PURPOSE:
1119 RESOLUTION
INITIAL RESOLUTION FOR SANITARY SE[dER, WATER MAIN, GRADING
AND GRAVELING, AND HZGH TYPE STREET IMPROVE.`�IENT
INITIATED BY: DEPART�fENT OF PUBLIC WORKS
BE IT RESOLVED by the Comr�on Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its power
under Ser_tion 66.60 of the Wisconsin Statutes to levy special assessm2nts upon
property within the following described areas for benefits conferred upon such
property by improving the following named streets, said public improvement to
include the Eollowing:
SANITARY SEWER, WATER M.4IN, GRADING AND GRAVELING
AND HIGH TYPE STRiET L`IPROV�IENT
CLIFFVIEW DRIVE — from 670' north of Murdock Avenue to 1290' north of
Murdock Avenue
2. Said public icaprovement sha11 include the grading of the above namPd
street to the grade hereafter established by special ordinance of the City of
Oshkosh.
3. Before such improvements are made, the Board of Public Works is
directed to cause water and sewer service pipes to be laid in said streets from
the mains to the curb line of each 1ot fronting on the said streets and to keep
an accurate account of the expensr incurred in front of each lot and report the
same to the Comptroller who shall cause the amount charoed to each lot to be
entered o❑ the tax roll as a special tax against said road, provided, however,
that the Eoard of Public Works shall not cause such laterals to be so laid for
any particular lot, or parcel where, in the opinion of the Board of Public
Works, it would be impractical to do so.
4. The total amount assessed against such district shall not exceed the
total cost of the improvements and the amount assesse3 against any parcel shall
not be greater thaa the benefits accrued thereto from said improvements.
5. The assessments against any parcel may be paid accordino to the
provisions of Section 25-83 thru 25-89 of the Oshkosh Municipal Code.
6. The'Board of Public Wor'�cs is directed to prepare a report consisting
of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of. the improvements and laterals.
(c) An e�;timate as to each parcel of propzrty within the assessment
district of:
(1) The assessment of benefits ta be levied foc each improvement.
(2) The dama�es to be awarded for property taken or damages by each
improvement.
(3) The net amount of benefits over damages or of damages over
benefits for each unprovement.
Upon completion of such report, the Board o£ Public Works is directed to
file a copy thereof in the City C1erk's OYfice for public inspection.
7. Upon receiving the report of the Board of Public Works, the City Clerk
is directed to give notice of a public hearing on such reports as specified in
Section 66.60 (7) of the ldisconsin Statutes. The hearing sha11 be held by the
Board of PubLic Works at the Council Chambers in the City ilall at a time set by
the C1FrY in ?ccordance uith Sectic�.56.60 (7) of the �isconsin Statutes.
8. The jdisconsin Public Service Corporation of Oshkosh, Wisconein, is
hereby required to install gas mains in said street and service laterals at such
ir.tervals as the Board of Public Works sha11 direct, said work to be completed
p:ior t� the improvement of the said street, the City Clerk shall fozward a
certified copy of this resolution to sai3 corporation forthwith.
9. The Board o£ Public Wor'�s and the proper city officials shall do all
thinos necessary so as to complete the installation of stonn sewers in said
street pri.or to the iaprovements thereof, if necessary.
10. The installation of said street improvements shall be accomplished
according to the provisions of Section 25-3 thru 25-11 of the Oshkosh Municipal
Code.
