The apartment is unacceptable and very unsafe. After notifying you several times about the condition of the windows, you failed to take care of the whole problem. You were very good about coming and fixing the one part that happened to break, but that is not enough. The windows in the whole house need to be completely replaced because they are too old and not safe anymore. The windows do not stay up on their own; they only stay up when something is propped in them and they slam down if they are not held up. This is very hazardous to our family or anyone living in this apartment. Our son of 22 months had one of the windows slam down on his hand last week. Two days later I had one of the bedroom windows slam down so hard on my hand that the window broke and the glass shattered on my right arm. You were notified by us several times about the condition of the windows and your failure to fix the problem violates our legal rights as tenants. We are well aware of Wisconsin's landlord/tenant laws. Because of the current situation we will be moving out of this property by the end of the month of June. No further rent will be paid, and the utilities will be shut off. We will not tolerate the lack of caring about the problem that you have shown. The safety of our family is and should be your main priority as the landlord of this property. We will never jeopardize our child's safery, and that is why we are moving. There would be a problem if we did not pay the rent on time every month, but that is not the case. There is a problem with your failure to fix the windows, and your lack of concem. We have contacted the City of Oshkosh Building Inspector over this matter because we feel that you have not taken us seriously from the beginning and we feel his opinion will be helpful. We have taken good care of the apartment and maintained it as best we can, and kept records for everything that has happened there. This is a very serious matter that should not be taken lightly and your immediate response would be very appreciated. No further rerrt or utilities will be required to be paid by us. As long as our apartmerrt is in the same condition as it was when we moved in,the security deposit will be retumed to us in full minus the agreed amouM for carpet deaning.
