�ro'HE�2FAS, the Co�nn C�uncil of t1� City of Oshkosh held a public hearing on
tlie 6th day of J�ne, 1979 at 7:00 p.m. for the Fn��e of. hearing all interested
�x�r�ons cancerning the preli[air�ary r.esolutions and re�rts of the City Manager
(Board oF Public t4orks) on the proposed ;�rove�nts consisting of the
concrete paving with concrete curb and gutter and appurtenant work, pursuant to
the initial resolution adopted on April 5, 1979 by the Oshkosh Coin;nn Council of
tha following named streets:

l. That the report oF the City Manayer, acting as the Board of Public
6dorlcs, pertaining to the const.ruction of th2 abov� described public i�rove.m�nts,
including plans and spec:ifications therefore, is heretr� adopted and a�roved
with the following �difications:
a. Delete Grand Street from Merritt Avenue to Hudson Avenue
b.

carry out the wc>rk of su.cii i�rovm�ents in accordance with the report of th2

6. That the assessments may be paid in cash, or in installir�nts pursuant
to Section 25-83 thru 25-89 of the Oshkosh hbanici��l C�xle. Said deferred paycrents
to bear interest at the rate of eight percent (80) per annwn on the vnp�id
bal:ince. The City Clerk shall publish an installment assessn�nt notice in
accordance with Section 66.54 (7) (e) ot the Wisconsin Statutes for 1975 in the
official newspaper of the City.
7. The City Cler.k is dirocted � publish this resolution in the official
nEwspaper of the City, the ��II(OSH DAILY NOKPfb4ESTERN.
8. The City Clerk is further directed to mail a cop� of this resolution
to every proper.ty owner whose name appears on the assessment roll whose post
office address is known or can c,r �h reason�ble diligence 1� ascertained.

PU➢LIC HEARINGS
The Chair ordered the following Public Hearings be held:
1) Zone Chan�e for croperty located on the West Side of Josslyn Street,
approximately 20� ft. south of intersection with Rush Ave, from R-1B
to R-5
Rev. Gerald :�erenhauser, the petitioner, stated he would apprec-
iate a vote on tr�s issue this meeting as the construction would be
held up consider4bly if this be held until a later date. He informed
the Council of tte inteution to continue a like construction already
abuttin� this are�, and that the zoning would conform with the area.
No one else appeered for or against this zone change, and the Chair
called the Public Hearing closed.
2) 1979 Aspahltic Co�crete Overlay Program: Wisconsin St/ Waupun Rd.
Mr. Lawrence �_uenzl, 2519 Oregon St., referred to the petition/
letter distribute� to the Council prior to this meeting and referred
to in the City Cl�rk's Report. This petition informed the Council of
a number of propesty owners on Oregon St, whose property would be
assessed for a st:eet to which they have no access and actually no
connection to nor service from. He ststed it would be an unfair
assessment to these properties and requested deletion of this charges,
Mrs. Cecelia �itz, 4244 Shady Lane, co-owner of 47_k and 432 Wis-
consin St., said _his street had been designated as a state truck
route, and she ha: been informed at that time she should not worry
about this road a=_ it was a state route. She also has been told this
would be widened `_n the future and if this is true she did not feel
it feasible to as�halt overlay it now. She also referred to the cost
of underground re-pipin� and the like at this time which msy have to
be redone later a�:3 at additional expense. She does not feel this is
the proper time fcr this project. Mr, Jack Schneider, Director of
Public iJorks state3 it may be some time before the state will re-
construct the street, and now, with the bridge closed to the public,
would be a good t'_�e to overlay the street. She was also informed
the construction �nd assessment cost now would be pro-rated on the
future improvemen�,
No one else appea�•ed for or against this program, and the Chair
called the Public Hearing closed.
3) 1979 Asphaltic Co^crete Paving: Micolet, Ceape, Waugoo, Algoma,
and Elmwood.
Mr. Bill Gregcry, 802 Ceape Ave „ lives on the northeast corner
of Bowen and Ceape. When the city reconstructed Bowen Street an apron
of ceffient was lai� as an approach in front of his property fronting
Ceape Ave. This e�tends into Ceape Ave. about 26 feet and was told
this would not be Necovered. He was not the owner of the property at
that time, but ha= bought the praperty recently; and the former owner
is deceased. The �roperty was clear when he pu:chased same, and he
does not feel he s:iould pay for improve�^ent done years ago, nor at
this time for an c-:erlay that will not be put done over the concrete.
It was noted by t`_�.e administration that no charge was made at the
time of Bowen Stre°t construction for this particular apron fronting
this address.

Mr. Starr Clark, 160G Algonia Blvd, ow^s property at 632 Elmwood
Ave, and asked if this would be the same �ppe o= work put in during
the 1973 program and at a mere difference oz" three cents, He Questioned
if this program would give the same results. T�1r, Jack Schneider, Di-
record of Yublic Works stated there are various variables between the
two programs, such as a na:rower street, a��d the current overlay projects
involve three diFferent policies and ra�es. The 1973 project (Algoma Blvd
was also a State project. Mr. Starr questioned if the overlay would
be heavy enough because of truck traffic, and t�1r. Schneider informed
him the overlay depth would vary throu�h the street area, but to his
knowledge this would be a satisfactory project.
Mr. Dave Lippert, 1135 Elmwood Ave., elso asked if the heavy traf-
fic has been taken into consideration; and how work on Elmwood Ave.
fits into the future pictur of the University future plans. He was
swered that the program was designed to cerry the moderate heavy truck
traffic; and the University has gone on record that Algoma Blvd.
and Elmwood Ave. will remain the streets t�ey are and that no closing
of traffic routing changes. He was also told the curbs and gutters
will be repaired or replaced.
No one else appeared for or against this a:ogra�, and the Cnair called
the Public Hearing closed.
4) 1979 Concrete Paving Program: 4l. 6th Ave., Jackson St., and Grand St.
/ idrs. Donna Koelbl, 512 E. Parkway Ave,, owns property at 508 Grand
1 St., 418 Merritt Ave., 512,51� Grand St., and 526 Pleasant St. She
fails to see why this should be a concrete and curbed area. The side-
walks on the east side would have to be tern up to make way for a con-
crete street. She was told this came about by a petition request, but
she said she owns several pieces of proper�y here and did not sign this
petition. She admitted the street does :,eed sor.,e kind of new surfacing
such as an asphalt overlay; and stated t�e street is not that heavily
used.
No one else appeax�ed for or against this p°ogra�, and the Chair called
the Public Hearing closed, and the regular order of business be resumed.
