The city of Oshkosh, Winnebago County, provides water
service at said location as a public utility under s. 196.01, Wis.
Stats. It applied to the commission on February 22, 1980,
pursuant to ss. 196.03, 196.20 and 196.37, Wis. Stats., for
authority to increase water rates on an interim and permanent
basis.
Applicant requested an immediate interim rate increase
of 6 cents per 100 cubic feet for all consumption in excess of 800
cubic feet per quarter, or approximately $156,000 in annaal
revenue. Application for interim rate relief was granted by order
dated May 20, 1980 in this docket as a 12.8% surcharge:to existing
rates for service
estimated $192,b70.
Such surcharge increased annual revenue by an

THE COMMISSION FINDS:
Prior to the interim increase authorized in this
proceeding by the commission's order dated May 20, 1980
applicant's water service rates were last revised in 1978, at
which time the gross plant investment was $11,355,986. The
utility`s gross plant investment estimated for the 198I test year
is $12,805,759.

Applicant's existing rates are unreasonable and unjust
because of inadequacy.
Applicant's capital employed in providing public utility
service is estimated to be 61.73% municipal equity and 38.27%
long-term debt. The composite cost of debt capital is 4.91%. A
return on rate base 6.0% will provide a return on municipal equity
of 6.67°� and a 3.2 times interest coverage. The rate of return of
6.0% applied to net investment rate base to determine revenue
requirement for purposes of this proceeding is reasonable and
just.

Applicant requested that the commission determine a
reasonable rate structure. Applicant was provided with staff's
initially proposed rates for review transmitted by letter dated
October 27, 1980. Applicant responded with a letter dated
November 14, 1980, in which it requested revisions to the general--
service volume biock rates which were proposed by siaff Lo
maintain a specific numerical difference between the highest and
lowest block rates. Staff analqzed applicant's requested rate
changes and testified that they would result in revenues over
$17,000 in excess of the recommended revenue requirement ared, in
addition, would result in unreasonably high percentage bill
increases to large volume customers.
In a revised exhibit, submitted at the hearing as
exhibit No. 4 in this proceeding, staff proposed revised volume
block rates that moved partially in the direction of those
recommended by applicant. Such rates would move closer to the
results of staff's cost-of-service analysis than those initially
proposed but would maintain a more acceptable degree of continuity
with existing rates. Applicant submitted in its testimonq its
requested rates and reasons therefore, but acknowledged acceptance
of staff's revised rates.

The commission staff submitted for the record an
analysis of the cost of supplying water for general service and
for public fire protection service. The staff used the base-extra
capacity-cost allocation method for the analysis. Under this
method, the operating expenses are allocated first to the service--
cost functions of extra-capaGity maximum-day and maximum-hour
demand, base costs, customer costs and fire protection, and then
to each of the customer classes served. Summaries of such
analyses, based on allocations that are reasonable and just, are
shown in schedule 1 of exhibit no. 3 and schedule 5 of exhibit
no. 4 of the record in this proceeding. Appendix A shows customer
class revenue requirements resulting from the cost analysis
compared with revenues at authorized rates.
Water service rates authorized herein will result in an
estimated net operating income of approximately $400,974 which
provides a 6.0% return on the water utility net investment rate
base of $6,682,896.
As shown in attached appendix A, the base-extra capacity
cost allocation method results in a relatively wide range of
increases in the charges to the various general service customer
classes to reflect the cost of providing service to such classes.
To provide for historical continuity in applicant's rates, the
commission finds it reasonable to authorize general service rates
that move in the direction of the base-extra capacity cost
analysis as described above, with the intent to make further
adjustments in that direction in subsequent rate proceedings. In

moving toward the cost of service in authorized rates, the
commission tempers the rate increase to the customer classes that,
according to the cost analysis, should receive the largest
percentage increases. 2he resulting revenue difference is
recovered through rates to the remaining customer classes. The
percentage rate inerease to�any individual customer will not
necessarily equal the overall percentage increase to the
associated customer class, but will depend on the specific usage
level of that customer.
Authori2ed rates as set forth in appendix B are based on
the cost of supplying various classes or types of service. These
rates are reasonable and just. All customers will be required to
pay an appropriate amount £or the service provided.
Some typical water bills for residentiai, commercial,
public authority and industrial customers were computed, using
schedule Mg-1 to compare existing interim rates with the new
rates. Such comparison is set forth in appendix C.
The overall increase in annual revenues is 4.Oqo,
comprised of a 4.8% increase in general service charges with no
change to the existing level of fire protection charges. A
typical residentiai customer's bill will rise 0.5% over interim
rates. Rates have risen because of a 13°� increase in gross plant
investment and a 12% increase in operating expenses since
applicant's last rate case in 1478. The typical bills calculated
using the authozized rates are approximately average when compared
with those of similar water utilities in the state.

