The proposed annexation is contiguous to the city and does not create any islands of town land, so there appears to be no legal barrier to the annexation. With respect to the size and shape of the territory, I find that the common boundary of the territory with the city is relatively short for the area proposed to be annexed. I would recommend extending the common boundary north to C.T.H. "J" and south to the intersection of the existing city limits with the center line of Jackson Street. Further, I would recommend including all of the land on the south side of C.T.H. "J" between Jackson and Vinland in the proposed annexation. It seems more rational to me to include all of the subdivided land in the annexation. The direct street access would appear to make the provision of city services simpler as well. I trust the above comments will meet your needs. It is not the intent of either of our clients to attempt to control the res3dence of any of the petitioners. We clearly recognize that if one prefers a City residence to a Town residence that preference should be honored where possible. Our concern is of a much differen[ nature, and it goes to the central issue of the planning function and harmonious integration of town and city development. The background may not be entirely familiar to a11 of the Council members or Planning Commission members. Therefore perhaps a summary is in order. In 1969 the City of Oshkosh was attempting to arrange �inancing for the sewage treatment plant and northside interceptor which vere to be constructed. Certain State and Federal aids were made available to the City on the pren�se that a portion of the design capacity of. both installations would be rzserved to a service area occupied by the Town of Oshkosh Sanitary District. I3either Che Town nor the City were entirely happy with the conditions which were prescriSed by the Department of Natural Resources. Thereafter maximum State and Federal aids were made available to the Cit� for your construction. Becac�� oi the geooraphical configuration of the Sanitary District and the topo�raphy of the Township, all of our planning consistently has required th� �onstrcc:iea of a line on Snell Road. This has been necessarv to reach Jac-_son Heights and Olson Acres as these areas l�ave been included in the District from time to tir:ie. It is generally acknocaledged that sanitary systems in that area have begun to fail. Some caells also are reported to have failed. Previous annexations of service area, in the Northside Industrial Park, have not been objected to. This is because service to those areas was vital to the best interests of the entire community at the time. Further, such service did not threaten the planning under development in the Town of Oshkosh. The Olson Acres annexation is quite a different thing. If the City cvill provide sewer service to Olson Avenue, it becomes extremely expensi_ve for the Tow�n to contemplate service of Snell Road residents. It also becomes apparent that Jackson Heights and other developing areas in the center of the Town may oecome prohibitively expensive for town service. Yet these same areas also na� not be within your present or future plans. It is coasidered that an annexation of Olson Acres does great violence to the abiii*_, of the Township to plan for the public welfare of the rest ofits reai�arts. Literally hundreds of thousands of dollars of engineering may be rend=red obsolete, even while the taxpayers of the Sanitary Distri.ct are only just beginning to make payment on them. We ask you to bear in mind all of these consequences on city-town relationships when you decide on the matter of the Olson Acres annexation. It is not s�:ply another piece of land.
