CODE PERTAINING TO THE CREATIQN OF A LiND�IARRS GOC4SISSION. The Common Council of the City of Oshkosh do ordai.n as follows: SECTION 1. That �ection 2-113.2 oF the Oshkosh Muncipal Code pertaining to L5e "Land;nar'�s Cammission" is hereby created to read as follows: SECTION 2-113.2 LAND�iSP.RKS COhu`fLSSION There is hereby created a Landmarks Commission, the "Commission," with powers, duties, and quali the following subsectiocis: a. The Director of Corianunity Dev- elopment or his designee sha11 serve as coordinator for the ComJnission. b. Except for the initial terms, the citizen members shall serve three (3) year terms. The Landmarks Commission sha11 saEeguard and foster civic pride in the City's historic and cultural heritage as embodied and reflecte� in landmarks and historic districts. SECTION 2. BY AL'?;*.OV'i'.D � - 6a - �- Va1ue of Landmarks Commission Ordi,nance By passing an empowered to construction, demolition of education, to preservation ordinance a community can create a landmarks commission designate landmarks and historic district; to regulate restoration, and exterior alteration; to regulate designated landmarks; to prepare programs for public draw up preservation plans, and to promote local historic in general. A landmarks commission ordinance could contain all or some of the following provision: (1) a sCatement of purpose; (2) definitions of terms used in the ordinance; (3) regulations determining the makeup and length of office of inembers of the con¢nission; (4) the powers and duties of the commission; (5) criteria and procedures for designating landmarks; (6) procedures for regulating exterior alterations to designated properties; (7) provisions for recognition and marking of landmarks; (8) criteria and procedures for designation of historic district; (9) summary of other powers and duties, and (10) methods of enforcement. One of the chief tasks of the co�nission is to decide which historic sites, structures, and districts are of sufficient significance to be c.lassified as landmarks. Obviously the community survey is invaluable in making the determination. The commission may be empowered to designate landmarks directly, using the criteria specified in the ordinance - after proper notice has been given to the property owner and the public, and following a public hearing. Or the co�non council may designate individual landmarls on the basis of recommendations made by the coumiission. The power to designate historic districts is usually left to the common council, with the commission having an advisory role. Purpose and intent of a Landmarks Commission it is hereby declared a matter of pubiic policv that the protection, enhancemant, perpetuation and use ot improvements of special character or special historical interest or value is a public necessity and is required in the interest of health, prosperity, safety and welfare of the people. The purpose of this section is to: A. Effect and accomplish the protection, enhancement, and perpetuation of such improvements and of districts which represent or reflect elements of the City's cultural, social, economic, political and architectural history. B. Safequard the City's historic and cultural heritage, as embodied and reflected in such landmarks and historic districts. C. Stabilize and improve property values. D. Foster civic pride in the beauty and noble accomplishments of the past. E. Protect and enhance the City's attractions to residents, tourists and visitors, and serve as a support and sCimulus to business and industry. F. Strengthy�the economy of the City. J1y�1� � ,���� � N°'Q J� 'i Landmarks Commission Composition A I.andmarks Commission is herby created, consisti_ne of seven (7) members. Uf the membership, one shall be a registered architect; one shall be a historian qualified in the field of historic preservation; one sha11 be a licensed real estate broker; one shall be an alderman; and three shall be citizen members. Each member sha11 have, to the highest extent practicable, a known interest in landmarks preservation. The Mayor shall appoint the commissioners subject to confirmation by the Common Council. Of the initial members so appointed, two shall serve a term of one year, two sha11 serve a term of two years, and three shall serve a term of three years. Thereafter, the term for each member shall be three years.
