SECTION 20-2 STATE PLUMBING CODE �'� State Plumbing Code adopted. Chapter 145, Wisconsin Statutes, and the Wisconsin Administration Code, Rules of Department of Health and Social Services, Plumbing Code, are hereby adopted and by reference made a part of this chapter with the same force and effect as though set out herein in full, and failure to comply with any of the provisions of said statutes or code shall constitute a violation of this secuon, punishable according to the penal ues provided herein. SECTION 20-3 APPOI*ITMENT AND QUALIFICATIONS OF SUPERVISOR (A) Appolntment There is hereby created the position of plumbing supervisor who shall be appointed by the city manager, as authorized in Section 2-23. (B) Qualifications The Plumbing Supervisor shall have at least ten (10) years of experience in plumbing, be a licensed plumber and have the necessary ability to supervise the installation of plumbing systeas. He shall not be interested as a partner nor otherw�.se wtth any person or in any business dealing in plumb- er's supplies, fixtures or materials or carrying on the trade of plumbing. 20/1 � SECTION 20-4 DUTIES UF SUPERVISOR � r�- (A) Generally Generally, it shall be the responsibility of the plumbing supervisor to establish and carry out the city's program to enforce the requirements of Chapter 145, Wisconein Statutes; Department of Labor and Human Relationa Plumbing Code, Department of Natural Resources Environmental Protection NR 111.25 and municipal plumbing code and relative laws. He ahall also perfonn such other appropriate'dutiee as may be prescribed by the City Manager. (B) Records The plumbing supervisor shall keep a record of all plumbing permits and plan approvals. Each permit ahall be regularly numbered in order of issue. The records shall show all inspections made, plans approved and feea collected. (C) Reports to City Manager The plumbing supervisor shall file monthly and yearly reports c.nth the city manager shocaing the activities of his office. (D) Monies Collected The plumbing supervisor shall keep a record of all fees received for permits and plan approvals pursuant to provisions of this chapter. Monies collected shall be paid into the city treasury and be placed in the general fund. The comptroller shall keep an account of the same and make a report thereof once a year to the city manager. (E) Whenever it shall be reported to the health officer that the plumbing or drainage outside or inside of any building, structures, parks, areas or complexes, etc., of an existing plumbing system is defective, or fails to conform to the requirements of this section and by reason of such failure tends to create a health hazard, the health officer shall direct the plumbing supervisor to inspect the plumbing system and suggest such changes as are necessary to eliminate the health hazard by bringing the faulty plumbing system into compliance with the existing plumbing code. The health officer shall thereupon direct such changes to be made and fvc a time for doing same. Any person refusing to camply therewith shall be guilty of a violation of this chapter; each day's continuance thereof shall constitute a separate offense. SECTION 20-5 AUTHORITY OF PLUMBING SUPERVISOR AND AUTHORIZED ASSISTANTS (A) The plumbing inspector and assistants shall have the power and authority at all reasonable times, for any proper purpose, to enter upon any public or private premises and make inspections thereof, and to require of any perso❑ or persons doing plumbing or drainlaying work the production of the permit therefor; provided, however, that no inspection shall be made witho�t a warrant, in the event that the occupant of the premises shall fail to give his consent to such inspection. Any person who shall resist or obstruct any lawful exercise of authority by said plumbing inspector shall be subject to the penalty provided in this chapter. 20/2 (B) The plumbing supervisor is authorized to onthhold approval tion oc plumbing permlt to any person who has not complied order of the plumbing supervisor. The person refused such appeal within ten (10) days to the city manager. � r� of an applica- c.*Lth a lawful a permit may (C) Supervisor and Authorized Assistants Not Liable In all cases where any action is taken by the plumbing supervisor or assistants to enforce the ordinances of plumbing such action or act shall be considered as done in the n2me of and on behalf of the City of Oshkosh, and the plumbing supervisor or assistants so acting for the city ahall not be judged as l�.able for any damage or inconvenience that may accrue to persons or property as the result of any such action or act committed in the discharge of their duties, and any law suit or action brought against said plumbLng sipervisor or assistants by reason thereof, shall be defended by the city attorney until final termination of the proceedings contained therein. (D) Inspection or approvals by the plumbing supervisor or assistants shall not in any case constitute a guarantee against imperfection by either the City of Oshkosh or the plumbing supervisor or assistants. SECTION 20-6 INTERFERENCE WITH INSPECTOR No person shall interfere in any way with the work of inspectLOn or permit any plumbing or drainage to be used until it has been inspected and approved unless special permission tiierefor is given by the plumbing inspector. SECTION 20-7 CLAIMS AGAINST CITY (A) The City of Oshkosh shall not allow any claim made by any person, firm or corporation owning property in the city which is serviced by sewer and water for damages to