ARTICLE XII. PENALTIES ARTICLE I. IN GENERAL CARE USED IN PARKING. � The driver or person having charge of any vehicle, before turning out or starting from or stopping at the curb line of any street shall first see'that there is sufficient space free from other vehicles, so that said turn, stop or start may be safely made. SECTION 27-2. MOTOR RUNNING WHILE PARKED. No operating mechanism of any motor vehicles shall be left running while any such vehicle is left unattended on any street, avenue, boulevard, or alley in the City. SECTION 27-3. VEHICLES NEAR FIRES. No vehicte shall be parked or allowed to stand upon any street within four hundred (400) feet of any place where the Fire Department shall be at work upon a burning building or fire. SECTION 27-4. DROPPING HEAVY ARTICLES ON PAVEMENT. � �� No person engaged in the delivering of ice or other goods, wares or merchandise in the City shall let fall upon any improved street or sidewalk any chunk of ice or other heavy articles or packages. SECTION 27-5. SEWERS INDER STREETS. The Board of Public Works shall from time to time inspect all streets under which any sewer shall lie, for the purpose of ascertaining the physical con- dition of such street with relation to the integrity of the sewer. If, upon investigation, the Board of Public Works shall determine that the continuation of traffic over any such street by heavy motor vehicles would endanger the sewer located thereunder, by reason of the shallowness of the sewer and the weak structure of the roadbed, then, in such case the Board of Public Works shall erect signs at suitable places on such street 13miting the weight of vehicles which may travel over such street. Any person who shall travel over any street upon which signs have been erected, according to the provisions of. this Section, with a vehicle the gross weight of which shall exceed the maximum permitted by such signs, shall be deemed guilty of a violation of this Section. SECTION 27-6. RESPONSIBILITY OF OWNER. If any vehicle is found upon a street, alley, highway, park or other public grounds of the City in violation of any provision of this Chapter, or any ordinance of this City, regulating the stopping, or standing or parking of vehicles, and the identity of the driver cannot readily be determined, the owner, or person in whose name such vehicle is registered, shall be held prima facie responsible for such violation. ARTICLE II. TRAFFIC REGULATIONS. SECTION 27-7. STATE TR4FFIC LAWS ADOPTED. Except as otherwise specifically provided in this ordinance, all provisions of Chapters 340 to 348 of the Wisconsin Statutes described and defin3.ng regulations with respect to vehicles and traffic for which the penalty is a forfeiture only, including penalties to be imposed and procedure for prosecution� are heYeby adopted and by reference made a part of this ordinance as if fully set forth herein. Any act required to be performed or prohibited by any statute incor- porated herein by reference is required or prohibited by this ordinance. The provisions of Subsections 346.57, 346.58 and 346.59 of the Wisconsin Statutes, relating to the maximum and minimum speed of vehicles, and such changes and additions as may be appended thereto from time to time are hereby adopted and by reference made a part of this ordinance as if fully set forth herein, except as specified by Subsection (B) hereof pursuant to Subsection 349.11(3)(c) of the Wisconsin Statutes. (B) Exceptions. (1) The speed limits are regulated as hereinafter set forth upon the following streets between the limits designated: County Trunk Highway "AA", City of Oshkosh, Winnebago County, Forty- five (45) miles per hour from its intersection with Libbey Avenue in the City, northerly to its intersection with County Trunk Highway "A" in said City. County Trunk Highway "E", City of Oshkosh, Winnebago County, (Witzel Avenue). Thirty-five (35) miles per hour from a point three hundred fifty (350) feet west of its intersection with Meadow Street in the City, westerly to its intersection with U.S. 41 in said City. County Trunk Highway "I", City of Oshkosh, Winnebago County, (OregoTi' Street). Thirty-five (35) miles per hour from its intersection with 1h•enty-fourth Avenue in the City, southerly to the south Corporate Limits of said City. County Trunk Highway "K", City of Oshkosh, Winnebago County, (West 2Uth Avenue). Tfiirty-five (35) miles per hour from its inter- section with Iowa Street in the City westerly to tts intersection with South Park Avenue in said City. Porty-five (45) miles per hour from its intersection with South Park Avenue in the City westerly to the Corporate Limits of said City. Algoma Boulevard, City of Oshkosfi, Winnebago County. Fifteen (15) miles per hour from Wisconsin Avenue to Woodland Avenue. (2) Twenty-five (25) miles per hour for a11 vehicles on the following specified City streets: Bowen Street, from Murdock Avenue to Nicolet Avenue. Vinland Road, from Murdock Avenue to Morgan Avenue. (2.1) Thirty (30) miles per hour for all vehicles on the following named streets: Jackson Street, from Murdock Avenue to Bacon Avenue. (3) Thirty-five (35) miles per hour for aIl vehicles on the following specified City street�: West Ninth Street, that portion that lies in the City from Highway 41 and westerly thereof. South Park Avenue, from Knapp Street to West 20th Avenue. South Main Street, from West 17th Avenue southerly to the City Limits. 20th Avenue, that portion that lies in the City between Iawa Street and STH 44. Washburn Street, that portion that lies in the City beEween STH 21 and Ninth Avenue. Koeller Street, that portion that lies in the City between Oshkosh Avenue and three-tenths (.03) of a mile south of iVinth Avenue. (4) Forty (40) miles per hour for all vehicles on the following specified City streets: 20th Avenue, that portion that lies in the City between STH 44 and USH 41. (5) Forty-five (45) miles per hour for all vehicles on the following specified City streets: Washburn Street, that portion that lies in the City between CTH "K" and Ninth Avenue. Koeller Street, that portion that lies in the City between CTH "K" and three-tenths (0.3) of a mile south of Ninth Avenue. Jackson Street, from Bacon Street north to a point forty-six-on� hundredths (0.46) of'a mile south of its intersection with County Trunk Aighway "J". SECTION 27-9. DELIVERY OF FORFEITURES. The officers accepting Yorfeited penalties and costs shall deliver them to the City Treasurer of the City at least once in each seven (7) days. SECTION 27-10. REFERE.VCE TO STATUTES. The term "Wisconsin Statutes" whenever used in this Chap[er shall mean the Wisconsin Statutes referred to in Section 18.01(8) of this Code. SECTION 27-11. RIDZNG WITN AN INTOXICATED PERSON. No person shall ride with any intoxicated person who is operating any vehicle in the City. SECTION 27-12. TRAFFIC PENALTIES. (A) Any person who shall violate any of the provisions of this Chapter shall, upon conviction therof, forfeit the amount of the penalty provided by section violated, and if the section does not provide a penalty, shall forfeit not less than One Dollar ($1.00) nor more than Five Hundred Dollars ($500.00), together with the costs of prosecution, and in default of payment of the forfeiture and costs of prosecution shall be imprisoned in the County Jail until said forfeiture and costs are paid, but not exceeding ninety (90) days. Any person who shall violate Section 27-23, specifically Appendix A-9, of the Oshkosh Municipal Code shall, upon conviction thereofg forfeit the sum of not less than Twenty Dollars ($20.00) nor more than Two Hundred Dollars ($200.00) together with costs of prosecution, and in defauLt of payment of the forfeiture and costs of prosecution shall be imprisoned in the County Jail until the forfeiture and costs are paid, but not exceeding thirty (30) days. SECTION 27-12.1. BICYCLE VIOLATIONS; PENALTIES. _ . (A) Any person who shall violate the provisions of Section 27-7 described and defined in Section 346.77, 346.79 (1-3), 346.80 or 346.81 (2) may be fined not more than 1t.*enty Dollars ($20.00). (B) Any person violating Section 27-7 described and defined in 346.78 or 346.79(4) may be fined not less than Ten Dollars ($10.00) nor more than Twenty Dollars ($20.00) for the first offense and not less than Twenty-five Dollars ($25.00) nor more than Fifty Dollars ($50.00) for the second or subsequent convictions within one (1) year. (C) Any person violating Section 27-7 as described and defined in 346.81(1) map be fined not less than Ten Dollars ($10.00) nor more than ltao-hundred Dollars ($200.00). SECTION 27-12.2. RIGHT TO STIPULATE GUILT FOR BICYCLE VIOLATIONS � (A) A person to whom a Summons or Order of the Oshkosh Police Department has been issued to appear in court for violation of operation of a bicycle may appear at the Oshkosh Police Department seventy-two (72) hours prior to the time established for appearance in court and enter a plea of. "nolo contendere" to such charges and forfeit the sum of Ten Dollars ($10.00) plus Six Dollars ($6.00) costs for the first offense within a year. For a second and suba sequent offense of the same ordinance within a one-year period, the penalty shall be 'itaenty Dollars ($20.00) plus Six Dollars ($6.00) costs. (B) When a person charged with such violation and signs a Stipulation of Guilt and enters a plea of "nolo contendere" and pays the fine and cost as set out in subsection (A) herein, such person need not appear in court and no witness fees or other costs shall be taxed. SECTION 27-13. ENFORCEMENT. (A) Traffic Division. There is established a Traffic Division in the City, under the jurisdiction of the Chief of Police, which division is vested with authority to receive the forfeitures