A GENERAL ORDINANCE OF THE CZTY OF OSHKOSH ADDING SECTZON 7-42 TO
THE OSHKOSH MUNICIPAL CODE PERTP.INING TO AWNINGS, CIuVOPIES, h1ANSARDS
ADID LICENSE REQUZREMENTS
The Common Council of the City of Oshkosh do ordain as £ollows:
SECTION 1. That Section 7-42 of the Oshkosh Municipal Code
pertaining to awnings, canopies, mansards and licer,se requir.ements
is created to read as follows:
SECTION 7-42 AWNINGS, CP.b10PIES, MANSARDS, LICENS£ REQUIREMENTS
(A) Retractable awnings: There shall be a minimum
clearance of seven (7) feet from the sidewalk
to the lowest part of the framework or any
fixed portion of any retractable awning, except
the botton of the valance of canvas awnings may
extend to six (6) feet nine (9) inches above the
sidewalk. Retractable awnings sha11 be securely
fastened to the building and shall be set back
at least twelve (12) inches from the curb iine.
They shall be equipped with a mechanism or device
for raising and holding the awning in a retracted
or closed position against the face of the building.
(B) Fixed or permanent awninas: The clearance from
the sidewalk to the lowest part o£ any fixed or
permanent awning shall be the same as required
for retractable awnings_
(C; Marqaees, canopies, n�r..ar3s an3 ot:�e, projccting
structures: Marquees, canopies, mansards and
other projecting structures shall be constructed
in accordance with section 7-34, 7-40 and 7-55.
Any projecting structure shall be set back at Ieast
one foot (1') from the face of the curb and must
be at least ten feet (10') above the level of the
sidewalk, exceptinq awnings and canopies installed
in accordance to section 30-22(D)(3)(a).

Note: The replacement of a canvas cover of an
awning or canopy does not require relicensing
if an existing frame is Ieft c�naltered.
(F) Compliance: Marauees, awnings, baPconies, projec-
tions or structures extending over any portion o£
a street, and law£ully existina at the time of
adoption of this ordinance may be continued although
clearances, construction, setbacks or yards do not
conform with the provisions of this ordinance. They
may be maintained, but in no case shall the be enl-
arged or structurally altered without conformina to
the requirements of this code. Al2 exzsting awr.ings,

structures extending over any portion of a street
shall comply with the terms of this ordinance on or
before October 1, 1986.
