INITIATED BY: STEVE MOSLING $ 3A ORDINANCE FLHN COMh11JJIUPI I(tCUh1MtNDHI IO(V: HFPttOVtD b-O A GENERAL ORDINRNCE QF THE CITY OF OSHKOSH ANNEXING CERTAIN TERRITORY TO THE CITY OF OSHKOSH AND SPECIFICALLY TO THE 14th WARD OF SAID CITY. WHEREAS, an annexation petition duly circulated has heretofore been sigr.ed b� +_he owners �f rore than one-half of the irind in *_Fe area within such territory, and a majority of the electors residing in said territory, notice of intention t� circulate an annexation petition for direct annex- ation having been duly published, and a copy of said notice with a scale map reasonably showing the boundaries of the area sought to be annexed and its relation to the municipalities involved, having been duly served upon the affected municipal and school district clerks and the Director of the Planni��g Function, Department of Resource Development, State of Wisconsin, within five (5) days of the date of publication of said notice, adoption of this ordinance shall constitute acceptance of the petition of annexation, and WHEREAS, more than twenty (20) days have lapsed since the publication of the notice of intention to circulate such annexation petition and not more than one hundred twenty (120) days have lapsed since the filing of the annexation petition, and WHEREAS, the Director of the Planning Function of the Department o` Resource Development of the State of Wisconsin has issued his opinion that the annexation is not contrary to the public interest, NOW, THEREFORE, the Common Courcil of the City of Oshkosh do ordain as follows: SECTIGPi l. The foilowing described territory, pursuant to a duly cir- culated and filed annexation petition for direct annexation is hereby annexed to and made part of the City of Oshkosh, a municipal corporation located in Winnebago County, more specifically to the 14th Ward of said City and is annexed for school purposes also and is hereby made a part of the City School District, and subject to all of the laws governir�g the same, all in accordance with Section 66.021 of the Wisconsin Statutes (1979) and the amendments thereto: - 3A - ORDINANCE 3� Stoney 8each Annexation A parcel of land in the Section 36-18-16, Town of Algoma, Winnebago CounYy, Wisconsin, described as follows: Gommencin; a*_ *_h=_ ��Y0�59CYlOn ef West 24th Aven��e and the exiended east line of Lot 1 of the KurYz Plat, thence east along the centertine of 24th Avenue to the eas �rly right- of-way of the Chicago and Northwestern Railroad, thence southerly aiong said easterly right-of-way line to the north bank of Giatz �reek, tnence Siy aiong tne westeri� snore line of Lake Winnebago to the centerline of Waukau Avenue, thence Wly along the centerline of Waukau Avenue to the centertine of Fond du Lac Rd. also being U.S.H."45", thence Nly along the centerline of U.S.H."45" to a poinC 69 feet Nly along the said centerl'+ne of the inters. of the wly line of the Chicago b NW Railroad right-of-way and the centerline of FJ.S.H."45��. thence S]1� 0$' W.; ?!5.b fee±. more er less. thence N 20°22'U., 374.9 feet, thence S 85°W•, 157 feet, niore or less to the east line of Kurtz Plat, thence Nly along the east line of Kurtz Plat to the extended N line of Lot 25 of the Kurtz Plat, thence west along the N line of said Lot 25> to the east line of Lot l in said piat, thence north along the east line of Lot i to the centerline of W. 24th Ave. being the point of beginning. (Generally located south of 25th Ave., east of Fond du Lac Rd., and N of Waukau Avenue) SECTION 2. Section t-28, 1-29, 10-1 and )0-3 of the Oshkosh Municipal Code pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to reflect the provisions of this ordinance and the proper City officials are hereby authorized and directed to make such changes. SECTION 3• This ordinance shall be in full force and effect from and after its passage. SEC710N 4.
