The Comron Coimcil of the City of Oshkosh do orclai.n as follouos: SECPIIX�I 1. That Section 1-B.1 of the Oshkosh Mimicipal Code prohibiting ixing a party to an ordinance violation is hereby created to read as follows: •-a a. • •-n��s�� !_• __ •� (A) Whoever is �ncerned in the violation of an ordinazce is a principal and tt�y be charged with and convicted of vio- lating the ordinance although he did not directly violate it and althou� the person who ciirectly violated it has not been convicte3 or has been convicted of so� other ordinance violation based on the sairn act. (S) A person is concerned in the violation of an ordinance if he: (1) Directly violates the ordinance; or (2) Intentionally ai.ds and abets the violation o£ it; or (3) Is a party tn a consoiracy with another to violate �+ �_ �.i�,+yaac l,_T�_� Cr,,mW�,lg ._,. r.til,,,r,.,:�_ .. _.�._�__ another to violate it. Sucn a g�rty is also�concemed in the violation of any other ordinance which is co�nitted in punuance of the intended violation and which under the circt��tances is a natural and probable consequence of the intended violation. This paragraph does not apply to a nerson who wl- untarily changes his mind and no longer desires that the ordinan� be violated an3 r,otifies the other parties concerned of his withdrawal within a reason- able time beiore the violation of the ordinance so as to allaa the others also to withdraw.
