Terms and Co�ditionf
1. When Federal Funds are invoived in the improvfinent, the initiation and accompfishment of the improrement will be subject
to the applicabVe Federal Aid tii9hway Acts and Regulations of the Federal Highway Administration, U.S. Depsrtment of Transportation.
2. The Municipality witl contribute and pay to the State all cost incurred by the State in connection vnth the improvement which
is not eiiglble for State and/or Federal fund financing. .
3. Federal aid and/or State highway tund tinancir.g will be timited 40 75 perc¢nt (�o) participation in the tonshuttion �
costs of tbe following items: (State tunds lim:ted to State trunk highway routes and connecting streets.J -
(a) The pavement, base, curb and gutter, together with atl grading.
(b) Catch Dasins and inlets for surface water drainage of the improvement, with connxtions to thestorm sewer main.
(c) Construction engioeering incident to inspect�on and supervision oi aduai comtruction wprk.

4_ Work necessary to complete tbe improvement to be financed entireiy by the Municipality or other ut3ity or facility owner

(a) New installatio+n ot or alteration of sanitary sewers and connections, water, gas, etectric, telepbone, teiegraph, tire or
pclice ala�m facilities, parkin9 meters, and similar utilities. . � -

(a) Place and maintain signt and markers for app�oved detours ot state trunk routes.
(b) Finance Statdexpenses of puroly an adminis[rotivenature.
(c) Condii�on, it required, and ma4ntain the portions ot approved detours loca.ed on highways whicM1 are maintained by
the State. �
7. The work on Orojecb, insofar as that eligibie for State and/o� Federal partitipation is concerned, wi�l be performed under
contracts �et and atlministerod by the State and under its supervision_ Such contract5 may also indud? items of work oot eligible
foi Federai or State par=icipation which are consideied nscessary to complete the project.
Work to be pertormet3 by tbs Municipality without Fe0eral aiA o� State highway fund participation, ne[zswry to insure a com-
plete improvement acceptable to tne Federo Highway Administration and/or the State, may be tlone in a mannw at the election of
tne Munfcipality but must be coordinated with the work und^rtaken by the State. �
T�e tunds to be provided by the Murtitipality (exceRt tor wo�k performed by the Municipality) wiil De cleposited with the
S:ate. The autnoiity for the Munlcipality to provlde funds for Wcn impruvements and tc zn.e� mto ayreemmiswith thz State is ex-
tended by Section 86.25(IJ, (2j, and (3) of the Statutes. -

Betore execution of a contract for the work, the Municipality, upon request of the State, wili deposit u�4th the State funds in
an amount ESTIM ATED by the State to detray all necessary costs incident to the project which are not cbarqeabte to Federai or
State Highway lunds. Shouid the Municipality decling to make the required deposit, it is understood that no cuntract tor the exe•
cution of the work wiil be entered into and disposition of the project wili be the s�bject of Turther neqoti�tions bxtwee� the Muni-
cipality and State. ti the Munitipality shou�d withdraw the project, it will pay to the State any cost that hasbeen incurred by the
State in behalf ot the pioject.
Upon comptetion of consbuction, a finai audit will be made to determine the final division of costs of the p�oject. .
8. The District Offica o1 the Division ot Highways will coope�ate with and advise the Municipality dur"�ng the survey and pian
deveiopment phase. The cost of any survey, plan, and preconst.uction engineering undertakan by the State, oiher than administra-
tive e�penses, wili be charged to the Municipafity.
It is understood tbat, upon comptetion of the plans and prior to�the execution of the contract tor thewcrk, the pioject will be
wbject to further agreement between the Municipaiity and the State with respect to the detaii of design, approval of plans, and if
Fetleral aid is to be used, certaln requfrements to satisfy the Drrnisions of the Fedeial Aid Highway Act and tfie regulations issued
pursuant tne.eto. It is further agreed by the Municipality that:
(a) It will maintain, at it3 own cost and expense, all portions of the project that lie within�its jurisdicfion }or such main-
tenance throuqb statutory requirements, in a manner satisfactory to the State or the Federal Highway AdmirKSiration or both, or
their authorized representatives, and will make ample provi;ion for such maintenance each year.
(bj Ii will keep records af cost of construction, inspection, tests, and maintenance done by it as w�ll enabte the� State .
to report, upon request ot the Federal Highway Administration, the amount and nature of the expenditura ior lhese purposes; that
the accounts and rewrds of such expenditures, together with all supporting dowment, v II be kept open at aA times to inspection
by authorized representatives of tbe Federal Mighway Administration; and that it will furnish copies tfiereot»t�en requested.
(�) All signs and tratfic control devices and otber protectire strudures erected on or in connec£wn with �ne projett,
including such of these as are instailed at ihe sole cost and expense of the Municipality or by others, wilf be iwconformity with such
manual of uniform traftic control devices as may be adopted by the American Assxiation of State Highwaymd Transportation oiti-
cials, approved by the State, and concurred in by the Federa) Highway Administration. .
(d) The right of way avaitable or prwided for the project will be held and maintained inviotate for public hi9hway or street
purposes. Thoze signs D�ohibited under Federal aid highway regulations, posters, billboards, roadside Stand; or other private instaila-
tions prohibited by Federal or State bigbway regulations,will not be permitted within the right of way limitsof the projed. The Mun-
icfpatity, within its jurisdictionaf limits, will remove or cause to be removed from ihe ri9ht oT way ot the pro"pxt ail private installations
of wfiatever nature which may be or cause an obstruction or interfere with the free flow of tratfic, or wFiich may be or cause a hazard
to traffit, or whith impair the asefWness of the project and all other encroachments whicb may be �equiredto be removed 6y the State
at its own election or at the request of the Federal Highway Administration, and ihat no such private instaliations wili be permitted to
be erected or maintained in the future. � � - � - — - ... �

annountement to ttx press and such outlets as would generolly alert the affected property owners and the community oY the naturc,
extent, and timing of the project and arrangements for handling traftic within anA arountl the projech.
(b) It wiil comply witb ali applicable provisions ot the Wiscorsin Action Plan. `-�--
-(i) When the acquisition of right of way is to be tinanced eitT�er in whole or in part with Federa� funds,wch purchases or atquis-
itioni will comply witb the provisions of Titles I1 and itl of the Unitorm Reiocation Assistance antl Reab Pra�erty Acpuisition Policies
Act ol 1970 (42 U.S.C. 4603 et seq.) as may be�ame�ded from time to time, and the requirements sef tortfi inSection Il of the State's
Minimum Right of Way Requirements for Federai Aid Urban Systems & TOPICS Projects of July 19T3 as rvy be amended from tlmr
to time. � � '
(j) When the acquisition of r'�ght of way is to be financed by tM1e Municipaiity or other utility orfatilityowner, such purchases
or acquisitiom will comply with the provisions of Titles fI antl III of the Vniform Retocation Assistance andReal Property Acquisition
Poficies Act o1 197D (42 U.S.C_ 4601 et seq.) as may be amended from time to time, Tiile V 1 ot the Civil Ri¢ets Ac1 of 1964, and the
requirements as set forth in Seetion 1 ot the State's Minimum Right of Way Requirements for Federal Aid l}rban System & TOPICS
Projects ot January 1974 as mry be amended from time to time, or the requirements as set -forth in Section ! of the State's Minimum
