HomeMy WebLinkAbout31746 / 82-02M i February 18, 1982 FIRST READING PURPOSE: INITIATED BY: �� 6 AMEND BOATING REGULATIONS AND PENAI.TIES PARKS DEPARTMENT ORDINANCE A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 19-7 (D), (G), (I) AND SECTION 19-9 TO THE OSHKOSH MUNTCIPAL CCDE PERTAZNING TO BOATING REGULATIONS AND PENALTZES. The Co�on Council of the City of Oshkosh do ordain as follows: SECTION 1. That Sections 19-7 (D), (G}, and (I) of the Oshkosh Munici- pal Code pertaining to boating regulations are hereby amended to read as follows: SECTION 19-7 BOATING REGULATIONS (b} Sailboat Mooring (1) All boats which are assigned a specific location for the season must be located within their designated apace. Maximum length of moorings shall be 28 feet. (G) Application All boats located on the City's boating or mooring facilities must be registered annually with the Oshkosh Parks Department and an appropriate permit issued. Applications for sailboat storage, dinghy docks, boat hoists, and moorings area shall contain the following information, and applicants shall comply with the £ollowing requzrements: (1) Application sha11 contain name, address and telephone number of the owner. �i� .yprc Ui DOnt� S7't2� CO�ivY� niSCO,wlia .�=P3ii,�cilL OF Natuzal Resources registration number and serial number of boat. (3) Club affiliation (if any) and purpose of boat: (a) junior, (b) racing, (c) pleasure. (4) Boat owners must sign disclaimer of responsibility for Iiability. (5) An annual filing fee of $10.00 will be required prior to any boat receiving a permit. - 6A - � Amend Boating Regs. Cont'd. (6) No permit may be transferred, assigned, or sublet without prior permission from the City of Oshkosh. Persons who vacate spaces or change boats without authorization will lose the assigned space and permit. (7) The Common Council reserves the right to suspend any and a11 permits and the rights thereunder at any time. (8) A separate fee may be established for use of any of the above facilities with rates established by the Department of Parks with approval of the Co�on Council. The receipts from such fees shall be placed in a separate account and used for the purpose of future improvenents. That Section 19-9 of the Oshkosh Municipal Code pertaining to penalties is hereby amended to read as follows: .� SECTION 19-9 PENALTIES j (A) Any person who shall violate any of the provisions of this Chapte� or of any Section thereof, shall upon conviction thereof, be pun-', ished by a fine of not less than $35.00 nor more than $200.00 ' together with the costs of prosecution, and in default of. payment � thereof, by imprisonment in the County Jail for a period not to . exceed 30 days. Each violation shall constitute a separate ._ offense. SECTION 3.