and the penalties hereinafter enumerated, which shall be collected by the proper court, which court shall report and deposit such forfeitures and penalties in the same manner as it has heretofore reported and deposited the same. The Traffic Division shall deposit forfeitures and penalties collected with the City Treasurer at least once every fourteen (14) days. The Chief of Police is instructed to delegate an officer to be in charge of such division at all times. Tlie Chief of Police shall make all needful rules and regulations not inconsistent with this Chapter, or any other ordinance of the City to properly operate such division efficiently. (B) Parking Violations. Any person to whom a ticket has been issued for violation of any overtime or meter violation parking regulation of the City may pay the forfeiture therefor in accordance with Section 27-40 and 27-48 of the Municipal Code. If the forfeiture is not paid within ten (10) days, an action will be commenced by the City in accordance with the uniform traffic procedure for nonmoving violations as set forth in Wisconsin Statutes Section 345.28. (C) Moving Violations. This Chapter shall be enforced in accordance with the provisions of ss. 345.20 to 345.33, Ch. 299 and s. 66.12 of the Wisconsin Statutes. (1) Stipulation of Guilt or No Contest. Stipulations of guilt or no contest may be made by persons arrested for violations of this ordinance in accordance with s. 66.12(1)(b), Wis. Stats., whenever the provisions of s. 345.27 are inapplicable to such violations. Stipulations shall conform to the form contained on the uniform traffic citation and complaint under s. 345.11, Wis. Stats., and may be accepted within five (5) days of the date of the alleged violation. Stipulations may be accepted by the Police Depart- ment. 1 (2) Deposits. Any person stipulating guiZt or no contest under Subsection (1� of this Section must make the deposit required under s. 345.26, Wis. Stats., or, if the 3eposit is not established under such statute, shall deposit a forfeited penalty as prov3ded in tfie deposit schedule fixed by the board of county judges and approved by the Chief of Police. Deposits may be brought or mailed to the office of the Police Department as directed by the arresting officer. Deposits for parking or nonmoving violations shall be mailed or brought to the Police Department. (D) Records. The Chief of Police shall establish a proper and adequate system of accounts, records and procedures for [he operation of the Traffic Division, and he shall have caused to be printed the necessary forms to be used in carrying out the provisions of this Chapter. citation therefor may, except for violations of Section 34fi.63 and for violations causing serious bodily injury, accept a written stipulation of guilt and required penalty plus fees and costs in the sum of Five ($5.00) Dollars from such person. (B) Such stipulation shall be in substantially the following form: STIPULATION OF GUZLT STATE OF WISCONSIN ) ) ss. COUNTY OF WINNERAGO ) I. .......................... having heen issued a citation on the .......... day of ................ 19...., for violation of section 8.01 of the Revised Municipal Code of the City of Oshkosh, Wisconsin, hereby stipulate that I am guilty of such offense and consent to forfeit as the penalty for such offense without court order or hearing the sum of $ , plus $5.00 costs, here- with delivered to the chief of police or designated official of said city. In consideration of this forfeiture and costs paid by me it is understood that I do not have to appear in court for this offense, and that no further fees or costs are taxable against me. FORFEITED PENALTY. � The sum to be forfeited pursuant to the stipulation for violation shall be according to the schedule of penalites established by the Judge of the Municipal Court of the City of Oshkos*� and County of Winnebago, but said penalties shall not exceed the maximum forfeitures provided herein for such offense. SECTION 27-15. DELIVERY OF FORFEITURE. The officers accepting forfeited penalties and costs shall deliver them to the Clerk of the Municipal Court in and for the City, at least once in each seven (7) days, and said Clerk shall prepare the required reports concerning same and shall disburse the funds to the City Treasurer according to law. SECTION 27-16. BAIL BONDS. Nothing in this Section shall be construed to limit the right of the proper authorities to accept bail bonds, deposits or certificates or money deposits as provided in Subsections 66.114, 345.13 or 345.15 of the Wisconsin Statutes. SECTION 27-17. STATEMENT OF NOTICE. Any official, enforcement officer or the City Attorney accepting a stipulation of guilt or a bail under the provisions of this Article or prosecuting a violation of this ordinance shall comply with the provisions of Subsections 343.27 and 343.29 of the Wisconsin Statutes and shall inform the accused of the effect of a stipulation of guilt, forfeiture or bail or plea of guilty or nolo contendere. Such official or officer shall require the accused to sign a statement of notice which shall be in substantially the following form: STATEMENT OF NOTICE State of Wisconsin ) ) ss. Dated : ......................... Signed:......................... Receivedby :.................... ARTICLE III. PEDESTRIAN REGULATIONS. SECTION 27-18. PEDESTRIAN RIGHT OF WAY. The operator of any vehicle shall yield the right of way to a pedestrian crossing the street within any marked or unmarked crosswalk at an intersection except � those intersections where the movement of traffic is being regulated by traffic officers or traffic control signals. SECTION 27-19. AT CONTROLLED INTERSECTIONS. Every pedestrian shall be subject to traffic control signals. ldhenever traffic is controlled by signals exhibiting different colored lights, the following colors shall indicate and apply to pedestrians: (A) Green of "GO". Pedestrians facing signal may proceed across the roadway within any marked or unmarked crosswalk. (B) Yellow or "CAUTION" and Red er "STOP". Pedestrians facing such signals shall remain on the curb until the Green or "GO" signal is shown. SECTION 27-20. PROHIBITED CROSSINGS. (A) Between adjacent intersections at which traffic control signals are in operation, pedestrians shall not cross at any place except in a crosswalk. (B) On streets not covered by Subsection (A) of this Sec*_ion no pedestrians shall cross a street in the City between intersections when a vehicle is approaching from either direction so as to interfere with the free movement of traffic or constitute a hazard for his own safety, or use such highway at any time in a reckless or negligent manner. SECTION 27-21. DIVIDED STREETS; RIGHT OF WAY ON. Upon the intersection of divided streets or streets provided with safety islands where in either case, traffic is controlled by safety control signals or by traffic officers, the pedestrian shall have the right of way only on that portion of the street between the street limits and the spaces not used by traffic. SECTION 27-22. RIGHT OF WAY ON SIDEWALKS. Pedestrians upon any sidewalk shall have the right of way over all vehicles crossing such sidewalk. ARTICLE IV. ARTERIES AND ONE-WAY STREETS. SECTION 27-23. VEHICLES TO OBEY TRAFFIC SIGNALS. It shall be unlawful for any person driving or operating any motor vehicles or other vehicle to drive or cause the same to be driven into and upon any of the intersections of streets in the City designated and declared by the Traffic Supplement (Appendix A) to be traffic signal controlled intersections or other- wise designated by appropriate traffic without obeying said traffic signals as set forth under Section 346.37 through Section 346.42 of the Wisconsin StatuCes. SECTION 27-24. VEHICLES TO STOP AT THROUGH STREETS. � It shall be unlawful for any person driving or operating any motor vehicle or other vehicle to drive or cause the same to be driven into and upon any of the streets in the City designated and declared by the Traffic Supplement (Appendix A) to be through streets for through traffic, or otherwise pXOperly designated by an appropriate "STOP" sign, without first coming to a full and complete stop. SECTION 27-25. VEHICLES TO STOP AT FOUR WAY STOPS. It shall be unlawful for any person driving or operating any motor vehicle or other vehicle to drive or to cause the same to be driven into an intersection designated and declared by the Traffic Supplement (Appendix A) to be a four way stop without first coming to a full and complete stop. SECTION 27-26. VEHICLES TO YIELD RIGHT OF WAY. The operator of a vehicle, when approaching any intersection at vhich has been installed a yield right of way sign, shall yield the right of way to other vehicles which have entered the intersection from an intersecting highway or which are approaching so closely on the intersecting highways as to constitute a hazard of collison and, if necessary, shall reduce speed or stop in order to so yield. (See, Traffic Supplement, Appendix A, for designation of yield right of way intersections). ARTICLE V. SPECIFIC PARKING RESTRICTZONS SECTION 27-27. ALL NIGHT PARKING PROHIBITED. (A) Regulations. No person shall suffer any vehicle of any kind or description to be parked on any public highway, or portion of street right-of-way, including but not limited to terraces and sidewalks, in the City of Oshkosh between the hours of 2:00 a.m. and 5:00 a.m. (B) Exceptions. (1) The Police Department may grant permission to so park a vehicle on a temporary basis in unusual circumstances. (2) In congested areas, as designaCed by the Police Department, vehicles may be parked during sueh hours; provided they shall first obtain a special privilege permit from the Police Department