The Carnpn Council hereby declares its inten*son tn exerc?sE its pn�r under Section 66.6U of the Wisconsin Statutes to levy special assess�nents upon property within the £ollowing described areas for benefits conferred upon such' property by improving the fo].laaing namecl streets, said public iu�mvement to include the followi.ng consisting of sanitary sewer, water mains, ancl grading ar�l graveling: MI�TII� DRIVE - Ftom W. 35th Ave�ue to 300 ft. south of W. 35th Avenue. 2. Said public improveir�nt shall include the qrading of the above named street to the grade hereafter established by special on3inance of the City of Oshkosh. 3. Before such imrn-ovc3nents are macle, the Board of Public Works is direc�ed to cause water and se,�rer sesvice pipes to be laid in said streets fran th.�� nr3ins to the curb line of each lot fronting on the said streets and to keep an urate account of the expense �*u-��ed in front of each 1ot and report the same ;- the Ccniptroller who shall cause the �munt charged tn each 1ot t� be ent�'ed �r� the tax roll as a speci.al tax against said road, provided, haaever, tl�at the Board of Public Works shall not cause such latesals to be so laid for any �rticular lot, or �x-�scel where, in the opinion of the Board of Public YJOrks, it would be impractical tn do so. A. The total, airount assessed against such dist;rict shall not excc,�1 the t,,;:�� cx;s� of cYie ing�mvc-sc��ts and the amount assessed against any parcel shall not be c3reater th�-ui the bPnefits accrued thereto £ran said ittg�mvEr�nts. 5. 'Ihe assessnPnts against any parcel may be paid according to the provisions of Ser_tion 25-83 thru 25-89 of the Oshkosh P�hmicipal Code. o£: 6. The Boanl of Public Nbrks is directecl tn preg3re a report consisting (a) Final plans and specificat'.ions for said i�rovanents. (b) An estimate of the entire cost of the improvanents and lateral.s. (c) An estim�te as to each parcel of property within the assessmPnt district of: (1) The asses�nent of benefits to l�e levied for each i�rovenent. (2) The damages to be awarcled for property taken or damages by each improvanent. (3) The net amount of benefits aver damages or of d�ges over benefits for each ucq�mvar�.nt. - 18A - Upon ccm�pletion of such report, �tbe Board of Public Works is directe�i tA file a copy thereof in the City Clerk's Office for public in.�tion. 7. Upon receivuxJ the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as speeified in Section 66.60 (7) of the Wisconsin Statutes. Rhe hearing sha11 be held by the Boa� of Public Works at the Council Cham2�xs in the City Hall at a time set by the Clerk in accordance with Section 66.60 (7) of the Wisconsin Statutes. 8. Zhe Wisconsin Public Service Corporation of Oshkosh, Wisconsin, is hereby re�ired to inst�ll gas mai.,c in said street and service laterals at such intervals as the Boaxd of Public Works shall direct, said �,vrk tA be canpleted prior to fhe i�ivvanent of the said street, the City Clerk shall fonoaid a cextified copy of this resolution to said wrporation forthwith. 9. �he Board of Public Works and the proper city officials shall do all things necessary so as to �lete the installation of stonn scwers in said •- street prior to the impmvanents th�xeof, if necessaxy. 10.
