HomeMy WebLinkAbout31375 / 81-03June 4, 1981 # 3 RESOLUTION PURPOSE: INZTIATED BY: FINAL RESOLUTION - SEWER 6 WATER PROGRAM DEPARTMENT OF PUBLIC WORKS WHEREAS, the Common Council of the City of Oshkosh held a public hearing on the 6th day of November, 1980 at 7:00 p.m. for the purpose of hearing all interested persons concerning the preliminary resolution and report of the City Manager (BOard of Public Works) on the proposed improvei.ient� consisting of sar.itary sewer and water main, pursuant to the initial resolutions adopted on October 2, 1980 and May 7, 1981, by the Oshkosh Common Council of the following named streets: S?�NITARY SEWER Easement along Wisconsin Street extended £rom West Smith Avenue to 165' + north of south line of NE 1/4 Section 11-18-16. Easement 165' + north of and parallel to south line of SE 1/4 of Section 11-18-16, from Wisconsin Street extended to the west line of the SE 1/4 of the NE 1/4 of Section 11-18-16. Easement along the west line of the E. 1/2 of NE 1/4 of Section 11-18-16 from 165' north of the south line of the SE 1/4 of NE 1/4 of Section 11-18-16 to approximately S00' south of C& NWRR Tracks. Easement within the NW 1/4 of NE 1/4 of Section 11-18-16 located approximately 500' south of the Chicago & Northwestern Railroad from the east line of said NW 1/4 of NE 1/4 to Vinland Street. West 20th Avenue from 675 feet west of washburn Street to 426 feet east of Lennox Street WATER MAiN Vinland Street from 480 feet north of Morgan Avenue to Chicago & North Western Railroad Tracks. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh as follows: SII�J`�'ITTi.D BY _ , -^ ,��.�, �� - 3A-- 1. That the report of the City Manager, actinq as the Board of Public Works, pertaining to the construction of the above described public improvements, including plans and specifications therefore, is hereby adopted and approved with the following modifications: a. b. c. 2. That the action of the City Manager in advertising for bids and to carry out the work of such improvements in accordance with the report of the City Manager and in accordance with the said resolution heretofore adopted, is hereby approved, ratified and confirmed. 3. That payment for said improvements be made by assessing the cost of the progerty benefited as indicated in said ZApnrtr eace?t ?� modified herein. 4. That benefits and damages shown on the report as modified are true and correct and are hereby confirmed. 5. That the assessments for all projects included in said report are hereby com�ined as a single assessment but any interested property owner shall be entitled to object to each assessment separately or both assessments jointly for any purpose or purposes. 6. That the assessments may be paid in cash, or in installments pursuant to Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear interest at the rate of eight percent (88) per annum on the unpaid balance. The City Clerk shall publish an installment assessment notice in accordance with Section 66.54 (70 (e) of the Wisconsin Statutes for 1977 in the o£ficial newspaper of the City. 7. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY NORTHWESTERN, the official newspaper of the City. 8.
