Sir:
This will confirm our February 16, 2004, telephone conversation concerning your use of a
strip of land along the northwest corner of your property at the above address. By Quit
Claim Deed dated December 28, 1993, being recorded on February 21, 1994, in the
Winnebago County Registry as document number 867830, the Wisconsin Central, Ltd.
conveyed to the City of Oshkosh certain lands that previously formed a railroad corridor
through the downtown area and paralleling Harrison Street. This corridor crosses a tiny
portion of the northwest corner of your property.
You initially inquired about purchasing this segment. In consultation with the city engineer,
the administration has recommended that the City retain ownership of this parcel for
possible future intersection improvements. You then indicated that you wished to replace
the shrubbery with a fence. Consider this letter as permission to install the improvement,
consistent with all applicable municipal code provisions; with the understanding that, should
the city engineer recommend and the Council approve an intersection reconstruction, the
City of Oshkosh does not intend to pay for removal of non-City personal property from its
lands. However, as explained during our telephone conversation, the Council current
project approval process provides notice to property owners when the Council is
considering a project for their neighborhood.
