�� 11 RESOLUTION
PURPOSE: INITIAL RESOLUTION - ASPHALTIC CONCRETE PAVING
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City oi Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its power
under Sect±on 66.60 of the Wisconsin Statutes to levy special assessments upon
property within the following described areas for benefits conferred upon siich
property by improving ihe following named streets, said public improvement to
incl:;de the f�llowing:
ASPHAI,TIC CONCRETE PA�'ING
Asphaltic Concrete Paviny, With New Curb and Gutter
EI.M4+OOD AVF,[vUE - from 4Test A'ew York Avenue to Congress Avenue
WEST EIGHTH AVENUE - From Rugby Street to Knapp Street
COU?tT STREET - East side, from Waugoo Avenue to Washington Avenue
Asphaltic Concrete Overlay, Single-pass Operation
With Curb and Gutter Repair
WEST EIGHTH AVENUE - from Ohio Street to Rugby Street
COURT STREET - From Ceape Avenue to Waugoo Avenue
CGURT STFEET - West side, from Waugoo Avenue to Washington Avenue
WOODIYqND AVE2vJE - from High Avenue to Cherry Street
HIGH AVE':UF - from Wisconsin Straet to Congress Avenue
2. Said public improvement sha11 consist oF asphaltic resurfacing, as
described above and apcurtenant work with concrete curb and gutter where required,
at a grade heretofore established by special ordinance of the City of Oshkosh.
3. Before such .i.r.iprovements are eiade, the Roard of Public Works is directed
to cause water and 'sewer ser..ice pipes to be laid in said streets from the mains
to the curb line of each lot fronting on the said streets and to keep an accurate
account of the expense incurred in front of each lot and report the same to the
Comptroller who shall cause the amount charged to each lot to be entered on the
tax roll as a special tax a�ainst said roau, provided, however, that the Bo2rd
of Public Works shall not cause such laterals to be so laid for any particular
lot, or pa.cel where, in tha opinion o: the Board of Public works, it wrould be
impractical to do so.
4. The total amount assesse3 against such district shall not exceed the
total cost of tiie improvements and the amount assessed a�ainst any parcel shall
not be greater than the benefits accrued thcreto from said improvements.

5. The assessments against any parcel may be paid according to the
provisions of Section 25-83 thru 25-89 of the Oshkosh Municipal Code.

6. The Board of Public Works is directed to prepare a report consisting
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the improvements and laterals.
(c) An estimate as to eacn parcel of property within the assessment district
of:
(1) The assessment of benefits to be levied for each improvement.
(2) The damages to be awarded for property taken or damages by each
improvement. �
(3) The net amount of benefits over damages or of damages over benefits
for each i.nprovecient.
Upon completion of such repart, the Board of Public Works is directed to
file a copy thereof in the City C1erk's Offlce for public inspection.
7. L'pon receivir,g the report of the Euard of Yublic idorks, the City Clerk
is directed to give notice of a public hearing on such reports as specified in
Section 66.60 (7) of the Wisconsin Statutes. Ttie hearing shall be held by the
Board of Public Works at the Council Chambers in the City Hall at a time set by
the Clerk in accordance with Section 66.60 (7) of the Wisconsin Statutes.
8. The Wisconsin Publir_ Service Corporation of Oshkosh, Wisconsin, is
hereby requir.ed to i.nstall gas szins in said street and service laterals at such
intervals as the Board of Public Works shall direct, said work to be completed
prior tc the improvement of the said street, the City Clerk shall forward a
certif3ed copy of this resolution to said corporation forthwith.
9. The Board of Public Works and the proper city officials shall do all
things necessary so as to complete the installation of storm sewers in said
street prior to the improvements thereof, if necessary.
10. The installation of said street improvements shall be accompllshed
according to the provisions of Section 25-3 thru 25-ll of tite Oshkosh Municipal
Code.