such services that may have occurred during public water and sewer construction in the public right-of-way unless prior notice is given to the plumbing supervisor and city engineer of the time and place where the repair is to be made. Upon receiving such notice, the plumbing supervisor and/or city engineer shall inspect the repairs to be made and shall file a written report of his findings in his office; and such notice and inspection shall be conditions precedent to the allowance for claicns for such repairs or damages. (B) Information as the plumbing supervisor or city engineer has with regard to the location of the public sewer or public cater supply and locations of y's and laterals for serving properties �.nll be furnished at requester's risks as to accuracy of same. SECTION 20-8 PLUMBING PER'�fITS, PLAN EXAMINATIONS AND APPROVAL (A) Permits No person shall perform or permit the performance of any plumbing or sewer work of any kind, except the removal of stoppages or repair of faucets, valves, or leaks as provided in subsection (B) of Section 20-3 of this chapter, unless a permit therefor shall first have been obtained as here- inafter provided. 20/3 (1) Applicauon The applicant for a plumbing permit shall make application to pl�mbing inspector on forms furnished by the city. the� i� (2) Issuance oE Permit No permit wi11 be issued until plan examination and approval require- ments have been met. Upon examination and approval of such applica- tion by the plumbing inspector and upon payment to the city treaeurer of the required permit fees listed in Subsection (3) of this Section, the inspec¢or shall iseue a permit therefor. Such permit may be issued on13• to persons duly licensed to do plumbing work under the laws of Wzsconsin and under the provisions of this chapter, and such other persons who are entitled to a permit under the laws of the State of Wisconsan. No plumbing permit ahall be issued authorizing a connection vnth the city water and sewer systems if the land to be benefited by such connection had not been specifically assessed for the water or sewer main extea•sion in the strzet abutting said property unless the owner thereof pays a connection fee to the city in an amount equal to the amount whsch the property w�uld have been assessed at the time of said water or sewer main construction, based on the formula used at that time for t3�e computation of the special assessment for said water or sewer main installation. (3) Schedule o� Feea The schedule of fees to be paid shall be as follows: $7.50 for sanitary or storm sewer connections at main in street or curb. $7.50 for sanitary or storm sewers relaid from main or curb to building or main to curb. $3.00 for water service connecuons at main in street or curb. $3.00 for water seroice relaid from main or curb or building or main to curb. $5.00 for water service and sewer repair, $2.50 minimum fee for inspection of any plumbing or drainage work requiring a permit. $2.50 for each fixture whether a new installation or a replace- ment and all plugged openings for fixtures. Such schedule shall apply to the folloc.nng list of fixtures: all trapped fixtures, a11 s2yles and descriptions of sinks, water closets, bathtubs, shower baths, wash basins, bubblers, garbage disposals, laundro- mats, dishwashers, floor drains, laundry tubs, water softeners, urinals, gas, oil, electric and coal wdter heaters, ranges, boil�rs, electric pumps, septic tanks, catch basins or similar receptacles, bar and soda fountains, ice boxes or refrigerator systems, air conditioning systems, dental cuspidors, developing sinks, a11 hospZtal and clinic fixtures, grease traps and grease 20/4 catch basins, acid tanks, sump pumps, and ejectors, private ��� sewerage disposal planta, house draine, rain water leadere, machine waste connections, cellar, floor, and subsoil drains, rain water cistern connectione, all plugged openings for future fixtures and fire protection installation when no plumbing fixtures are installed. (4) Double Fees Plumbing f�ctures or appliancea found installed by the Plumbing Inspector for which no inatallation permit has been issued e�nll be subject to an inspection fee charge of Five ($5.00) Dollars for each such fixture appliance. (B) Plan and Specification Exam�nations and Approval (1) Complete plans and specifica uons of plumbing to be installed outside and inside of all new buildings, structures, parks, areas or com- plexes, in the folloonng classifications shall be submitted for approval and approval received before a plumbing permit unll be issued so installation may commence: (a) Theaters and assembly ha11s. (b) Schools and other places of instruction except state-owned schools. (c) Apartment buildings, hotels, resorts and places of detention. (d) Factories, offices and mercantile buildings. (e) Private interceptor roains. (f) This section shall apply to all plumbing to be installed in all alterations and additions exceeding three fixtures. (g) Doctor and dental offices. (h) Doctor and dental clinics enthout operating facilities. (2) All plans and specifications shall be sealed or stamped in accordance unth Chapter A-E1 Wis. Adm. Code by a registered azchitect, engineer or registered plumbing designer. A master plumber aay design and submit for approval plumbing plans and specifications for a plumbing system which he is to install. Each sheet of plans and specifications the master plumber submits shall be signed, dated and include his Wisconsin Master Plumber License number. Where more than one sheet is bound together into one volume, only the title sheet or index sheet need be signed and dated by the master plumber designer-installer, if signed title sheet clearly identifies all other sheets. (3) Plan examination fees shall be paid when plans and specifica uons are submitted for approval. The fee shall be the same as the fee schedule set forth in Wis. Adm. Code Sec uon H62.25. 