HomeMy WebLinkAbout31768 / 82-05March 4, 1982 PIRST READING PURPOSE: INITIATED HY: 0 6 oxnu�AxCE ORDINANCE TO AMEND PENALTIES FOR ORDINANCE VIOLATIONS LEGAL DEPARTMENT A GENERAL ORDZNANCE OF THE CITY OF OSHKOSH REPEALING SECTSON 18-21(D) AND AMENDING SECTIONS 1-31, 2-155, 3-12, 4-52,5-39, 6-19, 8-106, 11-64, 13-30, 14-54, 17-4,18-21(A),22-27, 25-12�, 26-21, 28-10, 30-27, 30-34, 30-73 and 7-63 OF THE OSHROSH MUNICIPAL CODE PERTAINING TO PENALTIES FOR ORDIN_ANCE VIOLATIONS The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 18-21(A) of the Oshkosh Municipal Code pertaining to penalties for shoplifting is hereby amended as follows: (A) Whoever intentionally alters, indicia of price or value of inerchaadise or who takes and carries away, transfers, con- ceals or retains possession of inerchandise held for resale by a merchant without his consent and with intent to deprive tfie merchant permanently of possession, or the fu11 purchase price, of such merchandise may be penalized as provided in Section 18-81. SECTION 2. That Section 18-2I(D) of the Oshkosh Municipal Code pertaining to penalties for shoplifting is hereby repealed. � SECTION 3. That Sections.l-31, 2-155, 3-12, 4-52, 5-39, 6-19, 8-106, 11-64, 13-30, 14-54, 17-4, 22-27, 25-120, 26-21, 28-10, 30-27, 30-34 and 30-73 of the Oshkosh Municipal Code pertaining to penalties for ordinance violations is hereby amended to read as follows: Any person who shall violate any of the provisions of this Chapter or of any Section thereof, sha11 upon conviction thereof, be punished by a forfeiture of not less than $35.00 nor more than $200.00, together with the costs of prosecution, and in default of payment thereof, by imprisonment in the County Jail for a period not to exceed sixty (60) days. Each day of violation shall constitute a separate offense. SECTION 4. That Section 7-63 of the Oshkosh Municipal Code pertaining to penalties for ordinance violations is hereby amended to read as follows: SECTION 7-63. PENALTIES. (A) Any violation of any of the provisions of this Chapter shall subject the violator to a fine of not less than Thirty-five Dollars ($35.00) nor more than 1Fao Hundred Dollars ($200.00); � March 4, 1982 ORDINANCE - AMEND PENALTIES FOR ORDINANCE VIOLATIONS - Cont'd. together with the cost of prosecntion, and in default of payment thereof, to imprisonment in the County Jail until such fine and costs are paid, not exceeding sixty (60) days. Each day a viola- tion continues, unless otherwise specified in this Chapter, shall constitute a separate offense. Where the violator has been issued a permit or is a licensee under the provisions of this Chapter, such permit or license shall he subject to revocation in the dis- cretion of the court. (B) In an action for any violation, the fact that a pemit was issued shall not constitute a defense, nor shall any error, oversight or dereliction of duty on the part of any inspector constitute a defer�e. SECTION 5.