after filing an application with said Department and paying a permit fee to the Police Department, all as required under this ordinance and shall be parked as authorized by such permit. (3) Motor trucks motor busses permits. larger than 3/4 ton, motor delivery wagons, semi-trailers, shall not be eligible for such special privilege parking SECTION 27-28. SPECIAL PRIVILEGE PERMIT FOR ALL NIGHT PARKING. � (A) Contents of application. The application form shall contain the name and address of the owner of the vehicle, the license number, make and year of the vehicle, the name of the month of issuance, and the date of expiration, a statement that the owner resides in the designated congested area and is unable to find reasonable accommodations. (B) Contents of permit. The permit shall contain the number of the permit, the name and address of the owner of the vehicle, the make, year and license number of the vehicle, the location where the vehicle is to be parked, the month of issue, and date of expiration. The permit shall be a different color every month. All permits shall be numbered consecutively. (C) Approval by Police Department; term. The application for a special privilege permit shall be first approved by the Police Department in accordance with the needs of the indivicival in said congested areas before a special privilege permit can be issued by said Department, and said permit shall be valid for a period of not longer than one (1) month ending at midnight of the last day of the month of issue. The Police Department may.revoke said permit if at any time reason- able accommodations are available to the owner, or for failure to comply with any of the provisions of this ordinance. (D) Location on vehicle. The pexmit shall be placed in the lower right hand corner of the windshield. or in such other conspicuous place as the Police Department may designate, while the motor vehicle is in a parked position. (E) Fee. The special privilege permit fee shall be Six ($6.00) Dollars per month; provided, however, that if any permit is granted after the 15th day of the month, the permit fee shall be Three ($3.00) Dollars for the Yemainder of said month. (F) Receipts to be placed in special fund. All moneys received from said permit fees shall be placed in a separate fund for off-street parking purposes only, except that costs for the printing of application forms and permits, stationery, postage, office supplies, and for any other kindred forms and the printing thereof in connection with the administration of this ordinance shall be paid out of this fund. SECTION 27-29. PARKING LOCATIONS FOR VEHICLES WITH PERMIT. Any vehicles parked pursuant to the provisions of Sections 27-27(A) and (B) above shall be parked only on the even numbered side of the street on those nights bearing an even calendar date during the portion thereof before midnight, and on the odd numbered side of the street on those nights bearing an odd calendar date during the portion thereof before midnight, except that where bays � have be provided in terraces, that such vehicles may be parked in such bays on all calendar dates, subject to any orders which the Police Department may issue to the contrary; that said permit shall not be issued for a location where parking is prohibited on the opposite side of ihe street except where such permit is for a bay in the terrace; no more than one permit shall be issued on any street for each one hundred fifty (150) feet of street space except where such permit is for a bay in the terrace; no vehicle shall be allowed to remain parked in such space after 12 o'clock noon of the day following the overnight parking. The parking permit issued pursuant to this Section shall be subject to the provisions of Section 27-38 of this Code relating to emergency snow removal regulations. SECTION 27-30. EMERGENCY CASES. The provisions of this Article shall not be effective and in force on the lst day of January in any year. Provided, further, that in case of night workers who are not provided shall constitute an emergency, and the Chief of Police shall, subject tb the approval of the Co�non Council, designate suitable loca- tions where, notwithstanding the provisions of this Article, such night workers shall be permitted to park their automobiles during the period of their employment. This Article shall not apply to licensed physicians and surgeons in emergency situations. SECTION 27-31. PARKING PROHIBITZONS ON DESIGNATED STREETS AND ALLEYS. No automobile or other vehicle, whether attended or unattended, shall at any time park upon any of the designated streets, avenues, boulevards or parts thereof, which are designated as "No Parking" areas, and no automobile, or other vehicle, whether attended or unattended, shall be parked upon the designated streets, avenues, boulevards or parts thereof, longer than the time limitations designated, between the hours of 8:00 o'clock A.M. and 6:00 o'clock P.M., except on Sundays, unless otherwise specifically provided; angle parking is prohibited on City streets; it shall likewise be unlawful for any person to park any automobile or other vehicle contrary to any appropriate sign installed by the City restricting parking. • SECTION 27-32. PUBLIC PARKING AREAS. (A) Ttaenty-four (24) hour limit. No person shall park or cause to be parked, any automobile, truck, or other vehicle whatsoever in any City operated unmetered public parking area for more than twenty-four (24) hours at one time, or such other period of time as the City Manager may hereafter designate. (B) City Manager may alter time limit. The City Manager is authorized, when in his opinion reasonable traffic and parking conditions require same, to further limit the time period for parking in said public parking areas, or portions of any said public parking areas. (C) Patking in excess of twenty-four (24) hours; permission required. � In the event any person shall desire to park any vehicle in said area for a period of time exceeding the maximum number of hours, permission therefor shall first be obtained from the Chief of Police. (D) Signs to be posted. Proper and conspicuous signs shall parking lots advising users of the be erected at convenient places on said parking limitation. SECTION 27-33. PLACES OF PUBLIC ASSEMBLAGE. No person shall park any vehicle upon any street adjacent to the front, rear, or side entrance of any church, hospital, theater, moving picture house, public school, parochial school, private school, state institution of learning, hotel, or other place of public assemblage within the limits of the City during the hours designated by an official sign. SECTION 27-34. AT BUS STOPS. No person shall stop, stand, or park any automobile or other vehicle at any place in the City which shall have been designated as a bus stop, and an official sign erected to so designate the area, unless otherwise specifically provided. SECTION 27-35 TAXICABS ON MAIN STREET. No taxi shall park on Main Street from the Fox River to Parkway Avenue. SECTION 27-36 TITAL STADIUM PARKING RRSTRICTIONS. (A) No person shall park or cause to be parked, any automobile, truck, or other vehicle whatsoever as it becomes necessary, at the discretion of the Police Department for a period of one (1) hour, before and until one (1) hour after events at the Titan Stadium on the following described streets: Josslyn Street, East side, from Adams Avenue to Witzel Avenue. Ruah Avenue, south side, from Sa:ryer Street to Bauman Street. Taft Avenue, south side, from Sawyer Street to Bauman Street. Pierce Avenue, south side, from Sawyer Street to Bauman Street. Adams Avenue, south side� from Sawyer Street to Bauman Street. (B) The prohibition of parking along streets under the above provisons shall become effective by police direction and/or appropriate signs and barri- cades, (C) This section does not rescind any parking regulation already in effect in the above described streets. SECTION 27-37. SCHOOL ZONES. The Board of Yublic Works with the advice and counsel of the Chief of Police, shall locate suitable pointed markers and signs, of a type approved by the State Highway Commission at appropriate places and in an appropriate manner in the vicinity of each shool building in the City. Such signs and markers when 30 placed and being the speed limit designated according to Section 27-8 of this Code, shall constitute a school safety zone in the vicinity of each such school. SECTZON 27-38. CITY HALL PARKING LOT, 215 CHURCH AVENUE. (A) Visitor parking; two (2) center aisles. No automobile or other vehicles whether attended or unattended shall park in the area designated as "Visitor Parking" (2WO (2) center aisles) in the City Hall Parking Lot located at 215 Church Avenue for a period of time exceeding one (1) hour. The first stall on either side of the center aisle is hereby designated "Handicap Parking" and shall be limited to those persons having handicapped license plates on their vehicles. (B) Employee parking. No automobile or other vehicle whether attended or unattended shall park in the City Hall Parking Lot located at 215 Church Avenue in an area other than those designated as "Visitor Parking" without a designated parking permit issued by the City Manager, visibly exhibited on said vehicle. (C) Five (5) Minute Parking. The southwesterly portion immediately adjacent to City Hall is hereby designated as "5 Minute Parking." (D) When Applicable. The provisions of this Section shall apply only during the hours of seven (7:00) o'clock A.M, to five (5:00) o'clock P.M. on Monday thru Friday. SECTION 27-38.1. PUBLIC LIBRARY PARKING. (A) Employee parking is hereby designated at the South Side Library Branch parking lot located at 913 Oregon Street during the hours of 9:00 