SUHiSITTED BY � - 21 - —. - -_____.._ .._. ____.. _ __ � \ P, � Il . , y ,/� AGREEMENT QETWEEN TH@ CITY OF OSHKOSH AND THE CATHOLIC CEMETERY ASSOClATION 0� OSHKOSN .: �.; :;-:. � ,- WHEREAS, the Catholic Cemetery Association of Oshkosh presently orrns and operates Calvary Cemetery and Riverside Catholic Cemetery, both cemeteries being within the City of Oshkosh, Wisconsin, and WHEREAS, the Catholic Cemetery Association of OshEcosh desires to have the City of Osfikosh assume maintenance of the cemeteries and atso related duties, and WHEREAS, the City of Oshkosh desires to assume the maintenance and related duties of the aforementioned cemeteries in return for a monetary reimbursement. NOW, THEREF�RE, IT l5 HEREBY AGREEQ between the City of Oshkosh, a municipai corporation located in Winnebago County, Wisconsin, hereinafter talled "City," and the CaLholic Ceme.tery Association of Oshkash, Oshkosh, Wisconsin, hereinafYer called "7he Catholic Association," as follows: A. The City of Oshkosh agrees Yo provide the following services on the aforementioned Calvary Cemetery and Riverside Catholic Cemetery: 1. 2. � 4. iurf maintenance commonly associated wPth a cemetery including � eutting, sodding, irrigation, weed conYrol, and trimming. Snow removal on cemetery roads used for f uneral services. Locating, spotting, and establishing.the praper locations for ;mmediate internments and tfieir corresponding markers. Labor for the repair of irrigatior, iines and valves. The cost of needed supplies and materials wi}1 be bi)led at City cost to the Catholic Association, 5. Equipment and related expenses such as gasoline, oit, and labor � 7• used in normal turf maintenance functions. An office will be provided to thz Catholic Cemetery Assaciation, such to be approximately 9 X 12' and to be located in the building commonly referred to as the Riverside Chapel. Such office shall be provided with adequate heat, lights, and related utilities. The Catholic Association may requ�st that the City of Oshkosh . conduct.internmenC services at the approved rate schedulc��nd that the City invoice the appropriate requesting party, and the ,:. �. . . . , ��.. The City of Oshkosh will not show, locate, or propose.information for tot sales or for similar purposes. B. The Catholic Association will pay to tfie City of Oshkosh the amount of $16,800.00, such payments to be made in quarterly instal)m>nts, payable by the 15th of the months deemed to be appropriate by the Department of Administration of the Lity of Osfikosh, and payments to be made at the Department of Administration, City Hall, 215 Church Avenue, Oshkosh, Wisconsin. C. The Catholic.Association shall transfer t,itle and Possession of the following equipment to the City of Oshko5h: six (6) Bobcat trimming mowers and one (1) Bolens riding tractor. D. The Catholic Association and the Director of Parks of the City of Oshkosh or his designee witl cooperate �aith each other in the use, operation, security, and hours of operation or similar matters with regard to the cemeteries, in order to protect, maintain, and to secure the physical,components located within the cemetery and to provide proper service within the cemetery. However. the decision of the City of Oshkosh will be final whenever a co.nflict arises. The Catholic Association agrees to provide proper supervision of the offices to be rented. by it and to use all reasonable efforts to prever.t vandalism or damage to City property, and the Association agrees to leave any premises occupied by � them at the end of the year in good condition at the�termination of this agree- ment. E. The Catholic Association will be responsible for any/and all cemetery related activities.including but not limited to the selling of lots, publishing and advertising, record keeping, invoicing, coltection of fees, tree care, the maintenance of physical facilities such as buildings, and any other duties or activities. - F. The Catho}ic Cemetery Association of Oshkosh hereby releases the City of Oshkosh from a11 deSts, claims, demands, d;mages, actions and causes of action arhatsoever which may resuit from the aforementioned activities, and the Catholic Cemetery Association of Oshkosh agrees to hold the City of Oshkosh free and harmless from any c}aim for damages which may be made by reason of Bamages h or injury to persons or property connected therewith. . ; ---n,.,�...- �, --- �,__,_ - -----�---- --------- - ��_____ - � G. This agreement and its terms shalt expire on December 31, 1980.