Authorized general service rates provide a greater
percentage increase to large volume users than for average
residential customers. This greater increase is caused by the
relatively larger increases in the rates for the high volume rate
blocks based on the results of the base-extra capacity-cost --
allocation as discussed above. The greater increase to
large volume users is reasonable in that the proposed rates more
appropriately reflect the cost of providing service than do the
present rates.
The authori2ed charge for public fire protection
provides for no increase as compared to a 4.8y, increase in general
service rates. The results of staff's cost allocation, as shown
in appendix A, indicates an 18.4% decrease to the public
fire protection charge to reflect the cost of providing service.
Rather than reduce the charge to the indicated level, it is
reasonable in the interest of rate continuity, to leave the public
fire protection charge unchanged, and to recover the difference
through smaller increases to the general service rates.
The authorization to increase water rates is classified
as a Category 3 action under s. PSC 2.90(3}, Wis. Adm. Code. It
consequently requires neither an environmental impact statement
under s. 1.11, Wis. Stats., nor an environmental screening.
On May 20, 1980, the commission authorized a 12.88 interim
increase in applicant's rates. These interim rates were reasonable
and just for the period for which they were in effect.

Applicant bills quarterly. The authorized rates
rules for water service shall be made effective as soon as
possible after issuance of the order herein in accordance with
ss. 196.21 and 196.40, Wis. Stats., so that applicant can avoid
the adverse financial effect of losing authorized increased �
revenues for an entire billing period.
Order
THE COMMISSION THEREFORE ORDERS:
1. That the city of Oshkosh, Winnebago County, as a
water public utility, be and is hereby authorized to discontinue
its existing water rates and rules for service and to make
effective for such service the rates and rules set forth in the
attached appendix.
2. That the effective date of this order shall be
5 days after mailing to, or physical service upon, the parties to
the proceedings. The authorized rates and rules shall also be
effective on that date provided that the newly authorized rates
and rules are filed with the commission and placed in all offices
and stations of the utility prior to or on that date. If the
newly authorized rates and rules are not placed in all offices and
stations of the utility prior to or on that date, the rates and
rules will become effective on the date that they are placed in
all offices and stations. The utility shall immediately inform

the commission, in writing, of the date that the authorized rates
and rules take effect.
3. That the city of Oshkosh, Winnebago County, as a
water public utility, inform each customer of the new rates as
required by s. PSC 185.33(1), Wis. Adm. Code.

For public fire-protection ser•✓ice te the city of Oshkosh
the annual charae shall be $306,100 to cover the use of mai.r.s
and hydrants up to and including the terminal rydrant and connec-
tion'on each main existing for the 1961 test year.
For all extensions of fire-protection service, a charge of 35C
per lineal foot of main shall be charged per annum on the basis
of the length of main put into use between hydrants placed, nlus
a charge of $5g net per hydrant added to the system after the
base period.
This service shall include the use of hydrants for fire-protection
service only and such quant?ties of water as may be demanded for
the purposes of extinguishing fires within the municipal boundary
only. For all other purposes, the metered or other rates set forth,
or as may be filed with the Public Service Commission, shall apply.
The above base annual charge of $306,100 includes an estimated
1,098,093 feet ot 3istribution main; 4-inch and larger, and 1,572
hydrants. �

Water service supplied to municipal buildings, schools, etc.,
shall be metered and the regular metered service rates applied.
Water used on an intermittent basis for flushing service, street
sprinkling, flooding skating rinks, drinking fountains, etc.,
shall be metered where meters can be set to measure the service.
Where it is impossible to neasure the service, the superintendent
shall estimate the volume of water used based on the pressure
size of opening and period of time water is allowed to be drawn.
The estimated quantity used shall be billed at the rate of 52fi
per 100 cubic feet.

Repairs to Meters:
The water utility of the city of Oshkosh shall keep, maintain
and replace all 5/8-inch meters being used in the city of
Oshkosh in good repair and working order at the expense of
the city water utility, except that replacement or repair
of any damage to a meter resulting from the carelessness of the
owner of the premises, his agent or tenant, or from the
negligence of anyone of them to properly secure and protect
saiae, including any daMage that may result from allowing a
water meter to become frozen or to be injured from the presence
of hot water or steam in the meter, shall be paid for by the
consumer or the owner of the premises. The above provision
shall apply regardless of the use made of the premises in which
said meter is located.
The water utili*yo uf the city of Oshkosh shall keep and maintain
all (3/4-inch meters and all one inch) meters in good repair
and working order at the expense of the city water utility, on
premises where the use of city water is exclusively used for
residential purposes, except that replacement or repair of any
damage to a meter resulting from the carelessness of the owner of
the premises, his agent or tenant, or from the negliqence of
anyone of them to properly secure and protect same, including
any ,'.amage that may resu2t from allowing a water meter to become
frozen or to be injured from the presence of hot water or steam in
the meter, shall be paid for by the consumer or the owner of the
premises; the water utility of the city of Oshkosh shall replace,
when deemed necessary by the city water utility, at the expense
of the water utility, such 3/4-inch meters with 3/4-inch meters and
such one inch meters with one inch meters.
The water meters hereafter installed shall be of such make as the
water utility shall prescribe.
The original cost for the purchase and installation o£ such water
meters shall be at the expense of the owner o€ the premises.