A.M. to 8:00 P.P1. on Monday thru Friday and from 9:00 a.m. to 1:00 P.M. on Saturday. SECTION 27-38.2. PARKING ON TERRACES PAOHIBITED. ' No automobile or other vehicle, whether attended or unattended, may park on any municipally owned terrace; terrace meaning that portion between the sidewalk and the normal back of the curb line. SECTION 27-39. SNOW EMERGENCY TRAFFIC REGULATIONS. (A) Declaration of sno�a emergency; plowing of streets. There is hereby declared an emergency to exist in the City by reason of heavy snowfall whenever snow falls during any period of twenty-four (24) hours or less to a depth of three (3) inches or more in that such snowfall constitutes a serious public hazard, impairing transportation, the movement of food and fuel supplies, medical care, fire, health and police protection and other vital facilities of the City. Such emergency is declared to continue for a period of forty-eight (48) hours from the time it is announced � or until such earlier time as snow plowing operations have been declared completed. Whenever such an emergency exists and the proper City officials shall have caused announcement thereof to be made by at least one (1) radio station whose noxmal operating range covers [he City, it shall be unlawful for any operator or owner to park,or suffer or permit a vehicle to be parked so as to interfere with snow plowing operations on the City streets. In the event the owner, or operator, of such vehicle shal.l not attend to its removal the Police Department is authorized to move such vehicles to some other suitable location, at the owner`s expense, so as not to inter- fere with snow plowing. (B) Parking during snow removal period. When after any snowfall, which the Director of Public Works and Chief of Police shall deem to be sufficiently heavy to necessitate its removal from the vehicular traveled portion of the streets, the Chief of Police shall forthwith establish "no parking" zones on any streets where such snow removal operations will be taking place. Such "no parking" areas shall be marked with appropriate moveable signs not less than four (4) hours prior to the commencement of the snow removal operation, and such streets may be shut off and blocked at all times while the crews are operating thereon. It shall be the duty of the operator of a motor vehicle to check his vehicle a£ter each snowfall to determine whether it is parked in an area from which snow is to be removed, and if in such area such vehicle shall be removed forthwith. In the event the owner, or operator, of such vehicle shall not attend to its removal, the Police Department is authorized to move such vehicles to some other suitable location, at the expense of the owner thereof, so as not to interfere with snow removal. (C) Streets narrowed by excessive snow. When after any snowfall and snow plowing ogeration a street, or portion thereof, is sufficiently narrowed by excessive snow having been plowed toward the curbing, so as to constitute a serious public hazard, impairing transportation and the movement of vehicular traffic, the Chief of Police shall Porthwith restrict parking on such streets until such time as such hazard is eliminated by the placing of appropriate moveable signs thereon restricting the parking of vehicles, whereupon it shall be unlawful to park a vehicle on such streets contrary to the restrictions thereby imposed. SECTZON 27-40. RIGHT TO STIPULATE GUILT IN PARKING VIOLATZONS; PROCEDURES. (A) Procedure. (1) Person to whom a su�ons or order of the Police Department has been issued to appear at the police station for violating any of the provisions of Subsections 27-28, 27-29, 27-30, 27-38, and 27-39 may within forty-eight (48) hours after six (6:00) o'clock P.M. of the day of the violation, appear at the police station of the City in answer to the charges set forth in said su�ons or order and may sign a written plea of "guilty" and consent to an entry of judgment for the sum of One ($1.00) Dollar. Each such person may after said forty- eight (48) hour period, and during the succeeding ninety-six (96) hour period, consent to an entry of judgment for the sum of ltvo ($2.00) � Dollars. Subsequent to this ninety-six (96) hour period and prior to the commenceu�ent of court proceedings pertaining to the violation, such person may conset to an entry of judgement for the sum of Five ($5.00) Dollars. The failure of such owner or operator to make such payment shall render such owner or oeprator subject to the penalties hereinafter provided for violation of the provisions of this Section. Each time a designated parking period limit is exceeded even though such excesses shall be consecutive, shall consYitute a separate viola-- tion. Acceptance of a receipt from the Police Department will can- situte the equivalent of a written plea of "guilty" and consent to the entry of such judgment. (2) Person to whom a summons or order of the Police Department has been issued to appear at the police station for violating any of the provisions of Subsection 27-27 may appear at the police station of the City in answer to the charges set forth in said su�ons or order and may, within ten (10) days of the date of violation, sign a written plea of "guilty" and consent to an entry of judgement for the s� of Five ($5.00) Dollars. The failure of such owner or operator to make such payment shall render such owner or operator subject to the penalties hereinafter provided for violation of the provisions of this Section. Each time a designated parking period limit is exceeded even though such excesses shall be consecutive, shall consCitute a seperate violation. Acceptance of a receipt from the Police Department will constitute the equivalent of a written plea of "guilty" and consent to the entry of such judgment. (B) Arraig�ent and trial postponed. No violators of the provisions of said Sections shall be arraigned or tried in court unless the accused demands an immediate trial or until after the time allowed violators of this Section for signing said written plea of "guilty" and consent to entry of judgment has expired. (C) Failure to appear or plead guilty. If a person receiving any such summons or order of the Police Department shall fail to appear within the time specified herein, or if appearing, shall refuse to sign a written plea of "guilty" and consent to entry of judgment, the trial of said case shall proceed in the usual manner and the provisions of this Section shall not apply, and the violator shall be subject to the penalty hereinafter provided. When a case is tried upon such written plea of "guilty" and consent to entry of judgment, no wit- nesses shall be sworn for the prosecution or the defense. (D) Scheduling of trial. If, after signing said written plea of "gui2ty" and consent to entry of judgment, the defendant at the time of trial, which trial shall be held at nine (9:00) o'clock A.M. on the day following the expiration of the forty- eight (48) hour period hereinbefore mentioned, or the ten (10) day period for Subsection 27-27 hereinbefore mentioned, insists that witnesses be sworn for the defense, said case immediately shall be put upon the trial calendar and adjourned to a day certain, and witnesses may be subpoenaed on behalf of the prosecution and the defense. The trial of said case shall then proceed in the usual manner, the provisions of this Section shall not apply, and the defendants, upon conviction, shall be punished as hereinafter prov3ded. ARTICLE VI. PARKING METER REGULATIONS. SECTION 27-41. PURCHASE AND PAYMENT OF METERS. � The proper City officials shall enter into a contract for the purchase and installation of the necessary number of parking meters required to fulfill the purpose of this Article and the type to be autizorized by the Co�on Council, and to provide payment therefor exclusively from the receipts obtained by the City from the operation of such parking meters. SECTION 27-42. CITY PfANAGER TO CONTROL METERS. The City Manager may cause the installation of additional meters on the streets above named and within the areas designated, and may cause the removal of any meters heretofore or hereafter installed, all without further action by the Coffion Council; the City Manager shall, however, report to the Council for confirmat3on of action so taken. SECTION 27-43. PAP.KING OF VEHICLES. (A) Proper parking and payment. When any vehicle shall be parked next to a parking meter, the owner or operator shall park within the area designated by the curb or street marking lines, and upon entering said parking space shall immediately deposit in the meter a coin or coins up to the amount needed for the maximum legal parking limit using denominations of coins and amounts thereof as prescribed on the face of the meter. (B) Overtime parking. Said parking space may then be used by such vehicle during the legal parking limit provided or such fraction thereof as the amount of the coins deposited bear to the cost for the legal limit; and said vehicle shall be considered as unlawfully parked if it remains in said space beyond the legal parking limit or such fraction thereof as the coin or coins deposi[ed. bear to the cost for the legal limit or when said parking meters display a signal showing illegal parking. (C) Owner liable for violations. It shall be unlawful for any person to cause or permit any vehicle registered in his name to be unlawfully parked as set out in this Section. SECTION 27-44. PARKING METER RATES. The rates for parking in the City shall be as follows: (A) Five ($.OS) Cents per hour areas. (1) All twelve (12) minute meters at Ttao($.02) Cents as designated in this Section shall be at the rate of One ($.O1) Cent per six (fi) minute period. �.. �2) SECTION 27-45 A1T twelve 12 minute