BE IT P.:S�LVEC F,y �he Conru�n Council of the City oi' Oshkosh as follows:
1. The Conenon Council hereby declares its intention to exercise its
power under Section 66.60 of the Wisconsin Statutes to levy special assessments upon
property within the following, described area for benefits conferred upon such
property by improving the following named streets, said public improvement
to include the following:
GRADING AND GRAVE�IG
1.) West 35th Avenue fY�om Oregon Street to Marvel Drive
2, Said nublic improvement shall include the followino: �dir� and
g�avelir� for t'�e following described streets,
GRADING A.Iv�J GRAVF.I,ING
1,) West 35th Avenue from Oregon Street to Marvel Drive
3. Before such improvements are made, the Board of Pub7_ic Works is dire�ted
to cause water and sewer service pines to be laid in said streets from the mains to
tne c.urb line o` each lot fronting on the said streets and to keep an accurate account
of the expens� incLU�ed in fY�ont of each lot and report the sair�e to the Comptrolle:
who shaZl cawe the amount charged to each lot to be entered on the tax roll as a
special tax �inst said road, provlded, however, that the Board of Public Florks shall
not cause such laterals to be so laid Por any p8.rticular lot, or parcel tiahere, in
the opinion of ,he Bo�rd of Public Works, it would be impractical to do so.
4, �e ��tal amount assessed ap,inst such district shall not exceed the
total cost of t:^.e improvements and amoimt assessea against ar�y parcel shall not be
greater than the ber.eYits accrued thereto from said improvements.
5. Zhe assessments ag�ainst any parcel may be paid according to the prov3sions
of Section 25-83 thru 25-89 of the Oshkosh Aiunicipal Code.
6. The Boarcl of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.

(b) An estink2te of the entire cost of the irr�rovements.
(c) An estim�,te as to each parce] of prcperty within the assessn�ent
district of;
' (1) 7he assessment of benefits to be levied for each irr�provement.
(2) `Jhe dama�e5 to be awarded for prooerty taken or danages by
each im�provement.
(3) �e net arnount of benefits over damages or of damages over
b2nefits for each improvement.
Upon completion of such report, the Eoard of Riblie Works is directed to file a
copy thereof in the City Clerk's Office for public inspection.
7. L'z?nn receiving the report of the Board of Publie Works, the City Clerk
is directed �:� give notice of a public hearing on such reports as specified in
Seccion E6,bG (7) of the Wisconsin Statiztes. The hearing shall be held by the
i�;sd of Publyc Works at the Council Chambers 3n the City Aall at a tin�e set by
thA Clerk in accordance with Section 66.60 (7� of the W35consin Statutes,

accordin� to the provisions of Section 25-3 thru 25-11 of the Oshkosh N�anicipal

7. Upon receiving the re�ort of the Board of Public Works, the City
Clerk is directed tn give notice of a public hearing on such reports as
specifieci in Section 66.60 (7) of the Wisconsin Statutes. The hezsing shall
be held by the Board of Public works at the Council Cha�ers in the City
Hall at a time set by the Clerk in accordance with Section 66.60 (7) of the
S9isconsin Statutes.
8. The installation of said street improv�its shall i�e accronralished
according to the provisions of Section 25-3 thru 25-11 of the Oshkosh
Nhmicipal Code.