20/5 � �(4) Plan submisaion data ahall illuetrate and describe the plumbing system � and ahall show the location, kind and eize of all sewera, drains, wastes and vent pipes, fixtures, traps, receptaclea, appliances, water service, and water diatribution, and any other pertinent data. The plans shall be prints that are clear, legible, and permanent. Plans not meeting above requirements will be rejected. Plane wi.11 be reviewed in order of receipt. (5) After approval is granted', plans and specificatione shall not be changed c.nthout written approval by the plumbing supervisor. A review of changes will be made when deemed neceasary �.nthout cost. SECTION 20-9 DELINQUENT FEES � In the event any permit fees are due from any applicant and are not paid at the time of filing of the plumbing supervisor's monthly report, such applicant's name and the amount due shall be carried forward oa each succeeding monthly report until such fees are fully paid. No permit shall be issued to any per- sons, firw or corporauon which is in arrears for more than the fees incurred during a current month, until such account has been settled onth the city. SECTION 20-10 NO PERKIT TO VIOLATORS Whenever the installation of any plumbing is done or being done contrary to [he regula uons of this chapter, the plumbing supervisor shall send a written notice to the violatox at his last known business address as shown in the register of licensed master plumbers or home owners to remedy such violations. Failure to comply nnth such notice shall be deemed sufficient reason for withholding future permits. If there is a failure to promptly respond to any official communi- cauons, then such acts shall also be dee�ed suffLCient reason for withholding future permits. SECTION 20-11 SERVICE BEYOND CITY LIMITS (A) Connec uons Prohibited Every person including all officers and employees of the City are prohi- bited from connecting or aiding and abetting the connection of any sewer or water lateral servicing any property situated outside of the legally established city limits of the City with any existing or hereinafter to be constructed ca ter or sewer main belonging to the city wrater and sewer systems. (B) Exceptions This ordinance shall not affect any existing installations. (C) Allowed Connections The Common Council of Oshkosh may, by resolution, authorize connections to the city sewer and cater mains by any property after said property has filed a valid annexation petition and prior to the consideration of said petiuon by the Common Council. 20/6 SECTION 20-12 CROSS CONNECTION CONTROL �'� (A) It shall be the duty of the plumbing supervisor to cause inspections to be made of all properties served by the city's public water system where cross connections wtth the public water system is deemed posaible. The frequency of inspections and re-inspections based on potential health hazards in- volved shall be part of the program and as approved by the Wisconsin Department of Natural Resourcea. (B) The plumbing supervisor is hereby authorized and directed to discontinue water service to any property wherein any cross connection in violation of this ordinance exists, and to take such other precautionary measures deemed necessary to eliminate any danger of contamination of the public water sys�em. Water aervice shall be discontinued only after reasonable notice and opportunity for hearing under Chapter 68, Wisconsin Statutes, except as provided in Section C. Water aervice to such property shall not be restored unul the cross connection(s) has been eliminated in compliance e.nth the provisions of this ordinance. (C) If it is determined by the plumbing supervisor that a cross connecuon or an emergency endangers public health, safety or welfare and requires immediate action, and a written finding to that effect is filed crith the City Clerk and delivered to the customers premises, service may be im- mediately discontinued. The customer shall have an opportunity for hearing under Chapter 63, Wisconsin Statutes, within 10 days of such emergency disconnection. SECTION 20-13 PENALTIES (A) Specific Penalty Any person violating any of the following provisions of this Chapter sha11, upon conviction thereof, or pleading guilty thereto, be fined not less than Fifty ($50.00) Dollars nor more than Two Hundred ($200.00) Dollars, and in default of payment of such fine and costs of prosecution, shall be im- prisoned in the County Jail unul such fine and costs shall be paid, not exceeding fifteen (15) days. The inspector shall cause all such counections to be removed forthwith. (B) General Penalty Any contracting plumber, or master or journeyman plumber, drainlayer, property owner or other person who shall violate any of the provisions of this chapter or who shall install or allow to be installed any plumbing or drainage in this city contrary to the provisions of this chapter, shall, where no other penalty is specifically provided, be punished by a fine of not less than ten ($10.00) Dollars nor more tha❑ Two Hundred ($200.00) Dollars, plus the costs of prosecution and in default of pa}*ment therefor, by imprisonment in the County Jail until such fine and costs are paid, not exceeding thirty (30) days.