meters at One � C) ($.O1) Cent as designated in this Section shall be at the rate of One ($.O1) Cen.t per twelve (12) minute period. OVERTIME PARKING. It shall be unlawful for any person to deposit or cause to be deposited in a parking meter one (1} or more coins for the purpose of extending the parking time beyond the maximum time fixed by ordinance. SECTION 27-46. SLUGS PROHIBITED. It shall be unlawful to deposit or cause to be deposited in any parking meter any slug, device or other substitute for a coin of the United States, and it shall be unlawful for any person to tamper with, open, willfully break or destroy any parking meter or part thereof. SECTION 27-47. ENFORCII�SENT; PAYMENT OF FINE. (A) Duty to report. It shall be the duty of police officers of the City, acting in accordance with instruction issued by the Chief of Police, to report: (1) The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parking in violation of any of the provisions of this Article. (2) The State license number of such vehicle. (3) The time at which such vehicle is parking in violation of any of the provisions hereof. (4) Any other facts, a knowledge of which is necessary to a Chorough understanding of the circumstances attending such violation. (B) Attach traffic citation. Each such enforcement officer shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been paTked in violation of a provision of this 5ection. SECTION 27-48. PAYMENT OF FINE; TIME LIMITS; FAILURE TO PAY FINE. Each such owner or operator, may, within forty-eight (48) hours after 6:00 p.m. of the day of the violation pay to the city as a penalty for and in full satisfaction of such violation, the sum of One ($1.00) Dellar. Each such owner or operator, may, after said forty-eight (48) hour period, and during [he succeeding ninety- six (96) hour period, pay a penalty of 24.�0 ($2.00) Dollars. Subsequent to this ninety-six (96) hour period and prior to the commencement of court proceedings, each such owner or operator may pay to the City as a penalty for and in full satisfaction of such violation the sum of Five ($5.00) Dollars. �'he failure of such owner or operator to make such payment shall render such owner or operator subject to the penalties hereinafter provided for violation of the provisions of this section. Each time a designated parking period limit is exceeded even though such excesses shall be consecutive, shall constitute a separate violation. SECTION 27-49. COLLECTOR AND MAINTENANCE MAN; APPOINTMENT; DUTIES. � There is hereby established the position of "Collector and Maintenance Man for Parking Meters", which position shall have duch duties as are prescribed by the Director of Administration, and shall be under the general direction of the City Manager. The hiring and discharging of such employees shall be vested in the City Manager. The salary of such position as established by the Common Council shall be paid from parking meter revenues and sufficient of such revenues are hereby appropriated for said purpose. It shall also be his duty to collect all coins deposited in said parking meters and deposit the same with the City Treasurer and receive a receipt therefor. SECTION 27-50. USE OF METER REVENUE. (A) For parking facilities. The net revenue resulting from the operation of said parking meters after the deduction of the original cost, cost of replacements, repairs and surety bond as hereinbefore provided, and cost of collection, enforcement and administration, shall be placed in a special City fund hereby designated "Off Street Parking Fund Only," the purpose of which fund shall be to make provisions for off street parking lots; said fund to be used for said purpose as the Council may from time-to-time direct. Any unexpended balances in said fund are not to become part of the General Fund of the City and the City Treasurer shall keep a separate bank account thereof so that funds are not commingled with other City funds. All earnings, upon investment of said fund, shall when received be and constitute an addition to the fund. However, any advances made from the General Fund to provide off street parking by lots purchased or other method of acquisition of parking sites, pending the accumulation of sufficient receipts from the operation of the parking meters herein authorized to provide such parking sites, shall be reimbursed out of said "Off Street Parking Fund Only" when sufficient moneys accumulate therein. (B) Parking meter revenues enacted as a police power ordinance. The payment of the sums required to be deposited in said meters is hereby levied as a police regulation and inspection fee to cover the cost of providing parking spaces, parking meters, and installation and maintenance thereof; the cost of regulation and inspection, operation, control and use of the parking meter spaces in zones created herein; for the regulation and control of traffic�moving in and out of and parking in said spaces and zones so created; and for the cost of any resultant traffic administration expense. SECTION 27-51. CAPPING METERS. (A) Loading zones. Persons entitled to loading zones shall apply to the Chief of Police for this privilege; and loading zones shall be authorized when approved by the Chief. The Chief of Police shall furnish caps to those applicants who are eligible. Any person granted such loading zone privilege, who shall leave a meter capped after the time as determined by the Chief of Police shall be guilty of a violation. (B) Theaters. All parking meters installed in front of theaters shall be capped at least one (1) hour prior to the opening of the theater to the public, and remain capped while the theater is open to the public. (C) For business purposes; fees. The Chief of Police may issue hoods or caps for parking meters for a fee of One ($1.00) Dollar per day or Ten ($10.00) Dollars per month to all persons who make application therefor whenever in the opinion of the Chief of Yolice the use of a hood or cap is practical necessity for business pur- poses. A record of all hoods or caps issued and moneys collected shall be kept by the Police Department; and the moneys shall be turned over to the City Treasurer once a month for deposit in the parking meter fund. If in the opinion of the Chief of Police, the privilege herein authorized is misused by any applicant, he shall forthwith revoke said privilege and repossess the hood or cap, and the balance of any fee paid for said pri- vilege shall not be returnable. (D) Violation. No person shall park a vehicle in any loading zane or meter stall where the meter is capped, except persons operating under loading zone or meter capping privileges. SECTION 27-52. TWO (2) HOUR METERED CITY OWNED PARKING LOT. The following described City owned park�ng lots in the City are hereby designated and established as parking meter zones, for two (2) heur parking, between the hours of nine (9:00) o'clock A.M. and six (6:00) o'clock P.M. daily, except on Sundays and on New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanks- giving Day and Christmas Day; and except on Fridays when the hours shall be nine (9:00) o'clock A.M, to Nine (9:00) o'clock P.M. (A) Soo Line parking lot, between Algoma Boulevard and Church Avenue, immediately adjacent to and east of the Soo Line Railroad Company track. (B) Old City Hall parking lot located at the northwest corner of the intersection of State Street and Otter Avenue. � (C) Algoma Boulevard Lot - all meters facing Brown Street and the three (3) meters in both sections of the south end shall be monthly rentals at the rate of $7.00 per month. Algoma Boulevard Lot - two (2) spaces in the southeast corner be changed from 10� per hour for [wo hours to monthly rental at [he rate of $7.00 per month. (D) Elk's Club Parking Lot -- all metered stalls except those on the east end of the lot - 2 hour meters at 10� per hour. SECTION 27-53. FOUR (4) HOUR METERED CITY OWNE➢ PARKING LOT. The following described City owned parking lots in the City are hereby designated and established as parking meter zones, for four (4) hour parking, between the hours of nine (9:00) o'clock A.M. and six (6:00) o'clock P.M. daily, except on Sundays and on New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanks- giving Day and Christmas Day; and except on Fridays when the hours shall be nine (9:00) o'clock A.M. to Nine (9:00) o'clock P.