The C'.ommn Coimcil of the City of Oshkosh do orclain � folloas:
SF.CTION 1. That Section 1-5.3 of the Oshkosh t•!�icipal Coc� pertaining to the
issi��e of citations for violations oP o�inances is hereby crnated to read as
follaas:
1-5.3 (1) Pursuant to Section 66.119 of the Wisconsin Statutes, the City of
Oshkosh hereby elects to use the citation �tY�,a.`' o` enforcemr.�t of ordinances other
than those for which a statutory count�rpa�-t exists.
(2) TE� CITATION. (a) The citation sha11 c�taiZ the follaaing:
1. The narc� and ad3ress of the alleged violator.
2. The factual allegations describing ti!e alleged violation.
3. The tine and place o� the offense.
4. 7`he section of the omine.�-�ce violated.
5. A designatioz of the offense in suc'� manner -ss can b2 readily �cLrstocd
by a person m3king a r�asonai�le ei�ort to do so.
6. i"ne ti� at which tl�e alleg�d violator may appea� in co�.ut.
7. A stat�rrer,t which in essence infoms the alleged violator:
a. That the alleged violator may ma'.Ke a cash deFosit of a s? cified
arroimt to be n�ailed to a specified official withir a speci.fie3 ti�.
b. That if the allecred violator �*a'ces su.:h a deposit, he or she need
not appsar in �eurt unless s�fisec;uently s«� n��.

does not appa�r in oourt at the tine s1.�ecified, an action may be c�rs�nced against
the alleged violator tA collect the £orfeiture and the ;�nalty assessment imFosed
by Section 165.87 of the Wisconsin Statutes.
8. A direction that if the alleged violator elects to malce a cash deposit,
the alleged violator shall sign an appropriate state[�nt which
accan�lnies the citation to indicate that he or she read the st�tesnent
mc�iired under subsection 7 and shall send the signed state�nt
with the ca:�h deposit.
9. Such other inforniation as rn3y be deer�ci necessary.
(3) SQ-IED[J',�E OF DHPOSITS. (a) The iollcw:ng schedule of cash deposits is
established for use with citations issued �ux3er this ordinance:
For violations of Chapt-�r 7 of tl�e �ht:osh Municipal Code (FSt:ilding
Code) , ChaptPr 11 of the Oshkosh Hb.uiicipal Code (Electrical Code) ,
Chapter 14 of the Oshkosh t�rimicipal Cod2 (Food and Foal Establish-
trents) , Chapter 15 of the Oshkosh idu�-ucipal C',ode (Itealth) , Chapter
16 of the Oshk�h hlunicipal Code (Housin�), Cnapter 20 of the
Oshkosh Mimicipal Code (Plutri�ing), C2a�ter 29 of Che Oshkosh
i��nicipal Code (Weic�ts and Measures) -$25.00 plus 10� penalty
provision plus costs.
All oiher citations issued imder this ordinance shall carry a cash
deposit as prescribed in Section 1-5.1 of the Oshkosh bhanici�l Cod�.
(b) Il�posits shall be made in ca�h, rr�ney or.der or certified
check +_o the Treasurer or Clerk of Circi�.it Co�.irt, or other official �esigr�zt; d bl�
the City, who shall pravide a receipt therefor.
(4) ISSUANCE OF CITATION. Law Enforcesrent of£icer. Any law eniorcera�nt
officer msy issue citations authorized imder this ordic�nce. In addition, the
follc�ring ax2 herehy desiqnat�d as City o£ficials kho may issu� citations witn
respect to oniinances direcrtly relat�d to tt�eir official respcnsibilities: Fire Chief,
Building Inspector, Electrical Ins1nector, Weic�:ts and r�asnres Inspector, Pl�mi;in,
Inspeetor and Plwri�ang Sup�nrisor, Housin9 Ins�ctor, Directvr of Health_ In

City Manac�r, the authority to their assistants er other designee.
(5) PF�DCIRE. Section 66.119(3) of the 64isconsin Statutes, relating to
violator's ��tions and proced�e on default, is hereby adopted and incori,orate3
herein by referenoe.
(6) NO�XCIASIVITY. (a) Other Ordinance. Acto�t�tion of this ordinan�e does
not preclud� the Coimcil fram adopting any o�'�er ordinan� or providing for th�
en£orcercent of any other l�r or orclinance relating to the sar,e or other mattc:rs.
(b) Other Ren�dies. The is5u�,� cf a ci:ration hereunder shall i?ot
preclude the City or any authorized officer �r�r. pr�ce:�ing und�r any �th�x
orc3inancQ or law or by any other enfor-..e.�nt �t�al tr� en,`'orce any ordinsn�,
regulaticn or orcler.

given effect without the in�ralid or t:ncoastitutional provision or application.
SE�'i'ION 2. This ozrlinanc� snall be in fuli force and effect from and after
its passage and date oi publication.
