STREET TREE PLANTING POLICY
PURPOSE

The policies hereto set betow are intended to:
1) estabiish a fair, equitable, and comprehensive plan for the purpose
of planting trees.
2) methodology to clearly define the responsibi)ity of the property
owner and City.
II. LOCATION
e) The area for planting trees shall be limited to the land commonly
referred to as "terrace", or the designated street right-of way
tvhich is not used for street purposes. The terrace may also be
defined as the area between the curb (or proposed curb) and side-
walk or (proposed sidewalk). ►f the residents of a p,�;ticutar
street in a residentally zoned area wherein there is an absence
or insufficient width for planting purposes, trees may then be
planted on private pcoperty. in the area facing the public street
in a planting manner similar if a terrace existed but in no case
more than ten feet from the property line. An appropriate legal
agreement or easement must be prepared prior to planting to
clearly define appropriate legal responsibilities.
���• METHODOLOGY
For residential streets:
Any resident shail, at least three months prior to the designated
planting date, submit an official tree petition, supp�ied by the
City, with the signature and address of the residents residing on
the same street as the tree petition originated. The petition should
contain a majority of residents in order that tfie ptanting clearly
makes a significant impact on the immediate environment.

The petition wiii be evaluated by the City Administration using the

Those petitions for streets, without p)anting restrictions, without
existing trees, and containing more than 75°G of the homeoo-m er's signatures
will receive priority.
SELECTION AND PLANTIDJG
After consideration of the petitions and in conjunction with funding
limitations, the City will determine tfie needed number of trees. After
purchase, the City wi11 proceed to plant the trees in consideration with
the original petitioners reque=_t, rese;ving the right to de[ermine numbers,
species, and spacing in order to create a complete terrace planting and
neighborhood beautification project.
PAYMENT
After the planting is completed, the Director of Parks will submit a list
of ali addresses together with the number of planted trees for invoicing
to the Departm=nt of Administration. The City will charge only the cost
of the price of the tree. Labor and administrative expenses will be borne
by the Departmznt. Invoices tviii be payable upon receipt, and the collected
funds deposited into the street tree fund.
REPLqCEMENT
The City's responsibility will include: tree selection, purchase, number
and placement, planting, initial o-iatering, and subsequent pruning. The
resident in front of the property the tree (s) is planted is responsible
for subsequent watering and care. If the tree dies by June 30 in the
spring in the same year or, in the case oF. a fall planting, the previous
year, the City Administration will examine the circumstances and render
a decision for replacem=nt. It is expressly the responsibility of the
home owner to notify the Departmeni on or before that date io be eligible
for replacement. If in the opinion of the Department the demise of the
plant is due to natural causes�not including lack of moisture�the City
will replace the plant one time at no charge.
CITY RIGHTS
The City Administration reserves the right to plant, repiace, or transplant
terrace trees o-iithout charge to the homeowner in the event of disease,
vehicular damage, vandalism, or incomplete previous tree plantings. Complete
documentation for such requests should be accompanied by police reports�
official requests, etc.
IX. SPECIAL PROVISIONS

In the event that funding for street trees originates from a program
which has specific parameters, then specia) provisions must apply
and the forgoing policies are waived. For example, if Community
Development Block Funds are utilized the question of payment, ease-
ments, costs, and guarantees, will vary dep�nding upon the program's
requirements
