HomeMy WebLinkAbout30611 / 80-09� ;;arch. 6, 1980 II 9 RF.SOLUTION PURPOSE: INITIAL RESOLUTION - CONCRETE PAVING INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.60 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following named streets, said public improvement to include the following: COPiCF.ETE °;VIPIG BOWEN STREET from Murdock Avenue to Harrison Street 2. Sai.d improvements shall consist of concrete paving as described above and appurtenant work with concrete curb and gutter on both sides of the street at a grade lieretofore established by special ordinance of the City of Oshkosh. 3. Before such improvements are made, the Board of Public Works is directed to cause water and sewer service pipes to be laid in said streets from the mains to the curb line of each lot fronting on the said streets and to keep an accurate account of the expense incurred in front of each lot and report the same to the Comptroller who shall cause the amount charged to each lot to be entered on the tax roll as a special tax against said road, provided, however, that the�Board of Public Works shall not cause such laterals to be so laid for any particu2ar lot, or parcel where, in the opinion of the Board of Public Works, it would be impractical to do so. 4. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said ir�provements. 5. The assess�ents against any parcel may be paid according to the provisions of Section 25-83 thru 25-89 of the Oshkosh M,unicipal Code. 6. The Board of Public Works is directed to prepare a report consisti.ng of: (a) Final plans and specifications for said improvemeats. (b) An estimate of the entire cost of the improvements and laterals. (c) An estimate as to each parcel of property within the assessment district of: (i) The assessment of benefits to be levied (2) The damages to be awarded for property improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inapection. 7. Upon receiving the report of the Board of Puhlic Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.60 (7) of the Wisconsin Statutes. Tne hearing shall be held by the Board of Public Works at the Council Chambers in the City Hall at a time set by the Clerk in accordance with Section 66.60 (7) of the Wisconsin Statutes. 8. The Wisconsin Public Service Corpoiation of Oshkosh, Wisconsin, is hereby required to install gas mains in said street and service laterals at such intervals as the Board of Public Works ahall direct, said work to be completed prior to the improvement of the said street, the City Clerk shall forward a certified copy of this resolution to said corporation forthwith. �. The Board of Public Warks and the proper city officials shall do all things necessary so as to complete the installation of storm sewers in said street prior to the improvements thereof, if necessary. 10. The installation o£ said street improvements shall be accomplished according to the provisions of Section 25-3 thru 25-11 of the Oahkosh Municipal Code.