�i. (A) West Tenth Avenue lot located on the south side of West Tenth venue one hundred eighteen (118) feet east of Oregon Street. (B) State Street Lot, located on the east side of State Street between Washington Avenue and Waugoo Avenue. (C) Waugoo Avenue Lot, located between State Street and Court Street except the twelve (12) meters on the easterly end of said lot. SECTION 27-54. MUNICIPAL PARKING RAMP (A) The following described city owned parking ramp is hereby designated and established as a parking meter zone for parking up to twenty-four (24) hour periods and such shorter periods of time for such portions of the ramp as the needs of parking of vehicles requires, as deemed advisable from time to time by the City Manager. The rate for parking on the municipal parking ramp is Ten Cents ($0.10) per hour with the exception of the meters on Ramp 8 which shall be Five Cents ($0.05) per hour. (B) Municipal Parking Ramp located on High Avenue. No operator shall allow or cause to be parked, or park an automobile in any vehicular parking stall, or otherwise, in that portion of the Municipal parking ramp which is duly designated as a parking area for monthly rentals without first having rented said stall. The monthly rate for parking shall be Ten Dollars ($10.00) per month for Ramps 3, 4, 5, and 6 and the monthly rental rate for Ramp 7 shall be Seven Dollars ($7.00) per month. SECTION 27-54.1. TEN HOUR METERED CITY OWNED PARKIN6 LOT. The following described City owned parking lot in the City is designated and established as parking meter zones, for ten (10) hour parking, between the hours of 9:00 a.m. dnd 6:00 p.m. daily, except on Sundays and on New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day; and except on Fridays when the hours shall be 9:00 a.m. to 9:00 p.m.: (A) Church Avenue Lot, located at the southeast corner of Church Avenue and Division Street. (B) The 12 meters on the easterly end of the Waugoo Avenue Lot, located between State Street and Court Street, ' (C) All metered stalls on the east end of Elk's Club Parking Lot - 10 hour meters at 5¢ per hour. (D) All metered stalls in Sears Lot - 10 hour meters at 5¢. per hour. SECTION 27-54.2. MONTHLY PARKING LOT The following described leased parking lot is hereby designated and established as a parking lot to be leased on a monthly basis at the rate of Ten Dollars ($10.00) per month: (A) Sears Parking Lot, excepting therefrom the westerly line of stalls abutting Jefferson Street. SECTTON 27-54.3 WEST 8TH AVENUE PARKING LOT. � (A) The east ten (10) stalls shall be 2-hour parking meters at 5� per hour. (B) The 26 remaining stalls shall be monthly rental stalls at a fee of $7.00 per month. Soo Line East Parking Lot - all meters facing Algoma Boulevard and the 13 meters which are located from Algoma Boulevard to 119 feet north thereof and adjacent to the Soo Line Tracks shall be changed from 2-hour parking at 10� per hour to 10-hour parking at 5� per hour. ARTICLE VIT. HEAVY TRUCK TRAFFIC. SECTION 27-55. THROUGH TRUCK TRAFFIC ROUTES; PROHIBITED AREAS; EXCEPTTONS. (A) No person shall drive or operate any motor truck, truck tractor, tractor, or bus, or trailer or semi-trailer, used in connection therewith, which shall exceed four thousand five hundred (4,500) pounds gross weight, upon Algoma Boulevard from the intersection of Algoma Boulevard with Congress Avenue to the intersection of North Main Street with Algoma Boulevard; and no person shall drive or operate any such vehicle upon Washington Avenue from the intersection of North Main Street with Washington Avenue to Lake Winnebago; upon Vine Avenue between Algoma Boulevard and High Avenue. However, this Section shall not apply to the operation of any such truck or other motor vehicle upon Algoma Boulevard and Washington Avenue for the purpose of reaching a destination on either such boulevard, or leaving therefrom, but no such vehicle shall turn upon Algoma Boulevard or Washington Avenue except at the intersection nearest its said point of destination. Upon leaving such destination, such vehicle shall turn off at the first intersection it reaches. (B) All north and south bound non-stop heavy truck traffic shall use the West Twenty-fourth Avenue Oregon Street-Jackson Street route. , SECTION 27-55.1. TRUCK ROUTES DESIGNATED. (A) No person shall drive or operate any motor truck, truck tractor, tractor, trailer or semi-trailer, used in connection therewith, on any city street except on the following designated streets: Omro Road - Oshkosh Avenue to Highway 41 ltaentieth Street - Highway 44 to Oregon Street Nintfi Avenue - Highway 41 to Main Street Witzel Avenue - Highway 41 to Ohio Street Oshkosfi-Congress Avenue - Omro Road to Highway 110 Murdock Avenue - Highway 110 to Bowen Street Highway 110 (Algoma Boulevard) - North City Limits to Jackson Street and Oregon Street - North City Limits Limits Congress Avenue to South City Twenty-Fourth Avenue - Oregon Street to Main Street Harrison Street - North City Limits to New York Avenue Main Street - Ceape Avenue to South City Limits Main Street - New York Avenue to Irving Avenue Ohio Street - South Park Avenue to Wisconsin Street Wisconsin Street - Ohio Street to Irving Avenue Irving Avenue - Wisconsin Street to Main Street Sawyer Street - Ninth Avenue to Oshkosh Avenue Packer Avenue - Jackson Street to Harrison Street Bowen Street - North City Limits to Ceape Avenue Ceape Avenue - Main Street to Bowen Street South Park Avenue - City Limits to Ohio Street � (B) Trucks permitted on heavy traffic routes. All trucks and loads otherwise permitted under the weight and load restrictions of Chapter 348 of the Wisconsin Statutes which sections are hereby adopted by way of reference thereto so far as applica6le shall be allowed to proceed on and travel over and along the heavy traffic routes set forth in sub- section (A) above. (C) Heavy trucks prohibited on other streets. It shall be unlacrful for any person to operate any motor vehcle the gross weight of which shall exceed 6,000 pounds upon any public street in the City except those particularly set forth in subsection (A) above, as the heavy traffic route, provided, however, that nathing herein contained shall prohibit the ordinary use of any public street or alley for the purpose oF obtaining use of any orders for and delivering or moving supplies or other necessary co�odities to or from any place of business or residence fronting on such highway or street, nor prohibit the use of any street or alley for the purpose of arriving at such destination where such order is to be taken or delivery is to be made, on any excluded street in arriving at any destination where orders are to be taken or deliveries made, as above provided. SECTION 27-56. OPERATORS DUTIES. Every person driving or operating anq of the vehicles enumerated in the pre- ceding Section and approaching the City on any United States, State or County trunk highway which shall be routed through the City shall direct his vehicle in such a manner as to avoid travel on Washington Avenue and Algoma Boulevard in violation of this Subsection. It shall be the duty of the Police Department to erect suitable signs for the purpose of routing truck traffic in accordance with the provisions of this Section. ARTICLE VIII. BICYCLE REGULATIONS. SECTION 27-57. DEFIrITIONS. The term "bicycle" shall mean and include a light vehicle having two (2) wheels, usually tandem, both of which are twenty (20) inches in diameter, or greater, with tires inflated, having a steering wheel and a saddle seat or seats, pro- pelled by the feet acting on tredles connected with cranks or levers. SECTION 27-58. REGISTRATION REQUIRED. � It shall be unlawful for any resident person to operate a bicycle upon any street or public way within the City unless the bicycle shall first have been registered by the owner and properly licensed as hereinafter provided. SECTION 27-59. REGISTRATION PROCEDURE. Registration shall be made by filing an application with the City Clerk setting forth the name, date of birth and address of the owner, together with a complete description of the bicycle, and paying the registration and license fee here- inafter provided. Each registration shall be serially numbered and kept on file in the office of the City Clerk, and a copy thereof furnished to the Police Department. The City Clerk sha11 keep a record of the date of issuance of each license, to whom issued, and the number thereof. Upon such registration, the City Clerk shall issue a license plate, which shall be affixed to the rear of the bicycle under the rear of the seat or saddle easily conspicuous to the rear. Such license plate shall remain so fixed to the bicycle unless removed by order of the Chief of Police or the Municipal Court for cause. SECTION 27-60. LICENSE FEE. The license fee to be paid for each bicycle shall be One Dollar ($1.00): If bicycle license is not applied for within thirty (30) days after registration begins, an additional Fifty ($.50) Cents will be charged for allowing the license to become delinquent. The additional charge would not apply to persons who purchase a bicycle after the thirty (30) day time limit. All such license fees shall be paid to the General Fund of the City. SECTION 27-61. LICENSE RENEWAL. On Easter Monday of each odd numbered year, all bicycle registrations shall be renewed and a fee for such renewal, in the amount of One Dollar ($1.00) shall be paid by each bicycle owner for each bicycle. All bicycles shall be renewed on such date every other year regardless of when the bicycle was originally regis- tered and licensed or re-registered; and upon such registration, a new license plate or license plates shall be furnished the bicycle owner or operator. SECTION 27-62. LOST LICENSE PLATE. In case of theft, loss, mutilation or defacing of said license plate, a new license plate shall be issued by said Department for a fee of One Dollar ($1.00). No person shall willfully remove, deface or destroy any license plate. SECTION 27-63. MUTILATION OF PLATES OR SERIAL NUMBER. It shall be unlawful for any person to willfully or maliciously remove, destroy, mutilate or alter the serial number of any bicycle frame licensed pursuant to this ordinance, or any license plate. SECTION 27-64. TRANSFER OR CANCELLATION. Within ten (10) days after any bicycle registered hereunder shall have changed ownership or be dismantled and taken out of use, the person in whose name the bicycle has been registered shall report such information to the Police Department. � a e of chan e or ownershi the re istration shall thereu on be cance d In c s g p, B P and new license issued to the new owner upon proper application and payment by him of a Qne Dollar ($1.00) registration fee. In case of dismantling and taking out of operation or use, the registration shall be cancelled and the license plate returned to the Police Depar[ment. SECTION 27-65. RESERVED. SECTION 27-66. GENERAL REGULATIONS. Every license issued hereunder shall be deemed to be granted subject to the following conditions: (A) State laws applicable. Every person propelling or riding a bicycle upon a public roadway