The Common Council of the City of Oshkosh do ordain as follows:
SECTZON 1. That Section 30-2 (b) of the Oshkosh Municipal Code pertaining
to Zoning Districts and the map therein descriSed is hereby amended by adding
thereto the district character of the following described area:
FIRST ASSEhIBLY OF GOD CHURCH ANNE:i�1TI0N - Annexed to the 13th Ward on
August 7, 1980
C-2 Light Commercial District for the following portion:
(a) The North 850 feet of Parcel I(described as follows) except the �orth
120 feet of the West 73 feet and the East 225 feet of the South 120
feet thereof.
(b) The North 30 feet of Parcel II
R-1B Single Fa�ily Residential for the remaining portion of the property
described below as all of Parcels I and II Less that nortion described
above to be Zoned C-2

Annexation and zoning
Honorable Councilmen:
The First Assembly of God Church has requested that
approximately 13 acres of land owned by it located at the
southwest corner of Witzel Avenue and Washburn Street in
the City of Oshkosh be zoned C-2 to permit t1-.e development
of a retail shopping complex.
The Church has entered into a written contract with the
developer, Commercial Properties of Wisconsin, Inc., and
has inserted the following restrictione in that contract which
will be incorporated in the deed in response to some of the concerns
of the City administration, City Council persons, and other citizens
of our community:
1) The size of the development is limited to not more
than 160,000 square feet of building, consisting of the
following:
Kohl's Department Store
Supermarket
Drug store
Small tenants - space area
Small tenants - space area
Free standing building
61,650 square feet
30,600 square feet
10,000 square feet
1 37,000 square feet
2 15,750 square feet
5,000 square feet
160,000 square feet
2) The developer is limited to building the project in two
phases. The first phase, which may be constructed immediately,
shall consist of the Koh1's Department Store, drug store and
small tenant space, free standing building, all totalling not

more than 113,750 square feet. The supermarket and remaining
small tenant space cannot be under construction prior to
October l, 1983.
3) The small tenant space is limited to two tenants
occupying not more than 10,000 square feet each and the
remaining small tenant space is limited to not more than
5,000 square feet for each tenant.
4) The Church has retained landscape control.
5) The developer may not purchase until it has obtained a
written commitment from Kohl's to lease space in the development
prior to March 15, 1981.
In the event the property is zoned at this time by the
City to permit construction of the retail complex proposed
and the written commitment is not received from Kohl's to the
developer within six months from the date the zoning ordinance
is adopted, the First Assembly of God Church hereby agrees
that it will not sell to any one else during that period of
time and shall thereafter promptly apply for rezoning to that
recommended by the City Planning Office at that time.

Dear Councilpers�s:
This is to inform you that at the September 9th Oshkosh Commercial Develo�nent
Corporation Boarrl of Directors meeting, we voted to support the Plan Coimiission's
recotnrendation that there not be further comnercial zoning west of Highway 41.
The City Council has made major public investments in Walkway West, parking im-
provanes�ts, and major street i�rovanents in the central business clistrict. The
city is wvrking on an e�rtensive redevelognent area with the Oshkosh Centre.
The Corporation rec.rognizes the Council has made a commitm�7t to support the cen-
tral business district.
We urge you to consider the long range iicg�li�ations if retail �pansion along
Iiighway 41 is allowed to go unchecked. A decision to allow the e�ansion of re-
tail growth in this area will severely hammr and hinder these past and continuing
efforts to assist the central business district.
