PL'RPOSE: FINAL RESOLUTION VACATING PORTION OF NORTH WESTFZELD
STREET
INITIATED BY: CITY ADMINISTRATION
WHEREAS, pursuant to Section 66.296(2) of the Wisconsin Statutes of 1980,
the Co�on Council has heretofore initiated proceedings on March 4, 1982, at a
regular meeting of the Co�non Council to vacate and discontinue the following
described portion of North Westfield Street:

line of Chippecra Ave. (now vacated) and North of the North
line of Witzel elvenue, except for that portion of said street
required for the construction of a cul-de-sac to be located
i�ediately south of the North boundary of that part of West-
field Street as described herein, all located in the Sixth
Ward, City of Oshkosh, Winnebago County, Wisconsin.
WHEREAS, a public hearing on the passage of such resolution has been set
by the Common Council, which hearing was set for 9:00 A.M. in the Council Chambers
of the City Hall, Oshkosh, Wisconsin, on the 15th day of April, 1982, and written
notice of such meeting was duly served on the owners of all of the frontage of
the lots and lands abutting upon that portion thereof sought to be discontinued
as provided by law; and
WHEREAS, a public hearing was duly held pursuant to said notice at the time
and place therefor affixed and all persons so served and interested were then
and there given an opportunity to be heard; a.nd
WHEREAS, a proper notice of the pendency of said petition for vacation and
discontinuance and map covering the proposed vacation was duly filed in the office
of the Register of Deeds for Winnebago County as required by the Llisconsin Statutes;
and
WHEREAS, the lots and lands a5utting on said street affected�by this resolu-
tion are all in the 6th Ward, City of Oshkosh, the description of said street here-
tofore set out in this resolution.
NOW, THEREFORE, BE IT RESOLVED by the Co�on Council of the City of Oshkosh
that it is hereby declared that since public interest requires it, the following
described street in the 6th Ward, City of Oshkosh, Winnebago County, Wisconsin,
is hereby vacated and discontinued, reserving unto the City of Oshkosh the right
to maintain, service, repair, add or replace all sanitary sewer, storm sewer,
water and gas mains and fittings in said vacated street:

BE IT FURTHER RESOLVED that Che City Clerk record a certified copy of [his
resolution accompanied with a map showing the location of said vacated street in
the office of the Register of Deeds for Winnebago County.

The Mayor ordered the following Public Hearing:
Vacate portion of North West£ield St.
That part of N. Westfield Street lying south of the north line
of Chippewa Ave. (now vacated) and north of the north line of
Witzel Avenue except for that portion of said street required
for the construction of a cul-de-sac to be located immediately
south of the North boundary of that part of Westfield Street as
described herein.
Rev. Calvin Larson, Executive Vice President of Lutheran Homes
of Oshkosh, Inc. stated the organization has purchased acreages
surrounding the area in question, and although there are no
drawings or plans at present, the Lutheran Homes would like
to have this issue settled for their future planning. He feels
the street is not necessary to the area; the High School has
developed their area and parking lots and all is accessible.
The type of traffic in the area has also been considered.
The neighbors volunteered to circulate a petition to have the
street vacated. These petitions represent residential homes
in the area, and only two signatures represent the Lutheran
Home. It is believed the street would not be a necessary thor-
oughfare.
Mr. Tony Sosnoski, 1620 Witzel Ave., approves of an intersection
area coming into Witzel Ave. to slow down the early morning traf-
fic into town, and agrees that this street should be put through
to Witzel Avenue. He said it has been onthe official map and
many other occasions in the past for area development have been
turned down because the official mapping would not be changed.
Mrs. Marjorie Siewert, i646 Witzel Ave. has been concerned if
this street would be put in as it would intersect into their
property. She does not believe a new street in this area would
alleviate �itzel Avenue traffic problems.
Mr. James Hepola, 251 N. Westfield Street property owner felt
there are enough traffic outlets in the area and a street extension
is not needed.
Mr. Dan Lalko, 267 N. Westfield Street property owner said the
area is basically built up and the street would appear to be un-
necessary and a new intereection could be dangerous.
Mr. Allan Schultz� 5352 St. Ives Rd, operates a business on Witzel
Avenue and does not feel another intersection would be of any help
to alleviate traffic.
Mr. Orrin King, 1042 Coolidge Avenue was present to promote this
street vacation and feels another intereection would be detrimental
Mr. Arthur Brandt, 700 Hobbs Avenue, said he is on the Planning
Committee of Lutheran Homes and stated concerned with possible
traffic lights at every intersection on Witzel Ave. Their plans
for the elderly and interesections and streets from building to
building would mean slow elderly walking in possible traffic
fast streets.