shall be subject to the provisions of all ordinances and State laws aplicable to the operator of any vehicle, except those provisions with reference to equipment of vehicle and except those provisions which by their nature would have no application. (B) Reserved. (C) Bicycle riders to stay on right side of road. Every bicycle when operated on a highway shall be kept as close to the rigfi hand curb as possible. (D) Riding two (2) abreast prohibited. Every person when operating a bicycle upon a highway shall ride such bicycle in single file only and at no time shall bicycles be operated two (2) or more abreast. (E) Clinging to moving vehicles prohibited. It shall be unlawful for any person riding upon a bicycle to cling to or attach himself or his bicycle to any other moving vehicle upon a street or highway. (F) Passengers and towing. No bicycle shall be used to carry anyone other than the operator unless equipped with a child's carrier, in which case the following conditions and regulations shall be observed: (1) The operator shall be sixteen (16) years of age or older. (2) The passenger shall be under the age of seven (7) years and seated o¢ the child's carrier. (3) The child's seat shall be fastened securely to the bicycle and shall be located behind the operator's seat. (4) Only one (1) child's carrier shall be attached to a bicycle. In the case of a tendem bicycle, a child's carrier may be attached behind each operator. (5) A child's carrier may be used only after it has been inspected by the Police Department and found to comply with the provisions of this paragraph. An annual tag denoting such inspection and compliance shall be issued by the Police Department and shall be fastened to the child's seat attached to each bicycle. 6 For the ur ose of this Subsection, a child's carrier (or child'si t ( ) Y P seat) shall mean a seat manufactured and designed for the purpose of attaching to a bicycle and equipped with a safety belt, arm rest, back rest, foot rest and spoke protector, to be used by children under the age of seven (7) years. (7) The operator of a bicpcle shall not tow or draw any coaster, sled, person on roller skates, toy vehicle or any other similar vehicle. (G) Racing prohibited. No person operating a bicycle upon a public highway shall participate in any race or speed or endurance contests with any other vehicle. (H) Acrobatic riding prohibited. No rider of bicycle shall remove both hands from the handlebars, or feet from the pedals, or practice any acrobatic or fancy riding on any street. (I) Riders to observe traffic regulations. Every person operating a bicycle upon a public highway shall stop for a11 arterial highway and automatic traffic signals. (J) Turns and signals. No person shall turn a bicycle at an intersection unless the bicycle is in proper position upon the roadway, or turn to enter a private road or drivevay unless the bicycle is in proper position on the roadway as required, or otherwise turn a bicycle upon a roadway, unless and until such movement can be made with reasonable safety. In the event other traffic may be affected by such movement, no person shall so turn any bicycle without giving an appropriate signal in the manner provided. Such signal shall be given continuously during not less than the last one hundred (100) feet traveled by the bicycle before turning. When given by hand and arm, such signal� shall be given from the left side of the bicycle in the following manner and shall indicate as follows: (1) Left turn--Hand and arm extended horizontally. (2) Right turn--Hand and arm extended upward. (3) Stop or decrease speed--Aand and arm extended downward. (K) No parking on sidewalks. No such bicycle shall be parked in front of or adjacent to any commercial or industrial establishment unless the bicycle is marked on the sidewalk parallel.to the street and is properly fastened or chained to a municipal parking meter. There shall be no more than two (2) bicycles fastened to any single meter. (L) Display of license plate. Every bicycle when operated upon the roadway or highway shall have in conspicuous display on the rear of the bicycle under the rear of the seat or the saddle easily conspicuous to the rear, a license issued for that bicycle. Location of the license on any other part of the bicycle shall be termed a violation of this ordinance. (t� Every person while operating a bicycle on a one-way street shall operate said bicycle single file in the direction of the one-way traffic. SECTION 27-67. SUSPENSION AND REMOVAL. � The Chief of Police shall have authority to suspend the registration of and remove the license from any bicycle operated contrary to any State law or City ordinance, such suspension and removal to continue for a period not to exceed fourteen (14) days. Such suspension and removal shall be in addition to other penalties provided hereunder: SECTION 27-68. REQUIRED EQUIPMENT. (A) Lights required. Every bicycle operated upon the streets and public highways of the City between a half-hour after sunset and a half-hour before sunrise shall be equipped with a lamp firmly attached or affixed on the front of such vehicle, exhibiting a white light visible from a distance of at least five hundred (500) feet to the front, and with a lamp on the rear, exhibiting a red light visible from a distance of five hundred (500) feet [o the rear, except that a red reflector approved by the Industrial Commission of the State of Wisconsin may be used in lieu of a rear light. (B) Brakes required. Every bicycle when operated upon a highway shall be equipped with a brake adequate to control the movement of and to stop such vehicle whenever necessary. Such.brake shall be maintained in good working order at all times. (C) Horn or bell required. Every bicycle when operated upon a highway shall be equipped with a horn or bell in good working order, capable of emitting souad audible under normal conditions for a distance of not less than one hundred (100) feet, and it shall be unlawful for any bicycle to be equipped with a siren or whistle, or to use any such bell or horn othercaise than as a reasonable warning to other users of the highway. SECTION 27-69. INSPEC2ION OF BICYCLES. Every bicycle in the City shall be inspected and examined at the Police Department or any other location so designated by the Chief of Police for a serial numbere If such bicycle has no serial number, a serial number shall be stamped on the frame of such bicycle by any qualified mechanic of a bicycle store or shop so designated by the Police Department. SECTION 27-70. BICYCLE COURT. A bicycle Traffic Court shall be conducted as hereinafter provided; Any person violating any of the provisions of the preceding Section(s) shall, upon receiving a third bicycle violation, be ordered to attend the Bicycle Court to be held in the Police Chambers of the City Hall on each first and third Saturday morning of each month, at 9:30 A.M. The procedure and personnel of said Bicycle Court shall be prescribed by the Chief of Police and all bicycle violators under and up to the age of sixteen (16) years, shall be brought to this Court to be dealt with as hereinafter provided for third, fourth and fifth offenses. In the case of the third offense for any violators of this ordinance, the violator mus"C' attend a session of a Bicycle Violators School which the Chief of Police shall create, operate and manage. In the case of a fourth offenders of this ordinance, the. court may in its discretion, impound the bicycle of the offender or license, for a period of seven (7) or fourteen (14) days at the discretion of the court. Such impounding shall be done bythe Police Department and the storage of bicycles or license plates during the impounding period shall be handled by the Police Department. All fifth time violators shall be taken to a session of the Juvenile Court upon reco�endation of the Youth Aid Bureau. Violators of this ordinance will be notified by the Police Department when and where to report for disciplinary action herein described. SECTION 27-71. DEALER IN SECONDHAND BICYCLF.S; PURCHASE AND REPORTS. Every person engaged in the business of buying, selling, exchanging or trading in used or secondhand bicycles, and every person, firm or corporation engaged in the business of buying or selling new bicycles, and any person in the business of buying and selling of iron or used metal, shall make a monthly zeport to the Chief of Police of all used or secondhand parts of bicycles bought by each person, firm or corporation during the preceding thirty (30) days, on a form provided by the Police Department. Each such report shall specify a full and complete description of such used or secondhand bicycle parts, and in addition thereto, whenever available, the serial numbers, factory numbers, frame number, color, type, model, frame size, wheel size, name of brake and other marks of identification, the date of purchase or trade, together with the name, address, and age of the person or persons selling or trading such bicycle. It shall be unlawful for any person, firm, or corporation engaged in the business of buying secondhand bicycles to purchase any such secondhand bicycles from a minor under the age of eighteen (18) years of age. SECTION 27-72. PENALTY. (A) Any person who shall violate any of the provisions of this Article, except sections as herein provided, shall upon conviction thereof forfeit not more than Ten Dollars ($10.00) together with costs of prosecuti.on, and in default of payment of the forfeiture and costs of prosecution shall be imprisoned in the County Jail not to exceed ten (10) days. (B) Any person who shall violate any of the provisions of Section 27-66 (K) shall, upon conviction thereof, forfeit not more than