsin
Public Service Corporation as presented with the following condition:
1. Final easement document shall include wording that the proposed easement will be
subordinate to all easements from vacated right-of-way or other existing easements.
The Plan Commission approved of granting of the easement as requested with conditions noted.
The following is the Plan Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the land use and
zoning classifications in this area. He explained the reason for the easement request and reviewed
the site plan depicting the easement area. He also reviewed the condition recommended for this
request requiring that the proposed easement be subordinate to all easements from vacated right-
of-way or other existing easements.
Mr. Fojtik questioned if there was a precedent for this type of condition on an easement request.
Mr. Buck responded that it was common practice in cases where existing city easements are
overlapping and located in the same area.
Motion by Nollenberger to approve granting a private utility easement at 200 North
Campbell Road with the following condition:
1. Final easement document shall include wording that the proposed easement will be
subordinate to all easements from vacated right-of-way or other existing easements.
Seconded by Borsuk. Motion carried 8-0.

WPS has requested this 6 foot wide easement from Campbell Creek to the Senior center in an effort to convert this
private service to a public service. They plan to run a new electrical service to FVTC from the transformer East of the
Senior Center Building. There is no new install planned for the easement area. The existing underground utilities are
sufficient for this plan.
