WEiEREAS, an annexation petition duly circulated has heretofore been signed by the owners of more than:100% of the land in the area within such territory, tnere being no el.ectors zes�ding in said terricory, notice or intention to circulate an annexation petition for direct annexation having been duly pub- lished, and a copy of said notice with a scale map reasonably showing the boundaries of the area sought to be annexed and its relation to the munici- palities involved, having been duly served upon the municipal clerks and the Director of the Planning Function, Department of Resource Development, State of Wisconsin, within five (5) days of the date of publication of said notice, adoption of this ordinance shall constitute acceptance of the petition of annexation, and WHEREAS, more than twenty (20j days have lapsed since the publication of the notice of intention to circulate such annexation petition and not more than sixty (60) days have lapsed since the filing of the annexation petition, and WHEREAS, the Director of the Planning Function of the Department of Re- source Development of the State of Wisconsin has issued his opinion that the annexation is not contrary to the puUlic interesi, and WHEREAS, the petitioners have requested that the annexation ordinance temporarily designate the classification of the annexed areas for zoning pur- poses, and WfiEREAS, the Plan Comiaission of the Citv of Oshkosh has recommended that the said property be ?emporarily zoned as follows: M-2 INDUSTRIAL DISTRICT; C-3 COhL*tE?tCIAI. DISTRICT; pursuant to the attacned map NOW, THEREFORE, the Comnon Council of the City of Oshkosh do ordain as follows: SECTZON 1. Sections 1-28, 1-29, 10-1 and 10-3 0£ the Oshkosh Municinal Code perta3ning to Boundaries, Wards, Pollc, Benchmarks are hereby amended so as to reflect the provisions of this ordinance and the proper City o£ficials are hereby authorized and directed to make such changes. SECTION 3. This ordinance shall be in full force and effect from and after its passage and date of publication. SECTION 4. The proper City o£ficials are hereby authorized and direcied to comply with the following requirements of Section 66.021 (8) of the Wisconsin Statutes and the City Clerk shall give written notice to the appropriate Town Clerk of the acceptance of the annexation petition and the adoption of this - ordinance. -9C- � '_ EAA � WINNEBAGO CTY ANNE.YATION CONT.