Two Dollars ($2.00) together with the coste of prosecution, and in default of payment of the forfeiture and costs of prosecution shall be imprisoned in. the County 3ai1 not to exceed ten (10) days. (C) This penalty clause shall not apply to any minor under eighteen (18) years of age. Such minor may, however, be taken before the Suvenile Court for a violation of any of the provisions of this Article. SECTION 27-73. CROSSING BRIDGES. Vehicles approaching any bridge in the City shall, if the draw be unlocked or the lift in operation, stop before entering upon the bridge, and no such vehicle shall proceed over the bridge until the draw be again locked or the lift lowered and the safetp gates in such bzidge opened. No person operating any motox� vehicle sfiall pick up or discharge any passenger on any bridge in the City at any time. It shall be the duty of tfie Police Department to maintain a traffic signal at each entrance of each of such bridges; and anyone operating a vehicle other than in accordance with said signal, and with other provisions hereof, shall be deemed guilty of a violation of this Section. SECTION 27-74. PASSING ON BRIDG�S. No person while driving or operating any motor vehicle across any bridge within the City shall pass, except on the Oregon Street-Sackson Street Bridge, any other moto� vehicle preceding him upon such bridge and traveling in the same direction. Such person sfia11 remain behind the preceding vehicle until both vehicles have crossed the bridge. SECTION 27-75. SPEED LIMIT ON BRIDGES. It shall be unlawful to operate any vehicle upon any bridge, causeway, viaduct, or other similar structure at a speed which is greater than the maximum speed which can be maintained with safety thereon, when such structure is signposted as herein provided. It shall be the duty of the Chief of Police to conduct an investigation of a11 such bridges, causeways, viaducts, or other such structures in the City to determine the maximum speed of vehicles which such structures can withstand and to cause suitable signs, stating such speed to be erected and maintained. In no case shall such maximum speed exceed twenty-five (25) miles per hour. SECTION 27-76. PARKING NEAR BRIDGES PROHIBITED. No vehic2e shall park upon or within one hundred (100) feet of any draw-bridge within the City. ARTICLE X. RAILROAD REGULATIONS. SECTION 27-78. SPEED LIMITS. It shall be unlawful for any person to run any Iocomotive, engine, or car or cars on any railroad or railway within the limits of the City at a rate of speed higher than thirty (30) miles an hour. SECTION 27-79. MOVING CARS. It shall be unlawful for any railroad company, its officers or agents to operate or cause to be operated, propelled, pushed, bunted or otherwise, any car or cars across or upon any street in the City without having attached thereto a loco- motive. SECTION 27-80. OBSTRUCTING STREETS. � It shall be unlawful for any person or railroad company or any contractor, employee, agent or servant of any railroad company to obstruct any street, highway, sidewalk or alley or any part thereof in the Gity by leaving any engine, car or cars standing upon, within or across any street, highway, sidewalk or alley. SECTION 27-81. BELLS TO BE RUNG. It shall be the duty of every person operating any locomotive engine within the City to cause the bell on each such enginer to be constantly rung while running on any railroad track within the limits of the City. ARTICLE XI. ABANDONED, WRECKED, DISMANTLED OR DISCARDED VEHICLES. SECTION 27-82. DEFINITIONS. The following definitions shall apply in the interpretation and enforcement of this Article: (A) "Vehicle" shall mean a machine propelled by power other than human power designed to travel along the ground by use of wheels, treads, runners, or slides and transport persons or property or pull machinery and shall include, without limitation, automobile, truck, trailer, motorcycle, tractor, buggy, and wagon. (B) "Street or highway" shall mean the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. (C) "Property" shall mean any real property within the City which is not a street or highway. SECTION 27-83. VEHICLE ABANDOiVMENT PROHIBITED; REMOVAL; DISPOSAL. (A) No person shall leave unattended any motor vehicles, trailer, semi-trailer, or mobile home on any public highway or private or public property, for such time and under such circumstances as to cause the vehicle to reaonably appear to have been abandoned. Whenever any vehicle has been left unattended without the permission of the property owner for more than forty-eight (48) hours, the vehicle is deemed abandoned and constitutes a public nuisance. (B) Any cehicle in vinlation of this Sectipn shall be impounded until lawfully claimed or disposed of except that if the Chief of Police or his representative deterr�ines that the cost of towing and storage charges for the impoundment would exceed the value of the vehicle, the vehicle may be junked upon deternination by the Chief of Police that the vehicle is not wanted for evideace or other reason. ._ , % � (C) Any police officer, who discovers any motor vehicle, trailer, semi-trailer, or mobile home on any public high�aay or private or public property which has been abandoned shall cuase the vehicle to Ue removed to a suitable place of impoundment. Upon removal of the vehicle the officer shall notify the Chief of Police of the abandonment and of the location of the impounded vehicle. (D) The owner of any abandoned vehicle except a stolen vehicle is responsible for the abandonment and all costs of impounding and disposing of the vehicle. Costs not recovered from the sale of the vehicle may be recovered in a civil action by the municipality against the owner. (E) Any abandoned vehicle which is determined by the Chief of Police or his designa[ed representative to have a value in excess of One Hundred Dollars ($100.00) shall be retained in storage for a period of fourteen (14) days after certified mail notice has been sent to the owner and leinholders of record to permit reclamation of the vehicle after payment of accrued charges. Thereafter the City may dispose of the vehicle by sale as provided by this Code. (F) Any abandoned vehicle which is determined to have a value of less than One Hundred Dollars ($100.00) may be disposed of by direct sale to a licensed salvage dealer upon determination that the vehicle is not reported stolen. (G) Within five (5) days after the sale or disposal of a vehicle, the City shall advise the division of the sale or disposition on form supplied by the division. (H) Any person abandoning a vehicle in the City shall pay the cost of impounding and disposing of the vehicle and shall further be liable to a fine of not less than Ten Dollars ($10.00) nor more than Ztao Hundred Dollars ($200.00). SECTION 27-84. LEAVING OF WRECKED, NON-OPERATING VEHICLE ON STREET. No person shall leave any partially dismantled, non-operating, wrecked, or junked vehicle on any street or highway within the City. . SECTION 27-85. DISPOSZTION OF WRECKED OR DISCARDED VEHICLES. No person in charge or control of any property within the City, whether as owner, tenant, occupant, lessee, or other�aise, shall allow any partially dis- mantled, non-operating, wrecked, junked� or discarded vehicle to remain on such property longer than three (3) days; and nn person shall leave any such vehicle on any property within the City for a longer time than three (3) days; except that this Article shall not apply with regard to a vehicle in an enclosed building; a vehicle on the premises of a business enterprise operated in a lawful place and manner, when necessary to the operation of such business enter- prise; or a vehicie in an appropriate storage place or depository maintained in a lawful place and manner by the City. ARTICLE XII. PENALTIES. � SECTION 27-86. PENALTIES. (A) Any violation of any of the provisions of Article X shall subject the violator to a fine of not less than Fi.ve ($5.00) Dollars nor more than twenty-five ($25.00) Dollars for each offense, together with the costs of prosecution, and in default thereof, to imprisonment in the County Jail until such fine and costs are paid, not exceeding thirty (30) days. (B) Every person convicted of a violation of any of the provisions of the following enumerated Sections or parts of Sections of this Chapter shall for each offense, be punished by the fines as set forth, together with the costs of prosecution; and in default of payment of such fines and costs, by imprisonment in the County Jail for Winnebago County for the terms here- inafter stated: (1) A fine of not less than One ($1.00) Dollar nor more than Five ($5.00) Dollars for a violation of Article III. (2) A fine of not more than Ten ($10.00) Dollars, and in default of pay- ment thereof, imprisonment for not exceeding ten (10) days for a violation of Article VII L (3) A fine of not more than Twenty-five ($25.00) Dollars, and in default of payment thereof, imprisonment for not exceeding fifteen (15) days for a violation of any of the following: Article II (4) A fine of not more than Fifty ($50.00) Dollars, and in default of payment thereof, imprisonment for not exceeding thirty (30) days f.or a violatin of any of the following: Article V(with the exception of Section 27-39). (5) A fine of not less than Twenty-five ($25.00) Dollars nor more than Fifty ($50.00) Dollars, and in default of payment thereof imprisonment for not exceeding thirty (30) days for a violation of the follocoing: Section 27-27(b)(3). (6) A fine of not less than Ten ($10.00) Dollars nor more than Ttoo Hundred ($200.tl0) Dollars, and in default of. payment thereof imprisonment for not exceeding ninety (90) days for a violation of the following: Section 27-8(b).
